    1) I notice that Harlan disinherits his mother.
    2) If the will is invalid due to the slayer rule, Harlan is effectively intestate.
    Everybody seems to assume that in that case Ransom gets a share, but I doubt that.
    As I understand it, the estate would be divided equally per stirpes between his live children and live descendants of his dead children. A live descendant of a live child, like Ransom, would get nothing.
    Daughter Linda would get one third, Meg (as daughter of dead son Neil) would get one third, and son Walter would get one third.
    Grandchildren Ransom and Jacob would get nothing.
    Am I wrong?

      Great observations! Technically the slayer statute would just make any terms for the "slayer" invalid. The will would still apply.

      @@coloradoattorneys-althausl2060 Yes, I get that. The will would not actually be invalid, and Harlan would not actually be intestate. For purposes of inheritance, the slayer would be treated as if she predeceased him. But the will seemingly did not provide for the case where she predeceased him or was otherwise ineligible. So how would Harlan's property be divided in that case? I think according to intestacy rules, which get Ransom nothing. True?

      @@ClydeAdamsIII We love the hypotheticals! Unfortunately, we have to be pretty careful on how detailed we get with questions as we can start to cross the line on legal advice, which isn't allowed. Sorry! For a very basic answer, intestacy in Colorado would usually give to a surviving spouse first, then to children if no spouse, then potentially to parents. In the movie, there is no hypothetical where Ransom would inherit unless he didn't actually participate in the murder :)

Ransom wanted to get Marta considered the slayer and to conceal his own guilt. But even if his plan worked flawlessly, he would not inherit, as I understand the rules; that's my point.

    The will reading portion sidesteps that whole issue BECAUSE it's only a single page, and because the lawyer for the family has that family as his ONLY client.

    My parents not only sat us down, they provided CD-ROM documentation of their trust. This occurred nearly three decades prior to needing it. Not one hot second was spent belaboring the estate.

      @@JeffreyAlthaus the burial wishes were a comedy of errors. Their original plan was for me and my sister to smuggle their ashes out to Point Lobos for a highly illegal scattering, but then a National Cemetery opened near Sacramento, and Dad qualified on account of WWII service. Sis and I were all ready to smuggle *partial* ashes out, but brother in law talked us down. I guess if anyone found out, they wouldn't have been allowed in the National Cemetery? I don't clearly recall, and it's not like we were thinking straight.

    This is why this movie couldn't have been set in Peru. Peruvian law doesn't allow you to completely disinherit your children.
    Over here, if you have living descendants when you die, a mandatory minimum of 2/3 of your estate MUST be divided among them. Any will saying otherwise is legally invalid.

      It's definitely interesting how different every country is with their laws. Here, you can completely override the estate planning laws with your wills or trust.

    Why is she upset he states a spoiler? She's just watching "estate planning scenes" and not watching the whole movie herself. I really wish they just watched the movie front-to-back and edited in these parts to get the bigger picture, enjoy the film, and not speak in a contradicting manner like I just heard.
    Unless she means that it's being spoiled for us, in which case when you click on this video you know full well that anything for this film goes. Now, if he started spoiling something from The Lincoln Lawyer then I'd understand, but we know that if we're watching Knives Out scenes that clips from the film at any point have a chance at playing.
    Anyway, the rest is good. Just thought I'd leave my two cents there.

    I know my county takes wills. Anyone can file theirs for $5, just for safekeeping.

    Thanks for the commentary! So in a case like this, are all Harlan’s assets legally considered to have belonged to Marta from the moment of his death? And does that change if the will is contested in court?

      Normally, once a person passes the things are supposed to go to those listed in a will. Legal title doesn't pass until a deed is done in probate court, if probate is needed. Contests can change everything!

    If you pay attention the younger brunette is saying to Marta just go go go
