The parents of a 1-year-old girl who fell to her death from the window of a Royal Caribbean cruise ship over the summer is now suing the company for negligence.
Indiana residents Alan Wiegand and Kimberly Schultz-Wiegand filed the civil lawsuit Wednesday morning, accusing Royal Caribbean of playing "a major role in the death of our child." Their daughter, Chloe, would have turned 2 this week.

I sense the cruise line had no intention to promote on any level, endangerment to anyone. The lowered inhibitions of vacationers may possibly leave them predisposed toward making less well thought out decisions. Still, there is the possibility of insurance fraud, devisiveness, or a depraved act at play here. As the story continues to flesh itself out, we all will develop a clearer sense of this trajedy.

No way is RCCL AT FAULT. THE Window are open for a cross breeze. I been on 16 Cruises with them and there are usually 5-6 Windows open you have to be blind not to see the Window open. Sorry about that little one but Grandfather is at FAULT. 😰

This is just tragic for the whole family and though I know the grandfather didn't do this on purpose, he, in my opinion, was neglectful. She was up on the railing left to balance herself. What if she fell backward onto the ground and snapped her neck? It clearly would be his fault for not being behind her, protecting her but now she's fell forward, it's not his fault? It is his fault, he should have been there right behind her or not have her up there at all.
So her grandfather dropped a toddler out of the window and it's somehow Royal's fault. Yeah no.

I’ve been on many cruises and the area where it happened I’ve seen those windows and sometimes they are opened but it’s very visible and you can clearly see the window is open. I’m sorry for the grandfather and the family, but how is it the cruise lines fault.

Why did he lift her up there in the 1st place? He literally placed this little one in danger!. It is dangerous to lift children over railings. The railings are there to provide a safe barrier. So that people don't get too close. But if you lift a child over the railing you're just being belligerently negligent. If it was my child I would never be able to in the same zip code as Gramps ever again. He should have known better than to place a child over the railing. Truly tragic that this baby lady's life was cut short in such a way, but this was 100% preventable & is 100% Gramps fault that this happened.
Grandfather is colorblind, ignored the breeze and sound coming through the open window, and completely ignored the railing going across the window. Good luck sueing a company registered in another country.

It's a tragic accident. The child died due to negligence - not the cruise ship but the grandfather's negligence. The cruise ship does not have open hatches or windows on the ground for children to reach. Windows are 3-4 feet off the ground. The grandfather lifted the child up to the window and was negligent in the proper safety of this granddaughter.
Furthermore, how safe is a toddler on a window railing? If the window was closed, the child could have fallen 3-4 feet and get a head injury. The family would be suing for head injury as opposed to wrongful death.

With the window being open when the grandfather leaned over the first time could he not have felt some sort of breeze or smelled the fresh air? How could he not know the window was open? That's not really a good example at all. 1000 glass panels and only a handful open, with no real handle to distinguish between them. Yeah I get it that you should l be able to tell its open. But children with bang on zoo enclosures, people will walk into windows next to automatic doors. The cruise should have clear warnings on the windows that open (as they have on other cruise companies since 2004) why? Because they recognised it was potentially dangerous. If I put you in a house with a thousand door ways and didn't tell you 6 of them have a see through glass panel in them. You are gonna have a sore face. Bottom line poor little girl. Tragic.

She was on the trail which is approx 1 ft away from the window. He was looking out, what he thought was a glass panel, and let her tap the glass like she enjoyed doing at ice hockey games. She lost forward to put her hands on the glass and fell and he failed to catch her. But hey you KNOW what happened. I must be stupid.

Tragic yes, but the family do not have a case. The adult is responsible for their child’s safety. If the kid was able to open the window by herself, yes, there is a case but that was not what happened. What happen was the grand farther did not check for hazard around his grand child. The cruise line at no time encourages adults to put their toddler on the window like that.

The grandfather unfortunately made a bad choice sitting her down on the open window, if the security tape shows him looking over and out the window thus proceeding to sit her on the open windowsill then he’s at fault. There shouldn’t be a law suit against the cruise ship.

He did not assumed it was locked or even closed. He KNEW it was open and had no screen because he leaned his head out of it then reached down, picked up the baby, held her out the window and dropped her. God Bless that poor baby.

How is this the cruise ships fault. We left our kid with babysitter. That's what they are for. The ship is not required to childproof anything. Its made for adults. Furthermore the child was safe standing next to a window at ground level which was closed. If the grandfather hadn't picked her up off that safe floor and thrown her out the window basically...kid would still be alive. Royal Caribbean is not at fault.
