  • How would you feel if you were told to leave your home? Te Tumu Paeroa, the Māori Trustee, is trying to evict Bruce Smith and his whānau off their land in the Ruakituri Valley between Wairoa and Gisborne. But the Smiths aren't going without a fight.

    The Maori Trustee is a Pakeha kaupapa that is set up to alienate Maori from their land. Its not there for the benefit of Maori thats for sure. Me whawhai tonu ke whanau! I will share whanau to show our people that this sort of rorting continues in this day and age!

      The Trustee system alienates owners. Trustees have total powers and by law do not have to take any notice of owners wishes or concerns. The effect of this law is that owners are not owners in law they are just beneficiaries. In my book that is blatant alienation.

      Responsinke Trustees YES are appointed by the landownwrs and are responsible for the land and its administration.
      In the case of TTP they are appointed by the Courts for some reason to be the responsible trustee also..

    nothing as it seems the truth is actually not what is being portrayed here this is only one side of the coin, and there are omissions a plenty, it boils down to a family dispute between siblings one that seized control after time and locked out the others, funny no mention of that aye.

    I dont think people here have read the full story.
    It's all the same whanau that this dispute is between.
    The land was agreed to stay with one whanau for so long and then passed onto another whanau.

    This is like history repeating itself. Historically we are bound to our whenua as kaitiaki. Kia kaha ra whanau. Lording over by governing so called bodies in power are not acknowledging our culture, whakapapa it's another land grab. When does it stop this atrack on whanau...?
    Where is our sovereignty acknowledged not by this government. It has to stop this attack on whanau, whakapapa it's not right.
    We must sort out our whanau mamae too.
    It's ancestral healing. 💜

    Te Tumu Pareoa are often brought in at the request of the Owners and or the Maori Land Court to help weak Trusts with weak governance arrangements or where the land has weak Trustees and simply arent capable of administering the lands themselves or for some other reason acceptable to the Courts. They are put in place through the Maori Land Court with an Application either made by the landowners or through Te Tumu Paeroa on behalf of the Landowners.
    Te Tumu Paeroa, once put in charge have an absolute say on the land in question often holding Veto powers over the landowners and block including the majority shareholders. This is fully legal and has been done at the blessings of the Landowners.
    I would imagine with the Smith case, that the Whanau wish to retake control of their lands and will have to go through the land court application process once more to get the land released.

      James Broughton This family has 60% ownership of the land-they are the bulk of the whanau. Tumu Paeroa are the Trustee already and they are stirring up the other whanau because-I think Tumu Paeroa wants to take the land for their own agribusiness. Judge Issacs is involved too. It's disgusting.

      Olive Weir Olive, I have ownership of lands where I am the predominate (or majority) shareholder also, yet Te Tumu Paeroa are still the Administrators in some cases.
      As for the "Sir Up" I find that very difficult to believe after having dealings with Te Tumu Pareoa in the past and usually its the other way around.
      Te Tumu Paero like I'll say again are brought in at the behest of the Landowners or the Maori Land Court or both and to rid them an application must be made, so lets wait for that.
      Te Tumu Paero ARE the Trustees. Appointed Trustees (from the Landowners) would be there ONLY as "Advisory" with no say!

    Mihi atu ki te whanau, My whakapapa run thru one of the four son of Hucken Smitt. It sadden me to hear but there is a solution. Do you have your own whanau trust in your immediate whanau and get a collective from the other 60% to tautoko you when you present to the court in July. The will can be taken to the High Court. If all else trust in him above always. Lots of love whanau i am here for you.

      For starters, I would imagine that TTP already have the mandate without the votes to make a deal with another farm business. I would also imagine that the land shares is based upon aggregate than individual share holdings as the Smiths having 60% of the vote already hasn’t changed the outcome much as far as the court goes.
      To move to High Court costs big bucks and the High Court always takes seriously, any recommendations from either the lower Maori Land Court or the Appellate Courts first.

    The preamble of the te ture whenua maori /maori land act 1993 states the land is to be held in the hands of the owner ,whanau ,hapu ,sections 2 sub 2 it does not say tumu paeroa or maori trustee

    This breaks my heart.. why cant they just let people live on the land that was passed down... these ppl just keep wanting more and more. They want the land for money buy dont even wanna think about the people whose hearts IS the land. Smh this is sad.

    You may have to apply for your share of the block to be cut out. Costly but worthy exercise. The reformed laws will be interesting to put this case under prosecution. It sounds like there is not any semblance of discourse with the other shareholders.. That is always the problem. Good luck whanau!

      +John Insley John, without you trying to sound to legally minded (because you sound fucking stupid at it).
      The simplicity of it all is that the issue boils down to Te Tumu Paeroa exercising its rights as the legal Trustee. Reading the Case online, I have now established that I was right, it was about unrealistic demands placed upon by the Smiths in the Lease Renewal. Luckily the Courts directed a new Lease process was to take place wich has given them a stay of execution so to speak.
      What you’re talking about is partitioning lands and again that cannot be done without Te Tumu Paeroa approval as the legal Trustee, and I don’t think that’s what the Smiths want, and to partition lands (like land sale) under the current Te Ture Whenua Act takes at least 75% or more of all the Shareholders (Landowners) to approve the partition not forgetting the Courts Rubber Stamp.
      I cannot wait for the Reform to take shape next year or even later this year, despite the Tribunal getting involved.

    Wishing i knew about this earlier when this was current back then 4 years ago.
    Tumu Paeroa i understand Operation is owned by one man.
    Another form a corperation to alienate multiple owners from their lands.
    The sad thing about the Smiths is the lands in that district were confiscated.
    The lands becoming ballet farms for the soldiers as i understand it.
    So Maori land is precious.
    I would say sacred.

    My biggest block is 450 hectares. That's the biggest with a 60/40 share me having the biggest share. I feel sorry for this whanau in saying that learn the law whanau. This is quite simple to solve.
