Clearly, you're heaven sent. In the PCOR document, in order to transfer property FROM my husband's trust (he recently passed) to now me; on Part I Transfer Information Line "L" I check off line 2 as opposed to line 1 as in your video?

I want to make sure I clearly understand what you said during a portion of the video - my interpretation is as follows:
• If the existing deed for a property includes an individual’s living trust, you should not add a spouse to the existing deed.
• Rather, you need to replace the existing deed by recording a new joint deed that shows both spouses (No. 1).
• Then you have to replace the joint deed by recording a new deed to place the property into a joint living trust for the spouses (No. 2).
• Do I have that correct?
If so, would No. 1 above be accomplished in the PRELIMINARY CHANGE OF OWNERSHIP REPORT (PCOR) by selecting “A. This transfer is solely between spouses (addition or removal of a spouse, death of a spouse, divorce settlement, etc.)?
And would No. 2 above be accomplished in the PCOR by selecting “L. This is a transfer of property: 1. to/from a revocable trust that may be revoked by the transferor and is for the benefit of the transferor, and/or the transferor's spouse?

@treeoflifelawfirm I am in this situation. Sole owner on deed looking to transfer primary single family home in los angeles to a revocable living trust with my spouse.
Can you file both deeds at the same time (sole -> joint, joint->living trust) in the same filing with a note on order to process them or better yet on the same form and check both A and L.
Or is it better to add your spouse to the deed first. Then once you have verification that has been done, then proceed to file to move from joint deed -> living trust deed.

Edmund, your videos are very informative. Thank you so much. I have a question concerning current paperwork on file with the County. I completely paid off my house in 2009. All I received from the County Clerk Recorder, was a notarized copy of Substitution of Trustee and Full Reconveyance. I always assumed that this was my deed? I want to do a Quitclaim deed, and the PCOR. Do I need to do anything with the current paperwork already on file, before doing the Quitclaim deed? Thanks & God bless….

Unfortunately, my mother passed away and I was wondering how I would go about putting her property in a trust I have with my wife. Would I need only one deed to transfer it from my mother to the trust or would I first have to put it in my wife and my name and then another deed to put it into the trust?

Is it because this is a transfer from yourself to your trust and not funds were exchanged? Does it matter that if the quitclaim deed shows the consideration is $1? Thanks.

Now I terminated my LLC. I need to change my property title back under my original name. I’m the only person title on this property and this property is in San Diego. I had to complete a PCOR for a 2nd lien Deed of Trust. I also had a Grant Deed that changed the vesting interest from single man to married man. Would this be considered a name change and a new lender?

I never knew this PCOR existed or was even a requirement. Thank you. Is this true for all CA counties? Given this requirement, does it make a Transfer on Death option the better less risky option? I like the TOD option, except for the lack of privacy, which is huge.
I also heard that in CA, there is some threshold, where the value of items outside a living trust will force Probate. For example, I think it is $160K. So if a home has only a TOD recorded, and the home is worth 200K, does this force probate?

Should the buyer name and mail property tax info to (name) match the name of the living trust or the actual names of the trustees? We gave our trust a unique name but in that trust it does name my wife and I as trustees and grantors.

Reassessed. These lawyers are real top class criminals. They just don't want you to have total ownership. Please address the procedure to do a common law trust not just statuory trust.
