Nottingham triple killer Valdo Calocane's sentence not 'unduly lenient', rules Court of Appeal

  • The Court of Appeal has refused to change the sentence of Valdo Calocane, who killed three people in Nottingham last summer.
    The 32-year-old was given an indefinite hospital order after admitting the manslaughter of Barnaby Webber, Grace O’Malley-Kumar and Ian Coates by reason of diminished responsibility, and the attempted murder of three others last June.
    The Attorney General referred the sentence to the Court of Appeal in February, with lawyers arguing last week that Calocane - who suffers from paranoid schizophrenia - should be given a “hybrid” order where he would be treated before serving the remainder of the sentence in custody.

      'prosecutors argued that he was the “mastermind” behind the robbery as he organized it and purchased the weapons'
      'The officer Beshenivsky was 38 years old.. She was shot dead at point-blank range by one of the three men who carried out the robbery. Her colleague, Teresa Milburn, survived after being shot in the chest.' (not shot by him)
      Search 'Piran Ditta Khan ' and 'Judiciary' and the Judges sentencing remarks (includes details of court evidence, conclusions) can be accessed on Judiciary page.
      'Piran Ditta Khan, for the murder of Sharon Beshenivsky, the sentence is one of imprisonment for life. The minimum term would be 40 years but for the 1578 days I have already referred to and which I shall deduct. That results in a minimum term of 35
      years and 247 days, taking account of the seriousness of the offence.
      On Count 2, robbery, the sentence is one of imprisonment for life, with a minimum term of 10 years’ imprisonment.
      On Count 3, possession of a firearm with intent to endanger life, the sentence is one of
      imprisonment for life, with a minimum term of 14 years and 8 months’ imprisonment.
      On Count 4, possession of a firearm with intent to endanger life, the sentence is one of imprisonment for life, with a minimum term of 14 years and 8 months’ imprisonment.

      imprisonment.

      Not sure the judges do. They can only deal with what is front of them and what the law allows. If the police were aware and did nothing, that is an issue, likewise, parole officers (Though I can find no mention of Calocane having one.). Politicains have more facts (hopefully) than you about criminal justice and mental health and should take a wider view. John Rawls original position (Creating laws where you have no idea who you are in the world with those laws.) would be a good place for a politician to be when creating any law.
      I'm not sure general prison population best serves anyone for Calocane. He has severe mental health issues, which agreed should have been flagged earlier, But a secure hospital for the rest of his life does not seem leniet to me.

    • @justwayne4785
      @justwayne4785 Před 16 dny

      @@jiubboatman9352 They all play their part, there are two cases that come to mind, a judge sentenced a man who r*ped a 12yr old to 180hrs of community service, and a judge that gave no punishment to a 17yr old who did the same to a 13yr old because the 17yr old said he didn’t know r*pe was wrong (religious reason)
      Then you have the police arresting a victim of assault because arresting the person who committed the crime was seen as possibly inciting the crowd.

  • @kevinwake8789
    @kevinwake8789 Před 17 dny +7

    Of course its 'unduly lenient'. The hospital sentence means he could get out in 5,10,15,20 etc years if the psychiatric hospital deems him recovered and FIT FOR SOCIETY.
    HE SHOULD BE IN PRISON, AND COULD HAVE GOT MAXIMUM 40 YEARS FOR EACH MURDER, AS ALL 3 WERE PREMEDITATED IN MY MIND.
    Belmarsh has a secure hospital wing he could have been sent to, for example (its where tommy R was did his 6 months sentence, for filming outside leeds court on sentencing day).
