    It can take a very, very long time to get approved for SSDI benefits. The question is, "why?!?" In this video, we explain what causes the long waits, how the application process itself can factor into the waiting times, and what an applicant can do about it. We also explain how the state a person lives in can affect the wait and approval rates for the application for Social Security Disability Insurance benefits.

    I had to obtain a Lawyer. I was denied right away after my Family doctor plus specialists stipulated RA is in every joint. My knees got drained a few times as they swell to grapefruit size off and on. Plus Lupus. I worked from age 17 to 34. I didn’t ask for the Lupus to become much more harsh. It took 4 years before seeing a judge. I was started off at the lowest as if I never paid taxes in life. I have a CAM license. I was in property management at nice apartment communities. I’d give anything to be able to walk a lot when knees are swollen. My body is going to cripple I was told. They told Social Security that and I was still denied first time. I waited 15 months for a denial. I see so many getting so much help but I’m childfree so I do not qualify for any extra help. I’m below poverty. I can’t even look in my mirror I’m so depressed. I hate waking up everyday!

      @@talibiden4440 have you worked since 2013? I worked from the age of 15 until I was 44. Never even collected unemployment in my life. I Had major back surgery In 1998 and have been living with misplaced screws In My spine ever since . No Dr will remove them as they are afraid they will paralyze me. I haven't worked since 2016 and was denied my benefits at the hearing and that took 5 years and I only got one hearing Infront of an administrative judge. In that 5 years. And I was told I couldn't apply again as I havent worked since 2016. I was told I need to go back to work and then try again. Hello!!! I am disabled, that's why I applied for disability in the first place. That should prove right there that I can't work. My history should speak for itself and the fact I have been out of work with NO paycheck all this time should further validate that I am disabled. The screws in my back look likes I jumped off my roof and landed on a piles of screws. Sure don't look like a neurosurgeon specialist put them in there. Talk about a bitter taste u have to this "great" country. I paid my dues. Worked 18 years with misplaced screws until I could not work anymore. Now 2 levels above my fusion are going bad. My neck is messed up with huge bone spurs. I have post Lyme disease, and RA. I see people getting full disability with their pinky injured. Pisses me off something bad. These people that say it took them ten years to get their SSDI had to have went back to work. Were they really disabled if they could go back to work?? I know people have to do what they have to do. It’s no joke, I waited almost 3 years to see a judge, and I was denied. Like a lot of people my situation was pretty unique. I kept on passing out and going into seizure like activity. The doctor called it, but they couldn’t find out what was wrong. I had an episode right in front of an emergency room doctor he found ground glass particles in my lungs, which is kind of a catch all phrase, I think it was due to my time in the Middle East for the first golf war desert storm. my story is very long story, but basically they gave me some medication that treats, both a fib and migraines, and the passing out in seizures stopped. I was a over the road truck driver at the time. I obviously got fired from my job because I didn’t have a drivers license anymore after I stopped having seizures I did get my drivers license back. I worked for Walmart for 2 1/2 years and then I worked for the post office for two years.. Now at the post office, I hurt my shoulder, diagnosed with a type two slap tear. I had an operation through Worker’s Comp. and now there getting ready to send me back to work, but my shoulder still is killing me. I’m trying to way to apply for disability again from my shoulder, knowing I could be out of work for three years and not get it on the other side I don’t think I can do my old job anymore, working for the post office. You have to carry heavy packages when you case the mail you have to reach way above your head which is very painful for me but for any that’s got this and good luck with any problems you have just be aware sometimes you can wait three years and get denied.

This process is very painful and long and its so hard for people to make it through. Stay strong and keep your head up Angelica! You will make it through this! Hiring a lawyer to help you out really does make a difference. If they deny you again on your application, appeal it and then hire a lawyer (or maybe you can hire a lawyer right after the initial decision). No matter what happens don't give up or lose hope. If your disabilities are keeping you from working, you deserve these benefits and you will get it. While waiting on all of this to come through, you can try applying for SNAP benefits, Temporary Assistance (TANF), or see if you can do so side jobs that pay cash up front so that a W2 isn't filed. This can include: cleaning jobs, baby/house sitting, online surverys, etc. You might even be able to work part time up 25 hours but I think that can only happen after you are denied the initial claim and appealing it. Don't lose hope Angelica and just know that we all want you to be happy and get this approval! You are not alone and I am hear for you if you need someone to talk. Stay strong and take care buddy!

      Hi, Jonnette - that's a great question. You can appeal a termination of benefits after a Continuing Disability Review (also known as a "CDR"). You need to file a particular form, called a "Request for Reconsideration - Disability Cessation," also known as Form SSA-789, within 60 days of being notified by the SSA that the benefits are being terminated. Unfortunately, this isn't something Citizens Disability can help with, but a local attorney that handles SSDI/SSI or specializes in SSDI/SSI cases should be able to help you. Good luck, Jonnette!

    My 2nd filing got slowed down because the covid shit, then my attorney got sick(non covid issues), then she passed away. The next day after my court date on my 2nd one I got something in the mail saying my first one got sent back to be reviewed because the federal appeals said the personal judge did not give enough weight and dismissed things my doctor's were saying.
    I have won my 2nd one and my first one is in the courts somewhere and if that judge happens to agree with my 2nd one I will get an extra 2 years in back benefits.

      I feel bad that you both got turned down even after your doctors wrote a letter on your behalves. Don't lose hope or faith in yourselves. You both do deserve disability benefits so just remember that and don't doubt yourself on that. Keep it strong and keep fighting no matter what happens. Going forward though, if at all possible never reapply for benefits. Instead, if you get denied appeal the decision and hire a lawyer if possible. The majority of denials come from the initial decisions and the majority of approvals come from the court hearing with a lawyer present. At the hearing stage the social security people get to ask you questions about your disabilities so that's why your chances of approval are a lot higher at that stage. Patti you have a lawyer now so good job with that. I hope Nikki is able to find one as well. Their doctors I think are just going to do what examinations are required for the application. I'd say just be yourself and ask those doctors the same questions you would ask your own doctor. If your doctors say you are disabled then theirs should say the same thing. One thing you can do to help your chances with getting approved is to get a Residual Functional Capacity (RFC) form completed by your own doctor. This is basically a form your doctor completes on your behalf which is basically telling SSDI that you are disabled (unless your doctor doesn't think so). It can be very beneficial. I hope the both of you stay strong. You are not alone and your happiness does matter so don't ever feel like it doesn't. If you need anyone to talk to you can always reach out to me. Stay awesome!

      Hi Derik, you will need to reach out to Social Security in regard to that as they are the ones who handle payments.

    Is it a good sign if Social Security cancelled my mental exam that they have scheduled, they have sent me paperwork to fill out and they are waiting on that. I applied last July,2019, my onset date was a year before July 2018. Mine is for depression.

      That's a really good question, Mike. We're not sure if we can say it's "a good sign" or not... we'd need to know a lot more about your case before we could hazard a guess (but please don't share details here where anyone can see them). There could be any number of reasons why the exam was canceled. But as always, the best thing you can do is be prompt and thorough with your paperwork and medical records/evidence. Good luck, Mike!

      Hi Youlanda! There are different non-medical requirements for both SSI and SSDI. If you have questions about why you did not qualify, you can call your local Social Security office.

    Is arthritis a disability?

    • @CitizensDisability
      @CitizensDisability  Před 2 lety

      Each claim is different and Social Security (SSA) takes all conditions, past work history, and education into account when making a decision. In most cases one condition is not guaranteed to be considered disabling under SSA's rules. If you are seeking representation, please contact our office.
