    DR:
    Attorney Menchaca, can you answer some of the frequently asked questions about the E1 visa?
    GM:
    Absolutely, please ask.
    DR:
    What exactly is an E1 visa?
    GM:
    An E1 visa is called the treaty trader visa, but nobody really knows what that means here let me break it down.
    It's an import export visa, it is designed to promote international trade between the United States and other countries so this visa is issued to people from certain countries who are in the business of regularly importing or exporting things products or services between their country nationality and the United States.
    DR:
    So you mentioned that this visa that sometimes called as an import export visa, does this mean that you have to both import and export to apply?
    GM:
    No, not necessarily you can do one or the other or both. So, for example you can take products or services from your home country and send them to the United States and that works, and that can qualify you on its own or you can take products or services from the United States and send them to your country of nationality and that works or you can do both and that works as well.
    DR:
    So in that case how do you prove that you're importing and exporting?
    GM:
    So for example, I have a client who imports and exports that produce, vegetables right so I can prove that he does that with the transportation company that he hires you know, there's a lot of documentation showing that they pick up merchandise at his place of business and transported and then deliver it to his clients in the United States, and then I can also show that there's a bills of lading, documents involved in the border crossing mechanism through the customs broker and then I can also show financial transactions where the clients in the United States pay his company abroad so there's a variety of different ways of proving it varies on a case by case basis.
    DR:
    Okay and for example let's say that I would like to bring somebody from my home country to work with me here in the United States are they eligible to apply for this visa?
    GM:
    So the E1 visa, can be issued to the owner of the company, or to employees of that company. If the employee shares the nationality of the owner of the company then the E1 visa is a favorable option and if the nationality is different then we can look at different types of visas, so there is always options to make that happen.
    DR:
    So with your experience what are some examples of your client's businesses that qualify for this visa?
    GM:
    Oh, look I've been doing what I do for a long time so I've seen lots of different types of companies that qualify for the visa. I can think of clients who import or export that fruits and vegetables, raw materials such as copper, petroleum byproducts, cement byproducts, and many other types of products.
    DR:
    What about on the service side?
    GM:
    On the service side I have many other clients who do are things such as consulting services, design services for websites and graphic design, computer services, transportation businesses, who you know provide transportation services, moving products across international boundaries, customs brokerage services, insurance services, so many.

    Hello Atty. Menchaca, how about goods like clothes, bags or shoes? Is it qualify for E1 visa?

    hello, does the e1 visa work even if I sell digital products such as sports training and online courses? and as for physical products such as snacks or other foods or even shoes, can I buy them in my country of origin and always sell them in my country of origin? or do I have to buy them in America and sell them in my country of origin?
    I mean, I am Italian, can I buy from a supplier in Italy and sell it in Italy through my American company? or does this not allow me to apply for the e1 visa?

      Francesco, hi. So yes, the E1 works even if you are selling digital products. Of course it works for physical products also. For example, you buy the products in your country of origin and then sell them in USA (or vice versa) -- this would work for an E1 visa. However if you buy in your country of origin and sell in your country of origin, you would not be importing or exporting with the USA, so that would not work. Good luck.

    E1 visa dependent will be considered an international student or a normal student in the university??

      Hi. The answer to your questions varies depending on the state in which you plan to enroll in university. I recommend that you direct this question to the International Student department of the school where you wish to study.
