    For question #9, wouldn't the answer be A due to implied agency? If they have been "working" together for months, I believe a court would take the time length into consideration.

    Question 9 is baffling. Can anyone explain that? There Agent isn’t working with the seller. There’s no seller mentioned. Wtf

      One of the main concepts to learn in real estate school is that our system is a system of sub agency. If we have not been hired by the buyer using a written agreement, we are always representing the seller. Doesn't matter what seller. Until the mid 90's buyer's simply were never represented. When the MLS systems were created in the 60's a system had to be developed that would allow two different brokers to be involved in a transaction. One broker listed the home and another produced the buyer. Again, during this time buyers were NEVER represented and you did not give a buyer advice. So the agreement is that everyone is representing home sellers when they are describing that home to a buyer. Now, we can have sign representation agreements with buyers that changes who you represent. I would encourage you to watch our video "Customer vs Client", it expalins it all.
