  • The Supreme Court today delivered a critical judgment on the rights of Muslim Women to Alimony ending decades of political debate around what has come to be known as the Shah Bano case. The Judges made it clear that a Muslim woman, just like any woman from any religion, can apply for maintenance under Section 125 of the CrPc. The court rejected an appeal by a Muslim man from Telangana who did not want to pay his divorced wife monthly alimony. Amid this big verdict, which will invariably open the doors for a new debate on a Uniform Civil Code, we speak to Hilal Ahmed, political researcher and scholar who has just published an important new book - A Brief History of the Present, Muslims in New India

    Very confusing for me.. I couldn't conclude wat exactly is he saying.
    Reservation in private sector is a problematic proposal as private sector cannot be forced to do social reform. Some private players may start voluntarily in their organization but a law which mandates such thing id gonna lead to flight of capiral

    21:30 Barkha dutt speaks for the elites. It's not sufficient that the elites in the army have pluralism. Do the masses have pluralism ? Does Kashmiri Muslims have plurality in them ? Does Pakistan which is an agglomeration of indian muslims + access to power have plurality ? Does Owaisi have plurality ? If so why did he oppose the women's reservation bill ? And why won't muslim women in his constituency punish him for that ?
    Why did Muslim women come out to protest against CAA but not against Sha Banu or against Owaisi for opposing the women's reservation bill ?

    Let us get the things straight: the present judgement of the Apex court is not new: way back in 2001, the Supreme Court delivered similar judgement enabling Muslim divorced women to either to get maintenance under125 of the CrPC or, Muslims women's Act1986 according to her option. It is complementary right of divorced Muslim women. Either she can opt for 1986 Act or Section 125 of the CrPC. If she opts for maintenance under section 125 of CrPC,she can't remarry and if she had son above the age of 18, she can't opt for maintenance under Section 125 CrPC. If she opts for remedy under 1986 Act, she can get Mehar,and lumpsum amount. It is for the divorced Muslim women to take a call which makes economic sense as well as her financial needs.
    However, Section 126 of the CrPC stipulates if she opts for maintenance in one of the Acts ,she can't avail remedy under the other . The Supreme Court has reiterated the earlier position of the same court laid down in 2001judgment.

    The Punch line of Rahul Speach was when he said BJP/ RSS do not represent the Hindu religion. He fell short of saying that BJP & RSS represent a Polythistic Brahmin religion and not a Hindu religion. Each caste is a more significant Polytheistic religion in its own right, while the Hindu religion is not even a Polytheistic religion. The Hindutva of RSS is actually a Brahminvadi Polytheistic religion, which they like to call the Hindu religion. The Hindu religion came into existence during British rule. They encouraged it by clubbing all non-Abrahmic religions under the umbrella of the Hindu religion. They did it primarily for their administrative ease and not to support religion. That is why we do not find any King in History who called himself a Hindu King. Even Lord Ram was not known as a Hindu King. Nor do we find any reference to Hindu religion in any holy book of Sanatana Dharma. Be it Vedas, Upanishads, Bhagwat Gita or Ramayana. We do not see any temples from the pre-British era, known as Hindu temples. During British rule, the Brahmins started putting a Barat of Idols in all our temples to pocket the revenue and started calling it the Hindu temple. Hence, we had no followers of the Hindu religion between the Vedic times and the British era. We still vote for our caste / Polythistic religion. The founders of the nation were wise people in giving us a secular constitution and not a Hindu / Brahminvadi constitution, which the Brahmins of RSS want to create now.

..This will kill startup culture and small business (and only help corporates because no new startup emerges to challenge big corporates
.like Jio did to Idea and Reliance to many textile giants)
.because all startup’s will be busy in following new License Qouta Raj
Companies are here to make profits and grow not do Public service and justice that is govt work
This policy another way to escape politicians who can’t answer why after 75 years they have not changed society and given good education and healthcare to backward castes

    The moment you give reservation to Muslim and Christian dalits, entire SC&ST will be converted and India will become a Hindu minority country. Present reservation policy is keeping many converted SC&ST as Hindu, at least on record.
    Reservation in private sector will kill enterprises for ever as merits will be over looked. Give reservations and financial assistance only in education. Thus we can provide opportunity and a level playing field to every section of society to uplift themselves. Jobs in any sector must on merit. This only will improve our productivity and help our nation scale the heights.
