Hello everyone, this is Ross McDonnell, director of Swift Justice, a film about Sharia Law under the Taliban. Thank you for watching.
We visited Helmand province in the aftermath of the Taliban takeover to see how the Islamic Sharia Court system was functioning at the village level for Afghans, what their issues were and crucially what role women had in the courts when they came to look for justice. We're here to feedback and answer your questions over the next couple of days. Enjoy the film.

At the strat pf this Islamic Emirate government, after the foreign invader terrorists and their Afghan puppets were sent running, our Islamic Emirate of Afghanistan government put in place a law forbidding forced marriages and another to ensure that women get their rightful inheritance, and this is strictly followed. This drug addict was also probably taken to drug rehab as our Islamic Emirate government is working hard to help our drug addicts.

Very happy with the woman's case....justice is justice
Except at the end of the day she has to cover her entire body lest she be beaten, and she cannot get an education lest she be beaten, and she cannot be independent lest she be beaten, and she has to live with her aging father and her children, and when her father dies she will have no protectin, will be forced into marriage... and beaten.
The reality is that there is no such thing as justice if you are a woman living under Sharia Law.

Cases also took a very long in the court system of the previous government and also involved bribery often. That is why some people living in areas under the control of the previous government and their justice system, would go to Taliban courts in Taliban controlled areas to get their cases resolved quickly.

For the poor, needy and oppressed this is the best way to solve all their legal issues without the luxury of a well-paid lawyer. In other countries, such trivial issues drag on for months after having paid the court and the lawyer's fee. Hats off to the Taliban for speedy justice.

It's an honor for women in Shari'a law.
I've been twice a defendant in Sharia courts in the Middle East, once defending the interests of my company and the other time, personally, following a minor car accident. In both cases, I had to swallow my logic and pride and take a loss with a small "l" rather than risk a big "L" on appeal. On the plus side, it was quick and cheap (no lawyers), and the fine was miniscule.
Islamic law is based on Logic and Justice and wisdom and I don't know exactly what type of court you are talking about where you have to swallow your logic

In “civilised” nations, the process of obtaining justice is itself a punishment. It can take years of gruelling court proceedings and a fortune in money to resolve disputes, wading through Kafkaesque bureaucracies and incomprehensible legal jargon.
This means that the mechanisms of justice are not available to the underprivileged people who can’t afford lawyers who can navigate the system on their behalf.
Thus, law becomes another tool for the powerful to keep their inferiors down.
Whether or not you agree with the actual values, principles and laws of the Taliban, it’s nice to see an accessible way of doing justice.

While the system may seem arbitrary, partisan and even partial, the truth is that justice system in many developed countries is just as bad. Courts are mired in corruption, delays and is just an endless money making machine for the ministry/lawyers/judges who make it tick. The fact that the Taliban court was quick and in this instance, truly helped the oppressed woman, is encouraging and seems progressive.
Don't let one ruling give you rose colored glasses.

If one is able to remove personal and cultural bias while watching the case of the woman, one can say the shariah code of law is as liberal as one can be when viewed in context of their society.
I would say just but not liberal. This equality thing is eating the west away, and Sharia is just about giving autonomy where autonomy is just and leaving it otherwise.
A woman for example has to be given a gift for marriage, a woman has to be taken care of either by Husband, Brother, Father, Uncle… ect. A woman can choose who to marry. But if she decides divorce, she should give back the gift.

I think there is credit to be said that the court gave the women the option to speak their mind and consider what it is what they want. It still has a lot of ways to go to make it credible, such as whipping someone to “speak the truth” instead of relying on cold hard facts. But it’s a small step that shows a small chance of hope for Afghanistan.

Clearly the judge listened to every one's argument took a day to ponder, allowed the woman stay in the court room to represent herself and asked what she wants to do, and agreed with her. Respectfully, I don't agree with Sharia law but saying women don't have rights under Sharia law would be completely wrong and this judge has proved it with his verdict.
