  • A California couple says they can’t move into their new home because the previous owner refuses to leave and can’t be kicked out because of the state’s ongoing freeze on evictions during the pandemic. Tracie and Myles Albert used their savings to buy a four-bedroom home in Riverside 14 months ago. They’ve been paying the mortgage every month, but haven’t been able to move in. "He just said he wasn't leaving, that was it. Wasn't going to leave the house, barricaded himself in the house,” Myles said. #InsideEdition

    That man no longer owns the house and is simply trespassing on that couple’s property. He should be evicted because he’s the one trespassing, not the couple who owns the house.

      Exactly... I don't understand the stupid surrounding this. If they bought the house in January before corona. Why weren't the cops present while the old owners were being forced out??! These people were being way too nice to this guy at the beginning. Jan 20 papers signed, Jan 21 police kicking out the tenants. How hard is that??

      Thats what I thought. He doesn’t have a rental contract so there would be no eviction. So its squatters rights, which I am not sure how that works.

    This is real estate fraud. At this point, I would declare the house sale a loss. Instead of trying to move in, I would take him and his real estate agent to court for real estate fraud to get back the amount of the down payment and the mortgage you paid for. This is ridiculous that California doesn’t give victims of squatters any rights to their own house.

      I agree, but California’s eviction moratorium runs until July & it’ll probably be extended beyond that. And even once it’s lifted, the courts will be so backlogged that it’ll take years before the case gets heard. These folks may not get to live in their house for a very long time.

      The only legal way to remove someone is Landlord and Tenant Court. Only a Judge can evict someone. They should take them to Court or get the Police 👮‍♀️

    I actually feared this. I bought a home in Texas and the pervious owners had not communicated with me at all about their move out or wanting to do a lease back. I arrived at the home Friday night before our closing Monday. They had not packed a single box. My realtor said they legally still owned the home and they technically did have to be out of the home. The home was still packed with their stuff. I grew concerned and told my realtor I would not sign the closing documents without a final walkthrough the day of ensuring they were out. The previous owners were livid at me. They had to pack an entire home by themselves in two days. There realtor would help them pack, and I would later learn they did not have money for movers nor truck. They literally took the light bulbs out of every light. Left me trash, broken furniture and a weight set....Parts of their RV septic system. They did remove the bulk of their stuff. I signed the documents, as it was bad enough to notice but my lease was ending on my home. I fully believe they were not planning on leaving either out of a necessity or simply didn't care about my needs.

      Tthat probably won’t happen. As a property manager myself you can force any squatter out in any way in the first week, after a week or two they basically “legally” get ownership rights in a way and it’s a legal nightmare from then on that takes months and makes you want to burn the place down and just collect insurance money

      When you d9nt pay your mortgage the bank can Auction your home without you knowing. But I'm sure that Landlord or owner knew coz bank will send them letter. Owner didn't know his house maybe was auctioned and sold. Theres gonna be more like this will happen in mid year or towards end of this year like hundreds of thousands.

      I think the real problem is the bank and its predatory lending. That guy went into foreclosure for whatever reason and then the bank sells the house below market value and people like this couple snatch it up.

    As this problems persists in several states the new way to deal with squatters is to deal with them yourself. Don’t call local law enforcement. Just man up and kick them out, if they get violent show them greater force. For instance having a gun on you but not brandishing it and waving it in their face. Just let them know you have it and will use it if things escalate, tell them to get out or face serious life consequences.

      In California if someone lives in a residential for more than 14 days instantly becomes a tenant. You need a court order to evict tenant if he refuses to leave. Seeing as he lived there for years before selling he's covered by tenants rights. Courts aren't evicting anyone right now.

    Nothing a black eye won’t fix.... I delt with this exact situation a couple years ago when buying my house. I called the police and they said there was nothing they could do at the time, but after they leave if I was to force my way in and just happened to be attacked by the previous home owner I would be able to defend myself without prosecution. Guess what? I had my property within 24 hrs.

    As a real estate agent, this is why we insist on being sure there is a checklist. What about a final walkthrough prior to closing? That would have confirmed and verified the previous owner vacated the premises. As soon as closing papers were signed and the mortgage loan was funded, the new owners could have changed the locks immediately. Never close without a final walkthrough! It should be beyond an eviction at this point. This man should be arrested and physically removed from their home!

      I hope they've spoken to an attorney about suing the squatters for a whole host of damages. Let's start with all the back mortgage payments, utilities and I'm sure there is damage to the house.       Well, that's the problem. They own it...they signed the papers, so they're on the hook for the mortgage and monthly payments. They might be able to sue after the squatters move out, but that would also be drawn-out and painful. The Sheriff's office is not being as creative and helpful as they could be. If these folks were influential politicians, the Sheriff would have figured out a way to get the squatters out by now. And yes, the occupants will probably damage the home out of spite.

    Two years ago, during the closing of my house, the real estate agent, the owner and myself found squatters in my soon to be house. It was a young man and his girlfriend. They said they rented the house from someone on Craigslist. It took the owner a month of going to court before the marshals finally came to get them out. Even though he was a scammer, squatters seem to have more rights than the home owner.

      @@JoshuaBd yes, I agree! The squatters had the nerve to try to blackmail the private detective that the owner hired to look into who these squatters were. One day the detective knocked on the door to talk to them. They told the detective they would leave for $3,000 if no money is given, they're staying. Even though they were squatters, I did feel bad to see all of their furniture eventually put out on the street.

    I am a senior single woman tenant. I took a young guy ESL student, and after he got in to my place he stopped school. I asked him to leave based on written agreement i had with him, but he doesn't care. I slept in shelters/street last week.I am paying high rent and called useless van police, but they don't help!! Any advice at all?!!! I have my sick dog with me in streets, whereas he is half my age, has a car and sleeping in my bedroom!!! God please have merci on me and help!!!!!!

    I cant imagine the condition of the inside is going to be... When i lived in a duplex I had a neighbor who got evicted after squatting for six months and due to the fact they didnt take accountability for their actions they conepletely wrecked the inside of the house. Destoyed the walls, threw paint everywhere, piled dirty diapers everywhere

      It already seems like it is pretty damaged unfortunately. The yard is already ruined. I would not be surprised at all if the inside is in just as bad of shape.

      Well technically it’s not the realtors fault. The owners HAVE to be the ones doing the final walk through. If they weren’t the ones that did it, then yes the realtor should be held accountable for not telling them that they (the homebuyers) need to be present at the final walk through.

    Well actually hes NOT a renter, right? Shouldn't he now be considered as trespassing?? He USED TO own the house. He received the money and now the deed transferred over to the new couple.. Sounds to me like the police arent doing their job! I didnt see any sign of FREEZING weather either. No coats on... come onnnnnn

      Exactly! police don't always want to do their job around here, they'd rather do simple little violations of missing head/tail lights just to fill their daily quota. They're basically useless when you really need then...like for this case. I agree with you though...that guy should've been considered as trespassing and told to leave or been arrested.
