- In this video I explain some of the foundational laws and concepts surrounding self defense in California and an individuals right to use force in self defense. This video is subject to change, and edits based on changes in the law. Also, as a human I am not infallible and I can make errors as well. Therefore, what is expressed in this video is also subject to human error. Furthermore, self defense and the use of force against another person is a serious topic. A pointer for the Armed Scholar who I like very much. If it's justified self-defense it's not "murder" which is what you called it in the video. All murders are crimes. Not all homicides are crimes. Take it from a cop.
@Masud Sadat California actually has pretty decent laws about self defense. There is no "duty to retreat" like there is in some states. Some homeowners get arrested but that's WAY different than being charged.
@Masud Sadat yes, sometimes police even book people and then let the prosecutors drop the charges. Always be careful what you say to the police after a shooting. After something like that you might not be thinking clearly or remember everything exactly right.
I don't like guns but i have a question, yesterday I was robbed with a gun fire, the robber took my wallet and my phone, but he was detained 40 minutes later by the LAPD, so I recovered my belongs. But I just feel so grateful because I am still alive, and I don't want to press charges to the burglar, my question is: what would be the charge for the robber that had a gun in his possession, either it was legally or illegally or if he was using a fake gun for threatening his victims?

Sadly it will never happen. There are two separate recalls currently for Newsom, and in the first 30 days a whooping _10 signatures_ were collected.
The problem is the recall effort is horribly disorganized and is not being supported by a unified organization collecting the signatures. The people wanting this recall effort are placing the burden on others to do their work to collect the signatures.
They need to get organized and not put the cost and effort onto other individuals.

After almost having to shoot one of three ex-cons who came to break into my home with my partially-disabled mother, I immediately signed up for no-fault (I think it's called like that) or "self-defense" insurance the following week. I had been contemplating it but took no action. After I enrolled, I had two other incidents but they weren't as serious as the first one. So I felt comfortable with my decision. My plan is quite generous and allows anyone at home to be covered for having to use lethal or less-than lethal self defense. I'm covered outside of my home as well. I'd rather pay the monthly premium than take my chances. Even after winning a potential lawsuit, you may have to face a civil lawsuit. This is where the criminal's family may go after you and win.

The fact that California makes it so hard for an American citizen to defend themselves with a firearm is unconstitutional. I could have the cleanest record, and I do, if THEY feel I shouldn't have the right to carry, if I'm confronted with a criminal with his own firearm, I'm screwed. What are my options, beg for my life? Toss my shoes at the criminal? Tell him or her to wait a moment because I need to call the police? What gives anyone the idea that a criminal cares about having a CCW? The Stand your Ground law means very little when California, especially Los Angeles county, decides for you whether or not the 2nd amendment applies to you.
Unless you bribe the sheriff with money and gifts, good luck getting a CCW.
Laura Dee I feel you, but if you lived in San Bernardino County You would already have a CCW. The Sheriff in SB is a defender Of the 2A.
A CCW here in CA is dependent on which county you reside in.
No problems in the majority of the counties. It’s maybe 15 out of 50 that won’t issue. Those 15 are also the most populated and liberal counties.
It's not hard to get your ccw.. Always avoid any confrontations.. I was told a few times, ccw or not, you have the right to defend yourself from deadly threat here in California... No matter the laws, common sense will always kick in.... Of course, having a clean record overall.

If you plan to carry weapons it should be trained to be second nature to know what is necessary and what is not.

Your perception of danger doesn't change the reality if you are in danger or not, just because i may believe someone is going to kill me doesn't make it justified for me to kill them first.
Unless you want to spend a very long time behind bars, it is absolutely necessary to abide by self defense laws.

No don't use USCCA, there absolutely useless for anything but "insurance" and most customers with USCCA has been turned down a staggering 60 percent of cases due to Grey areas in self defense laws. The insurance only covers property damage, training courses, firearm permit fees, additional training (advanced techniques), damage to firearms and the very small chance to help pay off court fees or send in there own lawyer which they rarely ever do. There literally taking advantage of you like any other corporate entity in this country though, theres so many Grey areas its ridiculous. Instead I recommend a law bureau that focuses on gun related self defense cases as well as 2A rights. I've heard a lot about Attorneys on Retainer and there the one of tip law firms in the country that will actually handle any legal case given to you. The rest of your stuff can all be done at a registered ffl or gun store.
I'm 5'2" and 120#. A single punch from a 6'6" 260# thug could kill me. I'll take my chances with the jury if I'm lucky enough to survive being punched.

I've heard stories of women being convicted for shooting home invaders, she followed the law, the guy broke in, she shot him, and she's now in prison for defending her life.
Can you make a video about why self-defense cases fail in California? If it all comes down to the jury's opinion then what is allowing jury's to use their opinions to convict truly innocent people?

One of my early supervisors was visiting his future wife in Texas. On the way back to Illinois, he got tired and pulled over to sleep in back seat and woke to have someone rummaging thru the front seat. What did you do? Shot him and pushed him out and drove away.

What if u don’t have a ccw permit but u still carry for just this type of scenario or say ur going home from the shooting range and u still have ur weapon on u.. can u still be cover under the self defense or stand ur ground law? Or those laws don’t apply to people that don’t have a ccw? Ben E Chupa Unfortunately, even carrying your weapon from and to the range your gun cannot be loaded and the ammo can’t be within reach. Ammo in car and gun in trunk or visa versa. So you are still at a disadvantage, Yea it stinks.
Even if you are exonerated as far as self defense goes, you will still be charged with felony firearms violations.

Hey Steve trip... I been told u can keep ur gun and loaded mag right next to each other and even ammunition as long gun is unloaded and it’s in a locked box or case.. if ur case or box needs a key to open or unlock I been told it’s even ok to have just one side lock.. as long as one side it’s ok but u can keep gun and mag and ammo in same case as long is unloaded and it’s in the trunk or day u don’t have a trunk then if I remember right even under the back seat or say u have a Jeep then a cable must secure ur case so it won’t be stolen but still only one side locked and gun and loaded mag side by side just gun unloaded..
The key factor with California on this particular law is to pay attention to the "force necessary"..in other words... somebody being in your home isn't enough to just shoot and kill if they turn away at all... you can't shoot them in the back or if you injure them first you can't keep firing..so they're laying on the ground with a wounded knee after one shot you cannot shoot them again. Use that knowledge to learn to shoot better the first time. And shoot right away. It's also important to make it clear that you feared for your life otherwise you are in deep doo-doo

California does more to protect criminals than a citizen defending themselves. As a Californian born and raised it sucked moving out of state. But again it was the best decision I ever made. Proud to call Nevada my home.

Hold on, people. Listen carefully to what he is saying. You first must investigate wether the person is there to harm you, not only that you have to do that, you also must determine at what level of harm will the criminal inflict on you before you even use any type of deadly force. In short, you must interview the criminal of what their intentions are, and at what level of threat he/she decided on to use on you because, the type of force you will use on a criminal has to be proportionate to the harm a criminal is about to use on you, so, before you use any type of harm against a criminal, interview them first, maybe, offer them tea or give them a warm hug at the door.

With regard to the "equal force" agenda, would a person threatened with a knife be required to respond with a knife only? Or would use of a firearm be justified?
Mark Paul Hammerquist In my opinion, no you don’t have to respond with a knife, deadly force is deadly force. You can jump straight to the use of your firearm in self defense if you’re legally carrying as long as the person is an immediate threat to your life or someone else (very close to you or someone else and adopting a hostile posture with their weapon).

I haven't seen a law that says it is illegal to carry a firearm, only that it is illegal to carry a firearm openly, or concealed carry without the permit.

Assault weapons ban does nothing for crime. What you do is slow down shootings but everything else goes up. Stabbings, assault with a deadly weapon, straggling, home invasions, murder, alot of things go up. Ask Australia.

I have a question as to conceal and carry, or open carry, even if I do not have a ccw, but only within the limits of my home and or property.

Good video. However, this is the same (and only) information that videos like this ever seem to cover. What would be useful would be a discussion of a number of scenarios one might encounter and whether or not deadly force is authorized. Strong arm robbery is an interesting scenario, for example. Another issue: when is okay (or is it ever?) to brandish your firearm in order to stop a crime in progress or prevent crime that is imminent from occurring? An example could be walking down the street and a group of individuals start accosting you and won't let you pass or retreat but they aren't assaulting you. There is an abundance of case law on these subjects, but that is not readily accessible to layman. I think examining a variety of edge cases would be beneficial.

If a person is attacking you and you have a gun on you, how is it not reasonable to fear that he could grab your gun and kill you with it? Scenario: you're walking down the street and you're randomly attacked and beaten for lets say a robbery. The man sucker punches you, knocks you to the ground, pins you there, hits you again, and looks through what you have on you in an attempt to rob you. You know you have a gun in your holster. The attacker is unarmed but the defender doesnt know that.
Killing someone with your bare hands = Sweep it under the rug.

Having trained and fought in Mixed Martial Arts for over a decade, I appreciate the reality that you can in fact be easily killed by an unarmed attacker via strikes or chokes. Many people have been crippled or killed from a single strike, having been knocked out then hitting their head on the ground.That said, do you know of any case precedents or can you formulate an(hypothetical) legal argument for using deadly force when confronted by a single or multiple unarmed attackers whom you believed were trying to kill you?

Wait! We actually have a stand your ground and castle doctrine?
I don't think that it is accurate that California has a Stand Your Ground law. I live in California and I work as an Armed Security Professional, and I have always been taught that the element of Avoidance still applies here. A person who has a gun cannot be escaped from, reasonably, and so because avoidance is not an option in that instant we can use deadly force at that point because retreat is not an option not because we do not have a duty to retreat if we had the ability.
Mn here we have castle doctrine. the only out of house defense you can do is if another person is in danger.
I read through many of the comments here and concluded that I did the right thing by getting self-defense insurance (although it's not called that by carriers) two years ago. I don't have a CCW, so I debated whether I should get that kind of insurance. Turns out that it's much more beneficial for me than what I imagined. I had a very frightening incident while home with my partially disabled mother. I was her caretaker but now I'm her full-time caregiver. I had already been familiar with guns and had taken a few gun classes about a year before this incident. Never had I seriously considered insurance like USCCA but I did see their ads and information. After about a minute on the phone with a sheriff to report a suspicious vehicle and a guy who had been knocking on my door several times, three guys suddenly opened the doors to their luxury vehicle and ran up my driveway. One with thick gloves was about to jump a gate and make it to the backyard. At that moment I decided to grab my shotgun and stop the threat(s) should the threat(s) break into my home. My mother's fingers were shaking uncontrollably as she tried to dial the phone (this incident probably contributed to her aneurism). I got to the bottom floor before anyone tried breaking in. I was in a tactical position but my greatest fear was having to shoot anyone. The person who made it to the backyard had his hands straight out as if he was about to break a window. He either saw the shotgun pointed towards him or he noticed the TV was on. Within about a minute I saw the rear end of the car that the guys had come in quickly leaving on an adjacent street. They were eventually caught but it took the first sheriff 14-15 minutes to finally arrive at my home. A few days later I enrolled in one of USCCA's programs because I seriously considered the negative outcomes of a deadly encounter. Even if I had been justified in using lethal force, I most likely would have been facing a civil lawsuit. I had two more incidents involving burglars/robbers a year later but they were both a pair consisting of a man and woman. Just recently I saw two guys get off a semi-luxurious SUV with small boxes in their hands near my home. Both were approaching my home but immediately turned the corner after noticing me inside the living room. Both guys easily fit the description of the three guys who first tired to break into my home two years ago. They were probably a part of the same south central L.A. gang that specializes in home invasions and knock-knock burglaries. There have been forced entries of vacant homes around where I live but only one home invasion just recently. I feel a lot more confident that I have a self-defense insurance because after the first incident and now that my mother is recovering from open-heart surgery, I won't hesitate to use deadly force if all conditions necessary for it are met during the moment it's required.
Video very helpful thank u. I just recieved my CA ccw permit not too long ago and have several questions.. Might be worthy for a new video. Where can u ccw and places you can't ccw? When driving, is it allowed to have ur loaded firearm in the center console, glove box, or on floor covered by a towel for easier access? What is the law about leaving a loaded firearm unattended in a vehicle? How many firearms allowed to carry at same time? If pulled over by police, is it required to inform the officer of the firearm in the vehicle. Any answers would be very much appreciated.
A firearms question here.. saw a single shot ar 15 pistol for sale in my local sportsmans warehouse. Would it be possible to convert that over to semi auto after purchasing and it still being legal?? Guy working the counter stated I can put it on my ccw as a single shot as well...

Can you please go over California PC25640? My understanding standing of this code is that I can carry conceal while I'm hunting or fishing, or while transporting the firearm to and from the hunting or fishing location. Does this mean I can carry and conceal a loaded firearm during the transport to and from my fishing location?
*_When i was younger a local criminal beat me over the head with a tire iron for no reason~He was just a thug. He hit me a ton of times, causing me to need about 40 stitches. I was afraid to go out for a few yrs afterward, until he was shot dead by other criminals. I know now i had ptsd. If i had saw him on my property i would have been so scared i'd have shot him on the spot for sure because i believe he would have finished the job given the chance. I wonder would a jury have convicted me??_*

Uhmm you still have to fight for your rights pertaining to the 2an amendment because William Bar is an anti-gun guy. He would love to have more restrictions.

Great video I am glad I came across it . I have a question and I do realize if you answer that is should not be considered legal advice . To touch more on the home break in or home invasion what are the laws regarding someone breaking into your home and that someone is heading down the hallway straight to one of your kids rooms while he is giving you his backside the whole time . Can you use deadly force since you fear your children are in danger?
