Speaking in a legal standpoint: since the letter wasn’t directly sent to you, then it makes the cease and desist null and void.
That’s for subpoenas. But you can always just ignore a cease and desist, they don’t have any real legal effect. It’s just an expensive way for one party to threaten a lawsuit, but no one is in any way required to abide by the demands of a cease and desist, regardless of whether it was properly delivered to them or not.

If the allegations were demonstrably false, she’d be sending cease and desists to the people accusing her - not bs copyright squabbles

Ethan said this in the video and that could be considered slanderous. Colleen’s lawyers may use this comment as evidence that Ethan slandered her and caused damages.
@@apex7640 defamation/libel- in England at least I'm not familiar with US law but I have to assume its similar - only has grounds where the statement is 1) intended to cause damage to reputation and spread in order to achieve this goal, 2) damage has been sustained to the career or earnings of the person slandered and 3) the information is *false*. so she doesn't have a case for slander because its true that her Attourney reps the accused in high profile SA cases, and there's what any jury would deem as sufficient evidence of wrongdoing for grooming. so tbh I think, unless laws differ greatly in the US, ethan should be alright

I was thinking the same thing while listening and scrolling the comments. I made some cracks myself, but you are right. There is absolutely nothing fun or funny about any of this. She clearly behaved at least immorally and hurt people. This needs to end soon. It's sad that so many people are paying as much or more attention to this than, for instance, the fentanyl crisis, which has gotten worse in the last several months alone. And so much more. i really have to say, as seemingly legit as it sounds, I would think a legal cease and desist, would come certified carrier with as much as she is paying this lawyer.
LegalZoom states “You can serve it via mail, email, an attorney and, in some cases, in person. However you choose to serve the letter, keep a record of delivery and receipt by the offending party. If you are sending the cease-and-desist letter yourself, send it via certified mail so that you have a record of delivery.” It would make sense to use a certified carrier but I guess it isn’t a requirement? So interesting!
I'm in Canada but when I was served papers by someone I missed a court date cause they served me via email lol it's definitely weird you had to establish previous contact with the emails. I would choose registered mail if I was gonna sue tho, I very easily made my case in court because I missed my email so no legal consequences for missed court date.

CHILDREN at the time) She’s also potentially broke laws so I highly doubt she would want to go anywhere near a court against Adam, Johnny, Becky, all the people she’s hurt and are passionate about telling their truth. Especially with potential witnesses like her ex husband and the writers assistant who wrote an article about working on her Netflix show accusing her of wanting to make the uncle “more rapey”. I mean who knows what else hasn’t even come to light yet. What if there’s more? What if it’s worse? What if it’s illegal? She hasn’t even gone after Adam for him accusing her of being sketchy with her fundraisers. Idk. Time will tell though 🤷🏽♀️

On the note of CDBaby, one of my favorite Japanese bands had an issue with someone uploading their songs via CDBaby. It was up for about a day until the bands label took it down. It went through to CZcams Music and Apple Music but it seems Spotify was able to catch on to it being someone who doesn't actually own that music. CDBaby should probably find a way to tighten their verification but I honestly don't know how they would. Its a good service for independent artists that's been around for a long time, however, a few bad apples could ruin the entire basket for everyone.
