That clip with the leopard and the porcupine is actually a great demonstration of the advantages humans enjoy in the wild: no matter what sort of spines or barbs a prey animal has, if a human wants to eat it, they can just smack it with a stick or pelt it to death with thrown projectiles.

6:14 Wrong. The issue isn't killing a thief. That is legal in many states. The issue is the premeditation of setting a trap that could hurt or kill anyone that sets it off, thief, animal, or child. Traps that won't injure someone are completely fine. In essence, it's better off legally to shoot an intruder than to trap them.

    • @beardalaxy
      @beardalaxy Před 2 lety +27

I think the point is that you are only supposed to fire at someone if you feel like they are a threat to your life. If you aren't even in the same room let alone same building with them then they aren't a threat to you, so setting a trap is unjustified. If you had traps you could set off manually it would probably be a different story.
Still wish we could have traps though.

10:08 Henry: "I can't believe the fly, like, doesn't notice the giant looming shadow over him."
The fly's eyes are Compound Eyes. They are excellent at detecting fast moving objects, like predators quickly approaching them. However, they don't notice slow moving objects so well. The next time you see a fly on the table, don't try to smash it into the table. That's a futile endeavor and you'll almost certainly fail to kill the fly. Instead, slowly move both your hands above the fly just a inch or two apart. Once you're above the fly, clap your hands together. When done properly, you'll almost always catch the fly in your hands. If you clasp your hands together without your palms striking together, you'll catch the fly alive in your hands. I did this a lot when I worked at Little Caesars (always washed my hands afterwards). We made our own dough and that yeast just draws them in if they are nearby.

@@ZappaSheik Gotta disagree. Ali was coming off a 4 year hiatus due to his conscientious objection to the Vietnam War (ages 25-29, prime athletic years). This was his 2nd fight after being allowed to return to the ring. Despite that, against one of the hardest punchers of the time, he knocked Bonevena down 3 times in the 15th round for a TKO; able to do that in that round clearly shows his endurance. He did lose to Frazier in their 1st fight a few months later - his 1st professional loss. But he won the 2nd in '74 setting up the Foreman fight where Ali regained his title, at 32, with an 8th round knockout. A better point of Ali's downturn would be the Shavers fight in '77. Ali finished his career with a 56-5 record with 37 KOs & a 3 time heavyweight champion.
Oh, and Ali's quote on Bonavena after the fight:
"Funny, when i was predictin' the ninth round, I never thought I came close to predictin' on myself. I made a lot of mistakes in that fight, and it cost me. I got careless with him in the ninth round, and you can't do that with Oscar. In that ninth round I got hit by a hook harder than Frazier could ever throw. Numb! Like I was numb all over. Shock and vibrations is all I felt, that's how I knew I was alive. I mean, I was jarred. Even my toes felt the vibrations. The first thought that came to mind-another good one or two might have dropped me. So the minute I'm hit-two steps backwards and I'm on the other side of the ring."

Right now, the victim receives both awards, resulting in perverse cases where the offender (original victim) has to pay the victim (original criminal) far more than the harm that was suffered.
Punitive awards are supposed to be payment from the offender to society as a whole. It should not go to the victim, not to the lawyers (the lawyers who negotiated the tobacco settlement became billionaires), not to the police, not to the government. All punitive awards throughout the country should go into a cash pool. And on April 15 it should be equally divided over all taxpayers (who represent society) as a credit against your taxes.

The case points back to some founding legal documents involving the use of booby traps - with some founding documents actually using the phrase "booby trap" - and tort and private property. The reason Boobie traps aren't typically allowed is it can't determine who is breaking in. It could be a burglor, or it could be an EMT or firefighter. Now if the farmer had just shot him when he entered that would have been fine because the farmer can judge the target

Right, so why should a thief in the night win the lawsuit? He was breaking the law, so whatever injury he suffered in turn should not be eligible for compensation. If someone with the legal right to break in got injured then they would have a case.

@@nono7105 I agree he shouldn't get legal compensation, but the fact that Boobie traps are a legal gray area is likely being used somehow. But I don't have the full details of the case

    FUN FACT
    a landowner in
    FLORIDA
    ( of course )
    got tired of trespassers
    who messed up his
    property & left a mess
    so
    he dug a trench around
    3 sides of his land
    and
    opened up a blocked
    creek / river
    to let alligators into the
    trench
    🐊
    a few nights later
    he was asleep
    and was woke up by
    loud screaming
he smiled & went back to sleep
    NO ONE TRESPASSED
    on his land after that

About that burglar, you are not supposed to leave traps, because any emergency personell could be a victim to them in case they are needed and its armed.

6:23 History of that case FYI is that the home owner and his wife were elderly and lived elsewhere. That was their ancestral home I believe and they weren't living there. The farmhouse had property in it, including antiques, and was repeatedly broken into and robbed. The police basically refused to do anything and the owner set up booby traps to protect his property. He was criminally charged and convicted on the principle that it was lethal force and it isn't legal to use lethal force to defend property.

The illegalities of a shotgun trap stem mostly from them being indiscriminate. The idea is maybe a young child would wander in. I've had my grandpa's property broken into a couple a times. Traps in general are deemed pretty illegal. But if you have cool neighbors just have them call you before the police...

If a burglar breaks into your house, trips on junk and sprains his ankle, he can sue you.
It has to be the dumbest thing ever. If he's trespassing, you shouldn't be liable for him getting hurt. But hey, laws.

    • @beardalaxy
      @beardalaxy Před 2 lety +1

You CAN sue for that, sure, but that one is highly unlikely to hold up in court. It would be a complete waste of time and possibly money.
