The Rule Against Hearsay

  • One of the basic rules of evidence is that a witness can only give oral evidence relating to things which they themselves have detected with their own five senses. Generally speaking, witnesses can't give evidence about things which OTHER people have detected with THEIR five senses, then told the witness about.
This sounds like such a simple rule, right? And yet it does so many students' head in. This lecture tries to unravel the mysteries of hearsay.

Thank you Anthony Marinac. Excellent video - I am reading law in Mauritius and your explanation on hearsay is clear and simple. Thank you very much Anthony Marinac. Are you a lawyer (barrister or solicitor)? If so, in which jurisdiction?
