    I got stopped over 2 years ago for a burned out license plate light. The Police officer said he thought I had been drinking. The fact is I have not used alcohol in more than 25 years. I refuse to do the road sobriety test because I'm in my 60s and do not have good balance. I refuse to take the portable breathalyzer, because I have heard that they are not reliable. When I got to the trooper post I tried to take the breathalyzer three different times, but could not blow hard enough because I have stage 4 emphysema and could not blow long enough to pass the test. Although I attempted to take the breathalyzer the officer wrote down refused and I lost my license immediately. I asked if I could do a urine or blood test and was told no.
    After paying an attorney $2,500 the ovi was dropped. I believe I was financially and physically and mentally victimized by the legal system. Why in the state of Ohio do law enforcement not have to give you a choice of a blood test or urine test if you have emphysema and are unabled to do the breathalyzer?

    Attorney Wilson, you make a fine, albeit extremely important, point: There is no statutory penalty for refusing to perform a Field Sobriety Test or (you didn't mention this) refusing to take the roadside breathalyzer. I have a question about something you did not address. Is it true?--> Refusal to take a test *once arrested* does carry statutory penalties? Further, once arrested, should one consent only to a blood test (i.e. not gymnastics or breathalyzer)? I am in no fear of getting an OVI, because I employ your "time machine" rationale. However, I am a civil libertarian, and knowing one's rights is paramount to a free society.

    Highway patrol will lie and ask I to imagine a line in the road. Then pull the u smell like beer even tho u don't drink beer. 🤡💩

    Aren't there a handful of states where if you refuse roadside sobriety tests you could lose your license or worse? I think New York is one of them. Are you saying that you should refuses ALL roadside sobriety tests in ALL states?

    Just keep your mouth shut don't answer questions at all. 5th amendment don't incriminate yourself.

    Just like driving is a privilege. But we pay for vehicles, pay taxes on it, pay for a license, registration, and tags on top of insurance. 🤯🥴 And then officer opinion is law that is discretionary. 🥴

    People dont know any better and thier scared and freak out. They see thier lives as over. Im going to start telling everyone never drink and drive and stop even drinking will at least help them think. Tell them any type of substance can make them thing its ok to drive. I will speak up that temptation will lead to destruction fire and brimstone. Because I dont want them to get destroyed. I feel bad for people getting in trouble.I dont want them to ruin life.

      I have been stopped for DWI at least 4 times in my life and have never been charged because I hadn't been drinking enough. When I go to a bear I stop after two, 12 ounce beers.

    Great information, and I have been a cop for 18 years... By the way, you forgot the modified Romberg test, the pupil dilation, and lack of convergence... Oh yeah, and you forgot to tell everyone NOT TO DRIVE IMPAIRED TO BEGIN WITH!!!....

      Da Spud, let me clue you in on a couple things. First and foremost, because of the untrustworthy behavior of some of your colleagues, and the general refusal of most of you do something about it, you have forfeited public trust. Second, there have been far too many bogus DUI arrests. Police are not particularly concerned about public safety, but rather your liability and of course revenue for your jurisdiction. Don’t for one minute think you are something special. You are just public servants, and at times very poor public servants. Many of you look disgraceful in your uniforms, and frankly don’t engender a lot of confidence. I would say you would have better off not replying, but it is your right to look foolish. I almost died in a foreign land protecting that right. And Yes, I advocate obeying the law, and avoiding encounters with folks like you, who don’t possess critical thinking skills, like the plague.
