My tenant is growing weed against my permission OUTSIDE… not only that but had the guts to kill my lily’s and plant on the ground inside city limits for anyone to grab … cops are saying now that since weed is legal I have to go to civil court ! What do I do ????

    I got stopped over 2 years ago for a burned out license plate light. The Police officer said he thought I had been drinking. The fact is I have not used alcohol in more than 25 years. I refuse to do the road sobriety test because I'm in my 60s and do not have good balance. I refuse to take the portable breathalyzer, because I have heard that they are not reliable. When I got to the trooper post I tried to take the breathalyzer three different times, but could not blow hard enough because I have stage 4 emphysema and could not blow long enough to pass the test. Although I attempted to take the breathalyzer the officer wrote down refused and I lost my license immediately. I asked if I could do a urine or blood test and was told no. After paying an attorney $2,500 the ovi was dropped. I believe I was financially and physically and mentally victimized by the legal system. Why in the state of Ohio do law enforcement not have to give you a choice of a blood test or urine test if you have emphysema and are unabled to do the breathalyzer?

    I currently have a Tennant that stated it was going to be him and his son. That son being a minor. He has brought in 6 additional kids (minors) saying 3 are his and 3 he baby sits. They have been there constantly. Can minors considered unauthorized Tenants?

    I'm homeless, the landlord illegally evicted me and illegally raised the rent in the middle of a year to year lease, I talked to the mayor about it, and legal aid and section 8 allowed it to happen, I'm on section 8 and they are saying I won't be able to get a extinction, my son had lead poison from the house, the 2nd year of living in the house, found out from doing my own test, I took the paint to health department and the health refuse to give me the results of the positive test, department of health, legal aid and home equal opportunity and section failed me and my children and now we are homeless, in a hotel that's expensive, my furniture is ruined from the rain, I need help please.

    Aren't there a handful of states where if you refuse roadside sobriety tests you could lose your license or worse? I think New York is one of them. Are you saying that you should refuses ALL roadside sobriety tests in ALL states?

    what if your new landlord claims someone is living with you but that said person really is not AND we can prove that. she constantly lease violates me over it, then she sent a paper saying he was trespassed (not legally and when we called the local police, they claimed they did not know anything about it) , now she just gave me 30 days to leave the premises due to that said person still being here. she claims she has seen said trespassed person. however, she is lying. she has not seen him and she knows it. so my question is, does she have to prove that said person has been here or is it just her word? now of course the tenents are going to say they have seen him, because this is a petty place too live. so that's the only thing they are going to have. also, my question, do they have to prove "they seen said person" or is it just their word????? please help

    I moved out of my apartment a week ago. I cleaned and scrubbed floors. I left everything clean. I requested a walk through and she refused. Which I didn’t understand…she just turned sour once I started moving. She kept saying that a “realtor” was going to do the inspection. I asked if I could be there and she said no! So I turned in the keys and the next day she sent me photos of dust particles etc….she then said that I should’ve dusted the furniture outside? And cleaned the window sills on the outside? Lol I cleaned the windowsills! I took photos. Anyway she keeps sending me threats and saying it’s not clean. I haven’t responded. It’s driving her mad and she is sending me atleast 2-3 texts a day telling me to come back and clean then said she was going to show the neighbors. It’s just making me physically Ill….I advised her I will take her to court if I don’t receive my full deposit. If she doesn’t do it in 30 days then I’ll move forward with the legal route. Aside from taking her to court is there anything I can do now?

    So landlord is deducting a window damage (tape used to put in AC melted on glass), handle to iifridge came off) minor stuff like that which can be easily cleaned up or fixed. But come to find out she’s selling house and remodeled & replaced all windows, carpets. Selling with no appliances, can she do this? Everything she’s charging me for she either took out or replaced .

    Just like driving is a privilege. But we pay for vehicles, pay taxes on it, pay for a license, registration, and tags on top of insurance. 🤯🥴 And then officer opinion is law that is discretionary. 🥴

    I am a tenant in an apartment complex. My neighbors are doing this, and have done it repeatedly (some guests only left bc we told management) -- we noticed bc there has been repeated noise issues. It's also a safety and privacy concern. But they are still doing it and management tells us they can't say anything about it. We want to feel safe and at peace in our home. Currently we don't (despite moving to a quiet community for this), we're deeply disappointed and frustrated. Our lease is far from ending and moving will cost more money despite the issue not being our fault. The state is not Ohio, but bit I appreciate your advice and am trying to understand this issue from the landlord's POV. Security camaras seem like a good idea to prove these additional occupants are indeed living here. We hate it, it makes us feel unsafe and

      You may try to offer it, but the the LL is allowed to accept or decline. If LL accepts it, you are considered back in good standing. This from a non-attorney, just an Ohio LL.

    As a single unit landlord my tenant after 3 years moving out had the balls to say "I probably left it better than when i moved in".. Sadly that is far from reality... He left spray paint marks on the patio, oil spill at the stairs, dirty carpet, shit spackle job that now needs sanded/repainted and holes in ceilings. From 3 fans. Outta $1500 i offerdf $500 which i think is fair.. he hasnt given me zelle info so if he wants to push it ill get actual estimates.. im handy and try to do things on the cheap but homeboy thinks he is a better tenant than he is/was.

    Attorney Wilson, you make a fine, albeit extremely important, point: There is no statutory penalty for refusing to perform a Field Sobriety Test or (you didn't mention this) refusing to take the roadside breathalyzer. I have a question about something you did not address. Is it true?--> Refusal to take a test *once arrested* does carry statutory penalties? Further, once arrested, should one consent only to a blood test (i.e. not gymnastics or breathalyzer)? I am in no fear of getting an OVI, because I employ your "time machine" rationale. However, I am a civil libertarian, and knowing one's rights is paramount to a free society.
