DUI / OVI Second Offense in Ohio

    What should I know about a second-offense DUI / OVI in Ohio? I'm Shawn Dominy, I'm a DUI / OVI lawyer in Columbus, Ohio, and this video is going to answer that question.
    I think there are two things you should definitely know about a second offense. One is the potential consequences, and the other is what to expect in court.
    With regard to the potential consequences, a second offense has some mandatory sentencing and some discretionary sentencing. For example, there’s a license suspension. If you plead guilty, your license will be suspended for at least one year, and up to seven years. There’s also a jail sentence. It’s a minimum of 10 days and a maximum of six months. There’s also a fine, six points on your license, a reinstatement fee, immobilization of your vehicle, ignition interlock on your car, and yellow license plates.
    With regard to what to expect at court, I think you should expect at the first court appearance, there probably won’t be any negotiating, and the offer will just be plead guilty, plead no contest, or plead not guilty. If you plead guilty or no contest, then you’ll likely be sentenced immediately, the case will be done in court, of course you’ll have to serve the sentence, but there won’t be any further court appearances. That means you also won’t have the opportunity to review the prosecution’s evidence, evaluate the case, and present a defense.
    If you plead not guilty, then you do have the opportunity to present a defense after reviewing the prosecution’s case and evaluating the strength of the case. So, before that first court appearance, there are three questions you should probably answer for yourself. Number one, “Do I want to fight it, or do I want to just plead guilty?” Number two, “Should I hire a lawyer, or should I represent myself? “And number three, “Which lawyer should I hire?”
    As you are answering those questions and thinking through those topics, I think it’s really important to educate yourself about your situation.
