    Here in NY, a protective order is called a "cheap divorce".
    A woman can get her unwanted husband removed from the premises, based on the mere perception of threat(with a few embellishments added), gain "temporary" custody of the children(which is rarely temporary) and have her boyfriend moved into the residence before the divorce has even been finalized.
    Its a great system - for dead beat mothers.

      You are right.
      The system is an equal opportunity abuser. Men can use it to abuse their women the same as women do to their men. The divorce industry is a twenty billion dollar a year industry, and it doesn't really care who it violates to pay the bills.

      Yep.. sad, but true! Its not just New York.. Its ALL 50 states! The US government has, literally, REVERSED DUE PROCESS, with Protective Orders / Restraining Orders!! Its SICK!!

    Going through this now in Va.....scarred to death. Still at home in separate room but constantly threatening to have me removed and locked up. Teaching her grandkids to say I hit her. Now they lie to me and stay away from me. Already got her friends and family on board about the lies. CRAZIEST THING I'VE EVER SEEN and i'm holding my breath!!!

    So the solution is to eliminate the ridiculous ex parte process and at the very minimum make attempts within a 24-48 hour period to the respondent to have an immediate trial so they’re due process is not violated because with the way it is now it’s a complete violation of supreme court and constitutional law and it’s basically spitting in the face of the 14th amendment. Or at the minimum do a background check on the respondent and if they don’t have any violent crimes or previous domestic abuse don’t grant it. And how about state courts take some responsibility for violating a parents fundamental parental rights by having the children put on these because that’s a direct violation of supreme court and constitutional law unless a Judge can deem the respondent a immediate danger to the children from clear and convincing evidence(85%) not the preponderance B.S.
    Not only are these ex parte’s breaking constitutional law by not allowing due process they are also breaking it by allowing the children to be on it. And they are only done for a states liability because the rare chance that the petitioner will end up being injured apparently outweighs the very common chance that young children can have psychological damage from a parent being removed from the environment like they are and somehow these state courts have snuck their way into violating constitutional and supreme court law and the puzzling part is nothing has been done about it despite it being widely known these ex parte protection orders are falsely filed especially during times of divorce for custodial advantage.
    And then to really slap the respondent in the face if the petitioner did file false claims and abused the protective order not a damn thing happens to them other than they don’t get their permanent order granted. How about a minimum mandatory of 5 years in prison? I think that’s pretty fair for ruining somebody’s life but no all they get is a false order denied.
    Don’t accept that what you need to do is gather all your evidence and sue them in civil court under the tort laws. Sue for everything under the sun including defamation of character, intentional infliction of emotional distress, abuse of process, false allegations, try and get them charged for filing a false police report, literally take them to court every single month for the rest of their life.

    When the defendants (Not Me) gives you a protective order in a lawsuit and which my lawyer signs it right away what does that mean? If were going to fight the protective order does he sign it before anything has started. Is there a point where my lawyer would not sign it? This is very important. :(

    Hows the affidavit child support order review work? Is that an effective thing or is it just a review paper that does not mean much?
    Also there is a peace pond in place but goes against what we are doing at the moment..how can tha help me. As I have court tomrrow.

    what happen when the plantiff has the protective order against the defendant and the plaintiff calls and come to the defendant house is the order dismiss?

      Not automatically. At least in Virginia, the person against whom the PO is lodged must petition the court to dissolve the PO and give evidence of voluntary contact by the alleged "victim." Good luck with it.

      They're basically the same thing. No contact of any kind with either A protective order or a no contact order

    Let's say someone violates an order of protection by interacting with the petitioner. The petitioner willingly lets the one who the order is against pick up their children that they share together and bring them back home at the agreed time. The petitioner willingly engages in sex with the one who the order is against. The petitioner admits via text message that they are in interacting with them because they want sex and want them to be in their kids life despite the order that they had put in place. Does this seem like a situation that the courts would see and conclude that the petitioner has disregarded and does not seem to exhibit behaviors of needing protection? Honest answer please. Hopefully I get a reply.

    Hi my name is Niphavan. I am currently living in chicago. I am going through 2 criminal cases right now which is an order protection that was filed against me and a violation of order of protection. The person that filed this against me is the father of my childs sister. Me and the father of my child are not together for 6 years now. On December 25th of last year i had show up on their property just trying to get my daughter for christmas because they have been ignoring my calls. Come to find out the police officers end up arresting me for violating my order protection which i never knew about and i wasnt properly served. I got charged with damaging property and harrasment which it never happen, i had a wintness with me on that day. I did showed up for court with an attorney and the judge dismissed it because the sister didnt show up. Now the state attorney wants to reinstate the case because the sister wants to pursue it, which is same court date for my order protection case. In this order protection that was filed has The sister name, the father of my child, her dad, her mom, and my daughter name on it. On the paper it didnt even state what time and date it happend. All she said was " Threaten to break her car window and her moms car window and state that i will beat her butt and when i see her i will f her up" i never said anything to her. i have proof of call logs and text messages to back me up. I havent seen my daughter for 4 months now and my question is can i filed a demand of motion to dismiss the case that state attorney trying to pursue? and are my facts good enough to maybe have the judge to dismiss it? Do i need to have this in writing? i will be so appreciate if you can help with these answer. Thank you so much for reading. You have a great day.

    First of all, if you want someone to stop contacting you, just tell him/her so directly instead of reporting him/her to the police and/or having somebody contacting him/her on your behalf. Reporting a person who is not out to harm you and has never threatened you to the police is despicable and having somebody contact the person on your behalf instead of you yourself contacting the person directly is extremely rude.
    Second of all, if you want someone to stop contacting you,
    (a) prove to the person that the CIA did not brainwash you and turn you against
    the person, (b) prove to the person that your father did not order you to stop
    contacting the person or else your father will kick you out of his home and
    make you homeless and (c) prove to the person that you are not subjected to any
    other form of duress whatsoever but that you made the decision that you do not
    want anything to do with the person anymore out of your own free will.Third of all, if you want someone to stop contacting you, tell the person how is the person supposed
    to know whether or not you change your mind and decide to allow the person to
    send you email again like you used to allow the person to do and/or in any
    other way contact you. Hello, the person is not a mind reader, the person is
    not out to harm you or anyone else, and the person has never threatened you or
    anyone else, the person just simply wants you and everyone else to be free of
    all mental illnesses, all other illnesses, and all other problems whatsoever
    and the person is simply lonely.

      Fred Tenzer I had an ex who tried to do that to me one time. We ended the relationship because of stupid things that were not even a big deal, but after saying some mean things she went to the police station to file a complaint and tried to get a restraining order because of it. It blows my mind how stupid people are. You get a restraining order because your life is in danger or threatened, not because your feelings got hurt and someone poses no threat to you at all. What you said was accurate and on point.

    i recently was served and injunction. the petitioner has no proof other than he and his best friend who is a tenant. can i be kicked out even though have paid bills there for over 6 months? or do i get time ?

      You need to seek an attorney licensed in your State; however, the general trend is for the injunction to take effect without analysis of the monetary effects of such injunction against the Respondent. Said differently, the protection afforded by the forced separation takes precedence over mere money matters.

    How can my girlfriends sister put a CPO on me to stay away from my girlfriend? Isn't that a third party CPO? I never did anything to my GF and her sister is making up lies and has posted something on Facebook saying she can't say it's me, but she thinks it is, and she needs all her friends help to put me in jail saying i have,100s of text numbers and fake Facebook accounts about harrasment calls texts and shuting down my GF facebook accounts but nothing about threats or abuse.

    Hi! This case is almost my case but this time I am the ex-wife I left him more than a year now. He'd been harassing me, stalking me and using my kids and most of all using the cops to get back to me. (He's jealous bcoz I already have a bf) so he'd been calling cops for small issues. I can't help myself but to reply to his text because he doesn't stop harassing me. So I would text him back like "you're gay, (which is true no offense to anyone) I don't want u because u stink, etc... he said I'm bullying me. He was granted a protection order and now I'm contesting it. And I wanna tell it to the court I never abuse or hurt him I left his residency more than a year now. His proof was all the text messages coming from me. Is that a hard proof against me?
