    Here’s the simplified reality....An order of protection is the end of a relationship. The sooner you realize this, the better off you’ll be. Trust me on this. Been there, done that

      Lmbo.....yup I'm a wife and I want him to go because he abuse alcohol and I'm just exhausted from the pee in the bed the 2am almost burning down the house..the girls...the waste of money...I'm just tired 10 years...alcohol wins. I'm out!!

But he would not let me break up with him. He would also act horrible and expect to be excused for it. He thought the danger he put us through should not affect his custody but I disagree because he acted really unsafe so I gotta protect my son from that too. Did you leave? Are you able to??

      @@Laurendoesflips thank you so much....I prayed and God came thru. For now he is sober and I have enough time to move now. We have been married for over a decade and now. I'll give him 1 year to work for the family he claims he loves but for my peace it can not be under the same roof. God revealed to me that if a person does not love themselves it will be hard for them to love u enough to get it together. So I'll allow him time to reflect and seek christ. The enemy do not bound nobodies he binds Giants that will bruise his head.....that's why the battle is so strong for alcoholics. Drugaddicts.. gays..lesbians....gamblers cus they are mighty men an women of God that will win so many souls to christ. So the enemy don't want that so he attract them early to brokenness.

    Is the 10 year time frame meant to protect the same victim? Although, here in Minnesota 2 yr of protection is what one gets most of the time. After that two years of protection and the respondent still continues to have you, then what?
    Or does this mean, if another victim gets another HRO and they violate that second HOR it means 2nd misdemeanor?

    Can i get an order of protection for a client who threatens to bring the police at my business place. You see i told her how I'm to get paid and how the product can be deliver by mail or pick up at the salon. But she insists that she will bring police which i dont what that to be happening at my business place.

    So if I get a order of protection placed on me for 2 years or less will that show up on background check for future employment?
    One of the orders has me paying fees, fines ,& compensation money but how would that be possible if I lose my job & can not get one because of this. Is it a criminal record or not?

    So I have a question because I can't seem to find any answers to it, a former friend of mine called the police to get me to stop talking to them. I personally had no idea that I had done anything wrong since we had normal conversations before that, I did notice there was something wrong but they never told me anything. Regardless, the police said that I wasnt in any sort of legal trouble, I just wasnt allowed to talk to her or anything of that nature, and if I did I would be arrested for harassment. I was never given a written record of it, and I am a single parent that doesn't ever want to get into legal trouble because I don't want to potentially lose custody of my child. So I don't know if this went on any sort of record of mine or what exactly was that was placed on me.

      @@rikmcdik6662 what criminal defense lawyers do is often misunderstood. Sometimes it results in getting people out of trouble, especially if their rights were violated. Other times it means getting them help along with some sort of reduced punishment IF THEY COMPLETE the help they’re getting. And of course there are those times when someone is actually falsely accused. But may I ask you a question? Could you be a prosecutor and put an innocent person on trial for a serious crime? What if that happened and what if they were wrongfully found guilty and spend 10, 20, 30 years in prison and then we find out they weren’t the one who did it? Wouldn’t that be horrible? It does happen, you can google the Innocence Project to see story after story about it. We criminal defense lawyers exist to protect against that. Wouldn’t you agree that’s a good thing?

    I have visitation rights to my child...my childs mother still refuses to let me have parenting time...i have no address...no phone number...i hired a "process server" (and an attorney) to file a contempt charge...on the same day that I hire my process server my childs mother filed a petition for an "ex parte civil protection order" how can she do that??? and will this affect me being able to serve her for contempt??? please help and thank you!!

    Odd situation: a former vendor at my work is acting crazy sending hateful emails and calls my line at work all day to harass me and scream and swear at me. Currently, I've been just hanging up on this person. However, this makes me feel uneasy. My boss asked me if we need to file a restraining order as none of us have ever dealt with this situation.       Katy K depending on what state you are in there are different types of no contact orders. Some are called "harassment restraining orders," or "no contact orders" or similar names. You can usually go to a self help center at your local courthouse to find out how to apply for one and what type is right for your situation.

      brandy rhonemus excellent question. Unfortunately no, it does not. I have represented people in that very situation. Prosecutors can still charge it out as a violation. Some use discretion and don’t charge it, but others do charge it. A jury can nullify it (I’ve had that happen) because it’s not really fair, but it’s risky to bet on that. Best thing is to still avoid contact and follow the rules of the order and document it in case something happens later.

    y question is: an order of protection is in place for the spouse, including eviction of the home. However, he has now been back 3 times to remove"personal property" which is not completely true. He has removed some personal stuff including all tools. He has been accompanied by a police officer each time. question: how many times is to many? is there a time frame, for how long he should be taking? if he is able to take whatever he wants? the last time he was in the home he turned the heating system switch off! the FEAR is real each time he is in the home. what can be done? if any? thank you

      Alma Colon each case is unique and each set of circumstances are unique. Police are there so it should be okay. It’s hard for someone that is suddenly kicked out of their home to get by. That’s why they need to return to retrieve items. The court is in charge of how many times is enough.

      I'm not a lawyer but I believe you can. Seeing as you referred to the person as a friend I might consider cutting them off until they want to talk about your dispute like adults. A licensed attorney will be able to give you the best advice.

    I just got a temporary restraining order against me for a domestic incident. I haven't seen my Wife or kids for almost a week & it is killing me not to see them. My Wife called me during the time we were separated & told me that she loves me & that she wants to work things out & make our marriage last. I can't tell you, as a man who made mistakes to cause this situation how hard & difficult this situation is. I quit drinking alcohol & I am taking the right steps to make my life better not only for myself but for my family. I just feel like I'm never going to see them again or get the chance to make things right & it is breaking my heart. I have no idea what is going to happen next week when I stand before the judge. All I can tell you is if you are married & you have a Wife that likes to fight & argue or hit on you - be the bigger guy & walk away. If the marriage isn't working out, try to save it by going to counceling or get a divorce.

    Had an OFP placed on me for simply breaking a phone in front of my ex fiance. In court the judge upheld the ofp for 8 months to "disentangle our lives", but left the option for texts about the minor children and allowed us to meet in public places to exchange the kids. He urged her to work with me on visitation in the interim of having a custody hearing. I had tried repeatedly to work out some type of pre-trial custody arrangements with her, as well as asking for phone calls from the kids. I was a stay at home dad for a year and a half before she ran off with them, and it crushed me to no end to have them taken from me like that. Just today I received a ticket in the mail that I have broken the ofp. Considering the only contact I had was via text as the judge called for, I'm wondering if this can be true? I suspect she's doing this to get a leg up in the custody hearing. Wondering If you could direct me towards a decent attorney in the Duluth area that could help with such things. -Thanks

    I got issued NCO by former employee who claimed I assaulted him. Then he shows up to my business and threatens to call the police and get me arrested if I didn't give him money. I tried to get him trespassed, but the Sheriff refused without a court order. This guy had me arrested twice. I was taken away in handcuffs from my own place of business when I wouldn't give him what he wanted. I spent two weekends in jail. Now I have to defend myself at trial. Any suggestions for a defense?

    My neighbor, she's in her 60's, has a restraining order against her ex-husband.
    He just got out of jail, he was put in jail for beating her, and convinced her to let him stay with her during hurricane Irma. We live in Punta Gorda Florida. But now he won't leave and is becoming a problem for her again. She's afraid to call the cops because she allowed him in, and he's telling her she'd be arrested for violation of her own restraining order against him for letting him back in.
    She's afraid. I don't know what to tell her or how to help her.
    Any information you can give me to help her would be appreciated.

    Why isn't the person requesting the order required to make reasonable efforts to avoid the other party? For example the ex girlfriend going into the other person's job just to force him to leave?

      Many orders for protection prohibit third party contact/harassment. First, they should check the language in the order. Second, the person being harassed can always apply for a harassment restraining order or no contact order against the third party. Does that make sense?

    I live with my kids mother we have two children but she is verbally abusive harasses me screams and yells in front of the children, I have primary custody through the family courts for our 9 year old son there is no legal status on a two-year-old child I have already contacted many agencies and legal aid, the mother continues to be abusive using now profanity and even blocks doorways for me getting through , she has smacked me once across my chest and shoulder.Her name is not on the lease the landlord served her a 10-day comply or vacate notice can an order protection filed by me have my children's Mother removed from our home??

    I don't want any part of my father in my life at all I'm 19 so clearly I can make my own decisions but throughout my childhood he's been abusive and harassing to me. He has laid a hand on me before and hurt me. Past is past but I will always remember. I have no proof of it happening it's all in my memory if a judge were to ask him if it's true he would lie straight up. He was supposed to pay child support for me up until I was 18 which never happened he is more focused on his other family and life. He doesn't feel like a dad to me he doesn't care for me when is needed, there are expenses he should've paid but never did he expects my side of family to pay for them but we can't since my mom passed 4yrs ago(wasn't his wife) all I have is my grandma and family down in California...etc etc. I don't wish to see him again I don't want him to be known as my father I don't want to be known as his son. I'm in Washington State how do I get this settled by a judge? I have no past criminal history, clearly whoever has read this, you can tell I'm serious about this lol

      In MN if a person is arrested and charged for stalking a judge will typically issue a no contact order while the case is pending.

    Okay your explanation of the situation only seems valid if the restraining order is not for a valid reason. But there are many situations that are horrible DV situations where orders of protection are necessary/not soon enough. Got a three year restraining order against my son´s biological dad after he threatened to kill me many times, had a hunting knife, would not let me leave his house, but he did not go to prison. I did not press charges bc I did not want to deal with retaliation and I did not have evidence, but he was very dangerous. Many times its appropriate and many perpetrators of DV play the victim and there can even be scapegoating of the actual victim of DV. I think allowing a perp to get a restraining order dropped when they were threatening harm to control someone is more playing into their narcissism/expectation to be excused for horrible things. My ex who was the aggressor always played the victim any time I fought back and his family bought it. Sometimes families of DV agressors enable and scapegoat the victim to try to make the perpetrator seem innocent. I have full custody of my son and our restraining order just lasts three years. I dont know why they don´t make permanent restraining orders. I feel like he should have no right to be near us ever. I am glad I called the police the first time he tried to hit me and I am glad I got this restraining order. Seriously more women should call the police sooner. Please don´t help anyone dangerous. Obviously, no one is entitled to do domestic assault. More often things happen that dont get reported, not the other way around. Restraining orders are an important part of the process to break a relationship if the other partner does not want to let the other partner make their own decisions. Sadly some men think they own women. I was wanting to leave but he would not allow me to. Restraining orders are necessary sometimes. Okay have a good day. Like seriously if a partner is wanting a restraining order on the other they should just move out and let them go, not fight the restraining order.

      I understand and appreciate your concerns and points. There is a process in place that exists for the purpose of protecting those that rightly qualify for a restraining/no contact order, and for dropping those orders when they are not valid. The process, like any other human creation, is not perfect. There are people on both sides of the equation (alleged victims and alleged perpetrators) that are equally capable of manipulating the truth and abusing the system. So yes mistakes can and will he made at times. But the problem is that alleged victims are equally as capable of manipulating the truth as are perpetrators. So the system does its best in attempting to sort out what’s valid and what isn’t. Both parties deserve the right to be heard and advocated for. Then it is up to a judge to decide the facts and apply the law.

      ​@@RyanPacyga Ya I fought back and called the police first thing and also went straight to the courts which I think saved my situation. Also a DV survey really helped the court worker to assess the danger of the situation. I think some women get scapegoated by the abusers families to make the abuser seem innocent. Abusers think theyŕe innocent/not at fault in their abuse. But I can understand why someone would not want a restraining order that was not valid on their records. But I respectfully disagree. I would guess that most restraining orders are requested for very serious and valid reasons. The sucky thing is if a someone is being abused and they do not have proof or if a woman has been trained to deny abuse to escape future abuse then she has no proof unless he left marks. I am glad I called 911 the first time he put his hands on me.

      Lauren Stanley I understand. Unfortunately there will never be 100 percent accuracy or correct results. You’re right, there are times something happened and just isn’t proven despite the fact that it happened. But there are also instances where nothing happened but a false allegation got an innocent person convicted. Thanks for your comments and stay healthy! 🙏

    I need help..i have a restraining order against me from ex gf three years ago.the R.O. last for 5 years during my dv classes.she contacted me.at first i didnt know but then she revealed her self who she was.i texted back like a normal person but when i found out it was her i told her i can go to get jail time fine or prison for this why u contact me.we talked reconciled but after the classes i didnt want to b with her cuz i was scared to get trouble.she told me to find her in fives years..but its ben 3 nd shes aware tht im single and had other relationships.she got furious.nd im aware she went to court to get revenge on me..so ik shes filing for violation.and i think she labeled as a S.O..im scared cuz i got court for intoxication in public real soon..im afraid this will show up nd im locked up nd fined..

      It depends. They can last anywhere from a small timeframe if your lawyer brings a motion to cancel it or quash it. Sometimes they last as long as the goes. Other times they last for several years.

      adrian luna it depends. If you allowed or invited the person to be at your home, then law enforcement, probation or prosecution may argue that you violated it. If the person showed up
      Uninvited and refused to leave, then it shouldn't be a violation.

    My husband exwife is from Canada. She is harassing and threatening me on his text. The exwife even harassing my social media on Facebook. She said whoever involved or friends with my husband she'll come after them. The exwife said she going to hire private investors and criminal investors to find me. I never met her or talking to her.       Unless you filed a protective order cause your life was in grave danger and you know that he's a nutcase then what makes you think that someone like him is gonna be sympathetic about it? There is nothing wrong with being upset with your significant other, but filing a protective order and possibly ruining someone's life? I have no sympathy for you whatsoever.     What if my girl friend went to the court and wanted to take the order off? She did not want the order she just wanted to get me help and the cops took over from there. I'm really confused and worried but all I qualify for is a public defender and I can't ever get a hold of them. We are engaged to be married and our family is very close and we just want to move past this since I have been going to therapy and it was the first time I have ever been in trouble or done anything like this. My hearing is on the 20th and they gave me I think 3 misdemeanors.

      I have had cases where we have been able to get a no contact order or OFP removed. So yes it is possible that she can do that, but each case is unique. Each court and judge have their own procedures regarding how someone can request to have a no contact order modified or lifted. In MN, the judge may entertain the issue at your next court appearance, especially if your girlfriend or the victim's advocate (on her behalf) asks for it to be modified or lifted. You should continue trying to get a hold of your public defender so he/she can give you the proper advice. Good luck!

      Hi I have had a temporary restraining order placed on me. Just prior to receiving it my Wife who left me about week ago called me & told me that she wants to work things out & said she got the type of restraining order that she can live with me. Is there such a thing? The court hearing is in 5 days & even though my Wife wants to come home is there a chance that the judge will not allow it or extend the RO?

    My husband got released without bail today. The conditions is that he has to live somewhere else and he cant have contact with me. I am about to have our baby in a few days and they said he cant contact me until his next court which is sept 21st. Is there anyway to remove this?       STREET SURVIVOR if the order for protection is directly tied to the criminal charge, then it will be dismissed (vacated). But if the order for protection was granted apart from the criminal charge, then no. This can lead to confusion and more criminal trouble if you think it was automatically vacated and it turns out it wasn't vacated. So the safest thing to do is to ask the judge, a court administrator or your lawyer if you have one. You don't want to make a costly mistake.
