      @@jamilael-gizuli4600 no you don’t have to be a notary, but what I found is a lot of documents do require a notary, I.e., POA. Also doing the notary yourself help eliminate a bad notarization by a notary that does it incorrectly.

    APOSTILLE, here in AZ you hear that all the time but i was under the impression only the state capitol were able to do it. I had no idea we can do and take care of their apostille docs for the clients. just became an NNA member for two years to start and would love to pick your brain.

    I just received an email from Arizona Secretary of State and in AZ, "Arizona does not have any apostille agents, apostilles are only issued by our office. Customers must contact our office directly, please refer the customers to our website or office"

      Hi Mark! What state will you be commissioned in? In most states, you'll need to purchase a bond. A typical amount ranges from $5,000 to $10,000, although it can be as low as $500 or as high as $25,000.
      A liability insurance policy (E&O) is not required, because your state does not write Notary laws to protect Notaries - it writes them to protect the public. That’s why many states require bonds. You should consider buying a Notary errors and omissions insurance policy because it protects you against claims relating to any errors you make during a notarization.

      @@markmcclendon7063 Michigan requires a Notary Public to hold a $10,000 surety bond, which must be filed at the office of the county clerk (filing fees apply). The surety company must be licensed to do business in the state. If the Notary acts improperly or is negligent, and there are financial damages, the bond will cover those damages. The company that issued the bond may require the Notary to pay back any damages covered. If you are a licensed attorney in the state of Michigan, you are not required to file a bond.
      Insurance is not required for Michigan Notaries, although you have the option of purchasing a policy. Errors and omissions (E&O) insurance helps protect the Notary. If you make an unintentional mistake or a false claim is filed against you, an E&O policy will cover your legal fees and awarded damages up to the coverage you select.

    I am still a bit lost as to what the Notary's function is for an Apostille 😐. To my understanding, it sounds like the Notary authenticates the signature, and then offers to send it to the SOS for the client, and that's it? I understand that the Notary also needs some knowledge of different forms, but basically you, the Notary, are sending on the documents, to the SOS. When approved they come back to the Notary. Then you, the Notary, give these forms back to the client, and the client then sends them to the country they need to go to. So the notary can charge for their notary work and the fee for shipping to the SOS. I am in Virginia, and there's no guidance on how to do this as a notary.

      Hello. Your only responsibility is to notarize the document itself. Because the document is destined for another country, the notarization must be performed properly to ensure that there aren’t any problems on the receiving end. An apostille is issued by your Secretary of State's office or Notary commissioning agency. The single apostille is the only certification needed. Once prepared and verified, the apostille is attached to and sent along with the notarized documents. Notaries cannot issue apostilles themselves. This all happens after the notarization and requires no action on your part.

    If I’m an IL notary but a document originates in AL, do I need to fly to Alabama Secretary of State to get the document apostilled? Or can I partner with an AL Notary to handle it on my behalf?

    I do have a question: When the Notary identifies the Signer, what Notarial Certificate is best to use, and is the Notarial Certificate the same always for identifying the Signer..no matter the document that goes to the SOS?

    I’m in Colorado and I had a client try and do an apostle of their drivers license. It got rejected cause the notary didn’t cross out the other parts of the doc. So I learned that today and redid it. Now I wanna do apostle. Is there a directory of agencies you use and what fees do you charge.

    Hi,
    Great presentation, question for you,
    for the state of Texas to do an apostille for a birth certificate to be presented abroad in Mexico. This is what I understood, submit the application, submit a statement notarized,
    obtain a certified copy of the birth certificate at the vital records office and submit the fee, is that it? Thank you,

    Very interesting. Thank you...But I've seen some notaries that offer this service in ALL 50 states. How is this possible if the apostille have to be done in the state in which the documents originated? Wouldn't you have be get a notary in that particular state?

      Good question! An apostille is issued by your Secretary of State's office or Notary commissioning agency. Some enterprising Notaries who live near their Secretary of State’s office offer "apostille services" as a way to generate additional income. They essentially provide a courier service to deliver and return the paperwork to customers. These are not considered "notarial" acts.
