And the cop was just curious on what it was and if it was safe to drive on the road. They blocked the road so that they can have control of comes by and how fast so they and the guy doesn’t get hit

      +John Dozier did you see the way they cut in front of him, jumped out of the car and quickly confronted him? They conducted the stop as if it were a felony. They should have pulled behind him and then attempt the detention. They stopped him to determine what type of vehicle he was in. At the moment he realized it's not a motor vehicle, the traffic stop should have ended and both parties continue on with their day.
      A police officer's job is to enforce laws, assist the public and uphold the constitution. When you continue to detain someone when no crime has been committed, is a violation of the law. A law we trust our law enforcement to enforce.

    Great that you were recording this exchange. The method used to stop you was not appropriate. As the officer got deeper into his reason for pulling over he realized that he had no lawful reason to stop you and was trying use his authority to negate a situation that worsened the more he spoke. He should have graciously apologized for mistaking your vehicle as a motorized vehicle then moved on. But no. He had to feel like he is the victor. I don't know where he was pulling his information from about what is legal for bicycles operators on the roadway and what is not. I applaud you for having studied the codification (its apparent that you have read traffic law) and in a polite, non-threatening manner, stood your ground. Yes, you-tube is a great place to put this video. It was difficult to hear what the other officer was saying. I had full volume on audio. What I did hear sounded like he was trying collude with his partner. I abhor LEO's that use their badge/uniform to try to make their own law to bully citizens.

    What a load of BS, "he doesn't want to waste your time", he tries to enforce a law he hardly even knows and he is "concerned for your safety". Seriously, these people need to put on bikes to patrol the roads, it will make them fitter and teach them how to ride a bike safely.

      Agreed, but it also depends on how the conversation started out. The cops were friendly initially, while the bike rider here immediately pushed back. Most cops I know see that as provocation and react accordingly...

    Yeah, the real problem is our streets and roads were never designed to accommodate anything but automobiles. I rode a lot in college, and I never felt safe. Ride in the street you're likely to get run over. Ride on the sidewalk, you're likely to run over someone else. If you obey the law, you're likely to get hurt or cited. If you disobey the law, you're likely to hurt someone else and get arrested.
    Sigh, just get out of the city and move to the country.

      penalcrack . That depends on the country i guess. In the Netherlands it’s illegal to ride a bike on the sidewalk. You have to ride a bicycle on a bikelane or the right side of the road.

      I looked it up because of this video. Californian cities introduced bicycle licenses in the 1950s. They were repealed in the 2000s, San Diego removed theirs in 2012.

      +monkeybutttt1 28-30 mph where its flat but 4 mph up hills. Takes more energy to accelerate but much less to maintain speed compared to diamond frame bikes.

      They have those in Japan, which is actually good when your bike get stolen. Bike licenses were common in the USA 50 years ago, when I was a kid, but most places gave it up as a pain in the ass soon after that.

And agree, there is no legal obligation for you to ride on the rightmost edge of the road if there isn't enough room for another vehicle to safely pass, or if it would otherwise jeopardize your safety from the potential to be doored by a parked car, or from debris or potholes, etc.

    "Bicycle license"? WTF is that? Sounds made up...oh it is, shocker (well actually repealed in 2013). No laws were broken and the cop was the one who obstructed traffic initially by taking up both lanes.
    That said I would never ride one of these things just because they are so low to the ground. I like to be more visible to idiots on the road, including cops.

    Very nice job dealing with them in the video. I like the way that you remain calm, and just talk about the relevant laws and requirements. I do understand the confusion to the velomobile, as I have never seen one here. But once he realizes it is a bicycle, he should have moved on. Unfortunately, he doesn't fully understand the rights of a cyclist on the road.

    It is for this reason that it is a good idea to have a copy of the state statue concerning bicycles printed out and on hand. I have had discussions like this while riding a "NORMAL" bicycle. Most police departments just don't know how to handle the rules for bicycles if they EVEN know them.

      K Vogel there are a ton of home built motor driven vehicles. So yes it could be. It could be anything, hence the reason he stopped him to check it out. You can't see the guy peddling and in another video the guy stares there are electric motors available for them.

    I have often wondered if anyone has ever cited a Recumbent Trike, Recumbent Bike or Velomobile rider for viloaltion of CVC 21201 d - 3 ... Where it says that you have to have a reflector on your pedal or shoe or ankle that is visible from the FRONT AND REAR. Dont think from the rear is very possible.

      +dregerclock I remember hearing of a judge that found the rider not guilty because it was a recumbent and the pedal couldn't be seen. I usually don't encounter sensible people when I go to court though. Also, my tires have reflective sidewalls.

      +dregerclock well in my state (Mi) its law is, if you are selling a bike with pedal. the pedal must have reflectors.
      if u are selling bike pedals, the bike pedals must have reflectors.
      Mich law doesn't say u must have reflectors on your pedals.
      Mich law DOES say if u are riding 30 mins before sundown to after 30 mins sun goes up, u must have a RED reflector on the back of your bike, a red light DOES NOT replace a red reflector (it also says the red light can't be flashing, but no1 really cares). also must have a head light riding 30 mins before sundown to after 30 mins sun goes up.

    Just a thought but could you legally have a flashing amber light, solid lights don't catch a drivers attention like a flashing one will, just behind your head so you'd be easier to see when cars are coming up behind you? I've never looked to see if there is anything said about this in the CVC.

People that say they have difficulty seeing me are struggling with their own ignorance and trying to place blame other than themselves. I've found that drivers are consistent with the DMV requirement to see, they all can.

    Is the vehicle/bicycle traveling at the posted speed limit or is he impeding traffic? Does the vehicle/bicycle have ample lights/hi-viz markers, turn signals? Does the driver/rider have insurance?

      Not required to have insurance, not required to travel at the posted speed LIMIT. If there was a posted minimum speed, he'd have to obey that, something that is only on controlled access roads like freeways.
      Bicycles have supreme court rulings that they can not impede traffic while operating as designed, they ARE traffic. Bicycles are not required to have turn signals, he does have high viz markers and ample lights (not a requirement during daylight hours).

      +FLATUANT Absolutely right and along the lines of the point made in the video I could be cited for virtually anything and I will lose in traffic court because I can't prove that I didn't violate it. Guilty until proven innocent. That's how it is in traffic court though. Our life on the roads is such a mess most municipalities step up the enforcement to try and hedge against the carnage on our streets. Yes I rolled through the stop sign and encroached on the crosswalk. Think of it this way, if there were only bikes on the road would that code even exist? We created the vehicle code to keep the automotive industry in business. That includes insurance and finance. The VC was not created solely with our safety in mind. We do not enforce the code solely with safety in mind. There is a lot of money to be made and we don't have the power here in the US to choose safety over profit every time. The one year that I monitored, maybe it was 2008, there was one death in the US bicyclist vs. pedestrian and unfortunately the gal had a preexisting spine injury that made her susceptible. This occurred on a high school running track. My point is that bicycles aren't killing us. Cars are.

I havent looked up the stats on UC Davis / City of Davis, since they are considered a bicycle town! but the cops have started strict enforcement of traffic laws because cyclists have been running stop signs and getting into accidents! But as for the cop stopping you for unjust cause as in the video is wrong in all ways! plus a cop being really ignorant of laws and then stopping a person to tell them they broke a law!
      since they have passed the 3 feet law I have seen more cars come close to colliding to avoid the cyclist! where I live there are bike trails and lanes, the cyclist arent using them, they use the road and several cyclist have been killed, usually by a drunk driver! I dont ride my bike on the streets anymore, because i have been intentionally forced off the road several times and I hug the side of the road! one guy didnt notice when he forced me over, a CHP was 2 cars behind him and nailed his bony ass! I pressured the officer for an assault charge, he was citing him for a fail to yield! I dropped my sisters name as the Valley Manager, she works for the CHP in Maintenance and then he brought the assault charge and he got prosecuted for it! one year in jail!
      back when people could wear guns in open carry, I wore one and people stayed the hell away from me! cops stopped and asked why i carry one and I said the same reason you guys carry one, for safety and protection from morons trying to force me off the road! no problem, they agreed and left!

    Velomobile is THE most energy efficient mode of personal transport. Then comes recumbent bike, regular bike and walking. Electric assisted velomobile would be my choise for eco transport.

      well a police man once said to me you can't cycle here on the pavement. so I said you just saw me cycle here so I can do it. and I pointed to my tandem with a trailer behind it. and because I where on a tandem and he saw i can ride between pedestrians on the pavement so he did not gave me a ticket :-)

    Is there room in the right hand traffic lane for a parked car with the street side door open, a car and a bike? NO! The cops pull you over and tell you how to ride when they don’t even know, then say they don’t want to waste your time, which they just did. You pull out and rightly begin to ride the way you were before they cut in across your lane to stop you... Ridiculous!

    Nother example of how little police are taught or learn or know much of anything about cycling law and CVC related to it. I guess he started to understand your comments and maybe it started to ring some bells about what is legal after you mentioned things. But yeah he has the same "concerned for your safety" mentality about cycling on a street that many Motorists have. Personally I have never had an officer pull me over for anything like that. I assume because they can see I am pedaling my trike.. I think he was initially very confused by the velomobile because he could not see you pedaling. I think if you had just clearly answered him about it being a bicycle from the start it might not have been so confrontational at the start. Hope he went home and read up a little on cycling law.

    I think you should have said that it was a bicycle when he first asked. He's clearly not very bright and making that clear earlier would have been good.
    The "number one lane", er the only lane.
    "If a car came by you, it would hit you, because a car can't get by" - Uh, massive logic fail. They always make this incredibly stupid excuse and it's simply not the case. Most people slow down. Some cross the center line. Hitting slow predictable traffic is unusual, even though slow predictable traffic is not unusual.
    Center of the lane is not center of the road.
    He doesn't know CVC 21202 and he didn't know that the bicycle license program had been repealed 2 years ago.
    I love it when they pretend that they couldn't see you. Of course he could see you. He's trying to support his pre-conceived notions by lying. What an idiot.
    Reflectors are only required when riding after dark. CVC 21201(d). In daylight hours, no reflectors or lights are required.
    The impeding law is CVC 21656. 5 or more vehicles and you have to turn out.
    I envy your ability to stay cool in the face of stupidity.

      +billdavidson6 Uphill yes, I was coming out of a red light. Their concerns are completely opposite to my experience. He was right when he said he could write a 21202 citation. I've lost that one before because it's generally not possible to prove the far right is excepted. It's likely the only place it could be proved is where an r4-11 sign is posted.

I've been to and cycled in around CA for many years now, I am a truck driver and carry a bike with me. Over the last few years I've seen several Velomobiles. They seriously need to reeducate their police force, even about simple traffic laws.

      Also, i know it doesn't always work out this way: but in order to be found responsible for breaking a law it is "the state" that must prove you guilty/responsible, it's not your job as the defendant to prove you didn't break a law. They would have to prove that none of the exceptions applied, including proving that "a vehicle" (not THE vehicle, A vehicle; any vehicle that might appear on that road) and your bicycle (or velomobile or whatever you were riding) could have fit safely side-by-side within the lane if your position were as far right a practicable.
      I am assuming you were consciously riding not AFRAP because you thought the lane was not side-by-side sharable (?)

      +E Beighe In traffic court the proof required is the officer's testimony. By merely writing the citation the burden is then placed on me to prove that I was not in violation. I've done this before. I had photographs and presented my defense just to have the officer conveniently move the site of the infraction up the road to where it was wide enough. Ironically at that point I was to the right. Because this isn't justice I consider the fines I pay to be the bicyclists road tax required if you operate safely IAW national bike safety organizations. This among other reasons is why you are watching these videos today.
      At 0:05 you can see I'm in the right lane, if there weren't cars parked along the side and I had cars behind me in the lane I likely would have moved right if I thought there was enough room. As it was there was no traffic behind.
      At 0:15 you can see that I'm still in the center of the right lane but there is room to the right, likely enough room for a car and bike to safely share side by side. I don't move right for two reasons, there was no traffic behind me in the right lane and the DMV says weaving in and out of the lane when there are gaps in the parked cars is wrong because it greatly increases risk
      At 0:29 you can see that the right and left lane are now one single lane and there is still plenty of room for cars to pass safely to the left. I know that I have to take the lane ahead and I want to remain visible and predictable so I'm tracking to be outside the door zone of the parked car ahead.
      At 0:38 the lane is no longer wide enough and I'm looking for a gap so I can signal and take the lane.
      At 0:45 I was positioned a little right of center in the substandard width lane. I could see the police cruiser here start to pass but hold up and wait. In regards to crossing a solid center line to pass a bicyclist, the CHP considers bicyclists to be obstructions thus qualifying the crossing of the solid line to pass. I'm convinced, based on what they told me that the officer driving does not know how to actually pass a bicyclist in this situation. He doesn't actually understand that he is to slow take up a safe following distance and wait for a safe opportunity to pass. The SDPD Traffic Division Chief issued a memo years ago stating that bicyclists should not be expected to operate in the door zone.

    Those cops were so sincere and genuine. People are just looking for bad cops now a days. Cut them a break. Even if you were following every "law" and "street legal" it doesn't mean that you're still not in danger on the road. ie: the front reflector. Is it required? Maybe not but it's just a good idea. You might be in the right, but it doesn't make you smart.

      +Truth Seeker : Reflectors only work when there's a light shining on them from an angle that is close to the viewer. Most people don't run full headlights during the day and daytime running lights are typically not bright enough to make reflectors useful during the day. They are "be seen" lights -- not "see with" lights.
      Reflectors are only required when riding after dark, CVC 21201(d).
      He had reflectors anyway.
      Yes, they were sincere and genuine. They were also wrong about the law and safety. The rider in the video is a League of American Bicyclists Certified Instructor. He knows bike safety better than you or these cops.

      +Truth Seeker I understand what you are saying. I'm definitely not looking for bad cops. I'm not looking for cops at all. We are all in danger on the road. I have two headlights up front that work really well to see and be seen, reflectors are ineffective. You can do things that are "just a good idea" when you have a motor to drive yourself around but when you only have human power those things add up quick. When someone tells you something that you know is wrong you should tell them you disagree, try it sometime, it's refreshing.

If they were truly sincere and genuine, they would have gotten on their computer (which most of them use illegally while in motion) called up the law, read it, understood it, and been on their way. If they were truly sincere and genuine they would not have illegally demanded or even requested ID.

      +Timothy 53 In CA CVC the police are not subject to the prohibition of using devices with screens showing other than performance or navigational data. Maybe they are allowed to engage in known risky behavior because they are so good they don't need to apply their full attention to what they are doing. Their collision statistics don't reflect this though.

    I hate to say this but the way you acted was pretty deuchy. He had no idea what a "velomobile" is. You riding in the middle of the roadway is dumb if cars get behind and you won't get over hould bc you are moving slow - Stay on the right-hand side like a bicycle. That's a no-brainer. I live in Orange County and Newport Beach you can bike on a street and when cars come you MOVE OUT OF THE WAY - the streets are small there too. LOL you would easily get hit by someone texting so he does have a point.

      Accidents happen every day, driving a car has more risks than smoking cigarettes. Life is full of risks. Law is there to mitigate those risks. Nothing wrong with him riding a bike, even if it gets in another impatient ignorant motorists way. If there is not enough room to lane split, or if the cyclist is negociating a left turn, it is wise to take a full lane. Motorists who take out frustrations on cyclists by endangering their welfare by taking them over so closely, nearly running them over is a no brain move on the motorists part. Many motorists don't know that cyclists are legally obliged to utilize the roadways and follow the same rules as motorists, which more often results in unsafe behaviors and false accusations. This film merely outlines ignorance of those upholding the law, which unfortunately is embarrasing.

    California law is quite clear: you only need reflectors on bikes when you ride at night. You can ride in the road when there is no space on the right or when there is debris on the roadside or if you are riding as fast as the traffic.
