  • The Constitution is clear regarding the defection of lawmakers. The Court of Appeal and Supreme court have made pronouncements on this matter. Whether the defectors comprise the total members of the house or a fraction the law mandates their seats to be vacant. This political situation might be a gain for the APC, but legally, it is a disservice to democracy

    Adegoke Kunle San. Is right and he spoke so well. Those 27 former members are no more legislature it's illegal to operate themselves as assembly members. I think Governor Sim Fubara is right to changed the venue. Because as the Chief Security officer of his state. He's acting according to his security details. Fubara must never compromise his stands because he's dealing with those who has no respect or regards to law or the constitution.     Mr. Adegoke epitomizes what a SAN should be -- apolitical, unbiased, and knowledgeable/articulate on constitutional matters -- rarely do I see Nigeria-based lawyers conduct themselves (on tv/CZcams) as has Mr. Adegoke. His membership of APC notwithstanding, he cited authorities from the highest courts of the land in faulting Amaewhule and gang's claimant to still being legislators, after their defection from PDP, as well as in calling out governor Fubara's illegality in tampering with the legislative building.
    Reuben Abati approaches legal matters like a first year "C" law school student, I doubt that Abati has practiced law a day in his life -- he is injecting irrelevancies/speculations in a matter that the Supreme Court of Nigeria has already set a precedent. Haba, if he did this in the US, not only would a presiding judge walk him out of court ignominiously, he would also be sanctioned for legal incompetence.
