The whole not dying after being stabed in the back thing is sort of a glitch, but mostly the game working as intended.
See if you go to the Court Mage first he will tell you where to find the killer without him being arrested and the killer will try to kill the High Elf lady in the market.
But since you got the mage arrested the killer kills the High Elf and the game picks a random female resident (or in this case former resident) of Windhelm for the killer to attack in the market after talking to the mage in jail.
Funnily enough, the random woman the game picked just so happens to be your wife, and since the game marks spouses as protected (no one but the player can kill them) she couldn't be kill even by a scripted event.

When I played Skyrim I adopted Braith and another boy and I was playing a wood elf. Wood elves are strictly like reverse Vegaterians in elder scrolls and only eat meat. They are strict to eat any meat of anything they kill so whenever I found meat in the game I'd stockpile it and keep it in a enormous mound in my children's room.
