      Nintendo has to sue them even if they might lose the reason being that if they don't, then it might set a precedent that is used in the future that can be used as a defense when Nintendo sues someone else for the same thing or something similar. The defense ends up being since they didn't sue for the same/similar thing before, they lose the right to sue over this other thing later. Whether or not that would actually work in court doesn't matter since Nintendo wants to avoid that being a possibility later. Trademark and copyright law can get technical like that, but that's just my non-lawyerly understanding of it. YMMV

      Pretty bad analogy, VLC doesn’t have a tutorial to scrape movies from Netflix and are not making thousands of dollars a month. VLC also can play completely legal videos, while Yuzu almost exclusively plays copyrighted content that Nintendo sells. I’m not a Nintendo fanboy but this analogy doesn’t work

      ​@@yourmomsboyfriend3337You misunderstood the "tutorial" it seems. Yuzu DOESN'T have a tutorial for piracy. Their tutorial is for dumping your own games. Creating copies and backups of software you own is absolutely legal and has been defended successfully multiple times in court.
      Yuzu is not advocating or teaching piracy in any way. Dumping your own owned games isn't piracy.

      you know what's not open source, the keys they tell you how to get on their website. yuzu would not work without the keys. Nintendo will spank them for this.

      It's unethical to promote piracy of video games. That only drives prices up and leads to more piracy etc. Ultimately video game studios earn less money and can make fewer games.

      nah, nintendo don't operate like that. the only thing they care about is protecting their IP since their IP = nintendo. if the value of their IP is diminished, so is their company. valve has some solid IP, but if those are tarnished, well they've got a huge ass monopoly on online gaming.

    People seem to misunderstand the situation. Nintendo didn't attack Yuzu because it can play Switch games. Nintendo attacked Yuzu because they locked behind a paywall features and bugfixes for games **not released** at the time, mainly The Legend of Zelda: Tears of the Kingdom.
    Yes, Yuzu is open-source, but Yuzu Early-Access isn't. Some features become public after a few days or weeks, but this precisely means it's **not** public and open-source. This early access version of Yuzu is by definition a paid version of Yuzu, sold for profit. This alone justifies Nintendo for attacking it (is it moral or not, that's not the question, this gives them the **rights** to attack since they're **selling** an emulator). But on top of that, this early access versions added patches and bug fixes for The Legend of Zelda: Tears of the Kingdom **before** its release, only for Patreon. How could they test and bugfix a game not released? Yes. Piracy. This is proof that the Yuzu team, even if it's a single member, used piracy to develop Yuzu at one point. That is more than enough for Nintendo to attack them.
    It's also the reason Ryujinx didn't get attacked by Nintendo. They're cleaner than Yuzu in this regard.
    I love emulation. I'm a defender of emulation and game preservation. And I hate Nintendo for their anti-consumer policies. But this time, Yuzu just messed up. Even within the open-source emulation scene, Yuzu wasn't really loved by everyone for the reasons I mentioned earlier. Pineapple, a **pirated** version of Yuzu Early-Access (how do you pirate an open-source project? spoiler: it's not open-source) was made by an ex-Yuzu developer who didn't like the direction Yuzu was going. I don't want to go in the drama or pick a side, but Yuzu isn't as clean as you make it sound.
    Still, it was an amazing emulator. The Switch will soon meet its end of life and having a fully functional emulator puts my mind at peace knowing my games aren't gone once my system breaks. It's a real shame it is now gone. Thankfully competition existed almost since day one with Ryujinx. People always asked "why do you need two emulators?" and now you have your answer. Ryujinx is sometimes behind Yuzu in terms of performance but it's still an amazing software which **won't** get shut down in the near future, unless they make a terrible mistake. There are also Switch emulators for Android like Strato which are in development and show promising results.
    Citra being gone as well (note: this is **not** Nintendo's doing, it's Tropic Haze LLC (the devs) shutting down Citra in the process) is the real bummer there. The 3DS is defunct and playing via emulation is better than playing on real hardware. There are other 3DS emulators in development but since Citra was so good they were all just hobbyist projects which aren't vert fleshed out, so for now 3DS emulation took a harder hit than Switch emulation, while being the most important right now (the Switch is still an active system).
    Love or hate Nintendo, love or hate Yuzu, this situation is really bad but it doesn't kill emulation forever. Nintendo still let Dolphin up even after sending a DMCA notice to Valve for adding it to Steam. Nintendo is aware of everything, of every emulator out there, if they don't take action it's because they know they don't have the rights to do so. Emulation is not dead, it's legal, and will always be, unless you do something illegal like piracy. Just like it is illegal to use leaked documents to develop and emulator, it is illegal to use a pirated game to fix your emulator. Yuzu is therefore illegal since the release date of Tears of the Kingdom. Does it really invalidate all the hard work of the devs to make the emulator? I don't think so, but Nintendo is right to say "yes" and attack them.

    My fav theory was that Nintendo learned very bad lesson when they won legal battle on Donkey Kong, when they argued "King Kong imagery is used so broadly in popular culture it's not real IP anymore" and won
    Since that, they close every hole for the same happening to them

    Nintendo doesn't really have any case here. Yuzu doesn't distribute decryption keys that enable the use of Nintendo Switch software. Those files need to be acquired from a legitimate Nintendo Switch. Unless there's an official build floating around that completely bypasses this requirement, Nintendo doesn't have a leg to stand on.

      If nintendo is suing them now, then they definitely feel like they have a case, they wouldn't do this and waste time and money if they didn't or they would have done it years ago.

      Yuzu is making almost 40k a month off their patreon of which they sell beta builds of their emulator. Other emulators do not do this.
      The money they are making via this saw a direct increase around the time Tears of the Kingdom leaked online before its launch date. Meaning people were paying for a newer build of Yuzu to emulate Tears of the Kingdom, which is potentially profiting from piracy which is not allowed"

      Yeah but I'm P sure the decryption key argument was what nintendo used to get Gary Bowser with SXOS which was a mod chip company for switches. SXOS also didn't provide those decryption keys but the argument didn't hold much weight because the chips were still capable of using those keys to decrypt the gamebackups which Yuzu also does.

    little addendum: is generally legal, at least in EU, to bypass protection to make "personal backup copy". This include dumping AND bypassing anything that would prevent your copy to function properly.
    Because of that, hacking console to be able to run personal copy is legit not only personally, but also commercially. Of course guarantee is void :)

      @@zekiz774 Yes, that is a common misconception. Private copies are only legal in the EU if those copies are obtained in a legal way so without circumventing protection. If you buy a blu-ray movie with copy protection and use software to rip it, that copy is illegal, even if you made it as a backup for yourself. The weird theory is that such a law exists because it actually negates a consumer's right of personal copy. The law needs to change. 30 years ago I could record TV movies and episodes with a VCR, due to lobbyism und law changes I cannot do that anymore despite the fact that technologies have advanced so much.

    Correction: dolphin was not served a dmca and not from nintendo.
    Valve got C&D (not dmca, that's not a lawsuit here) because valve reached out to them and they replied with it. THEN valve complied and took dolphin down....and that was the end of it.

    the fun thing about yuzu is that the experience of playing on PC, at 1080p 60fps, with a good controller, is better than playing in the original console with an original controller.

      Isn’t the point of a switch that it’s portable? I don’t know but for me it wouldn’t be a win if I could say „wow instead of playing this handheld game in handheld I’m sitting in front of my PC“… kinda defeats the purpose.

      Unfortunately, this will have no effect on the 'fans' of Nintendo which worship what they do. Many will never see it and those that do won't care in any immediate sense. Maybe when they get older and finally realize how fucked this is but even that's questionable. The Internet has taught me to question the intellectual capabilities of people and their foresight or lack thereof.

    In Spain (and i think in all of europe) you have the legal right of make copies for personal use of media you buy, so i legaly can make copies of a nintendo game if i want, in fact, in Spain you pay a little tax because the government and manufacturers already assume you're going to store copyrighted stuff in there

      We also have it in Poland, it's called "opłata reprograficzna" which can be translated as "digital reproduction charge". It's funny, because technically it's not a tax -- it goes to select few art-related organizations that lobbied for the law, rather than to the government. But it's basically a tax which manufacturers of media devices are legally required to pay.

    there was a similar case in the manga/manhwa world recently: a shitty manhwa publisher threatened an open source manga reader called Tachyomi with a lawsuit for piracy. The thing is, Tachyomi doesn't actually host/give access to pirated content, it's just a reader app that allows for user-made extensions and THESE extensions can give access to piracy websites. That's like suing google for showing piracy websites in search results. You would think this is silly and would get nowhere, but you would be wrong, the Tachyomi devs caved in for some reason and abandoned the project (it's still up but won't get any updates), they probably got threatened. A number of similar projects and forks appeared but it sucks that the apps/extensions got fragmented like that.

    For anyone wanting updates: Yuzu will pay 2.4 Million to Nintendo to settle the Lawsuit, that was a decision made by both parties (That's what I could find online).
    Someone said to me that Yuzu added a copy of Tears of the Kingdom, to their Patreon, if that's true, then that would explain why Yuzu went to pay for damages. Being able to make Millions out of an emulation device is crazy though,I won't lie,.
    Another update: I found out that yuzu had code for description of encrypted data by Nintendo games built in.
    They also announced an online mode and put that under paywall and then took down under the risk of lawsuit.
    They also have a stash of leaked games on gdrive they would use to download the games to make the emulator compatible before release meaning they never paid for games.
    And finally they added an update on yuzu a month before tears of the kingdom that would make it impossible for the emulator to run tears of the kingdom before the release because they were already emulating it before the game was released. Again there's so much wrong it's no wonder Nintendo won this and even destroyed citra too. The team managed to fuck their other emulator just to avoid paying a bigger bill to Nintendo.

      they don't the patch for ToTK is done by the community, this patch is also being added to their pre-release version, and this pre-release version is locked behind patreon, bad move from them, they should wait to merge the patch for the ToTK a month or so after ToTK release

      Yuzu never circumvented copies of Tears of the Kingdom, its mods, or made anyone pay for online. Online is P2P. Yuzu always had the release protection since it they've known of leaking Switch games pre-release. The only thing patreon got you was the ability to be a guinea pig for unstable builds.

      the problem is that they want you to buy a switch. and they rather have more people buying a switch and then some games, instead of slightly more people that only buying the games and no switch. And the games also dont hold up on other consoles/PC, only a few get pirated because of the IP Zelda/Pokemon for example.

      @@groghnash Sony wants people to buy PS5s and they still do PC releases, and have had great success with them. Hell it was thanks to the PC release of Helldivers 2 that has made it the popular multiplayer phenomenon it is now. Consoles and PCs are separate markets as those who primarily play on PC don’t have any intention of ever buying a console, especially in regions where it’s more expensive to own a console than a gaming PC like Brazil or Eastern Europe. Doing PC releases is obvious, and Nintendo wouldn’t even need to do day in date releases. They can limit releases to older titles so those who don’t want to wait would be more incentivized to get a Switch, just like Sony does with their PC strategy

    Reading on Lemmy already shows multiple people have downloaded all related Yuzu source code and Yuzu Early Access source code and reuploaded anonymously on multiple sites. Nintendo might be able to halt Yuzu development but not destroy the software, that will stay around.

    Most video game companies nowadays produce bloated trash that isn't even worth pirating. Nintendo games however have such great quality that I want to like the company, but their predatory behavior towards their fans just doesn't let me like them. Its stuff like AM2R, the covid melee turnament, the youtube nintendo partner program, their fight against emulation and game preservation and so much more stuff that absolutely destroys their image. I can't help but hate them more than all other video game companies out there.

      Pirating game isnt ok. The emulation teams are the hero of people around 3rd world country and poor for how they provide us to play our favorite games cause we either cant buy the system or games are too expensive for us. Literally many places nintendo has no distributor, $60 for a game is an entire month salary for many people till this day, emulator are thereby a hero for us. Then people like you go on spouting pirate the games loudly. While I think it is true that most of the big AAA games are incomplete scams filled with bugs that makes a game unplayable and that spending money on them isnt worth it cause how bad employees are treated and with layoffs here and there without a reason while the gaming market is rising.
      But game developer like nintendo are great, actually deliver what most expect. The games arent radically changed for sake of change or bullshit political map.
      This time nintendo sueing yuzu is over what seems to be absurd still got some strong cases of how yuzu dev teams boldly stating of pirating tears of kingdom in their official discord and how yuzu was working ahead of release for a smooth running of totk. The nintendo was lurking all over discord and media collecting evidence since long. And when they see something like this then they become more dedicated on stopping project like this.
      In most of the people of 3rd world country they dont even enjoy pirating with all that risk of virus scummy ad filled links slow speed of download and risk of account getting hacked similarly games have to be played at least settings with 15 to 20 fps.
      The proudest moments in our mind is going rightfully to buy an actual game hardware and actual good games without worry.
      At this point you arent actually not even buying the games to buy them but more like donations where those that can pay will pay to support a creator.
      Most of other companies especially western company are kinda scummy how they are filled woth false promises of a huge games, over the top budgets hiring employees here and there then later scrapping game laying the employees with no care pr giving out half ass game.
      Well nintendo as a game devs arent that bad to employees in comparision, they respect their devs thats why the first mario game still has spirit of the latest.
      So plz remember for majority of us piracy isnt something glorious but a necessity to enjoy our beloved games. And we would pay every single cent for the game if they are worth it if we could.

    Not willing to take the L, Nintendo sued Blockbuster again for ... providing copies of their game manuals. Blockbuster decided to settle instead of going to court again since they had the money to pay a 3rd Party to make their own Guides and Manuals back then.
    So they were bent over before. By Blockbuster of all companies.

      I never knew! When I was little my parents rented games for me from Blockbuster, which was how I discovered Super Mario Galaxy 2. We also rented Mario Sports Mix and Kirby Mass Attack. I don’t remember manuals being included in the game cases, but that’s a ridiculous thing for Nintendo to go after.

    I vividly remember those TOTK days. The reddit community of yuzu(the original that got hammered) was one of the best and most fun community ever existed in reddit.

    "Facilitate" means to make easier, so for them to say it facilitate piracy doesn't make sense - not just because the emulator doesn't provide any way to get games on its own, but also because by the time you open it to play, you have a game - and thus, if you downloaded a game instead of dumping it from a legal copy, the piracy **has already happened.**

    This is just like before all the streaming services. Tons of people used to Pirate movies/shows/music. But now that there is Netflix/Hulu/Spotify etc less people pirate that content. Point is, if Nintendo would make their games available on other platforms such as Windows, Mac, and/or Linux then less people would pirate their IPs.
