      @@travisleeabq It's not a "legal theory" when the U.S. Constitution supersedes any gun and mag ban. If you ever noticed when state and local officials get sworn into office the United States Constitution is first and foremost then the state Constitution and the laws thereafter!

    Hats off to those Sheriffs who stand with the people and not the tyrannical government. The second amendment is our last line of defense against against our totalitarian democratic governments. There will be a second war of independence and our for-fathers seen this coming.

      The Sheriff is not doing his duty in full. COLOR OF LAW: “The appearance or semblance, without the substance, of legal right.” State v. Brechler,
      185 Wis. 599, 202 N.W. 144, 148. “Misuse of power, possessed by virtue of state law and made possible only
      because [the] wrongdoer is clothed with authority of state, is action taken under ‘color of state law’.” Atkins v.
      Lanning, 415 F. Supp. 186, 188.
      CONCLUSION: Common Law is the law of the land; any statute in conflict with the Constitution is
      unenforceable; and, to enforce such statute is a crime. It is the duty of the Sheriff and U.S. Marshal, being
      Constitutional Officers, to make sure judges, officers of the court and all elected, appointed and hired servants
      obey the law; and, when they violate the law under the color of law, it is the ‘DUTY’ of the Sheriff & U.S.
      Marshal to arrest such public servant immediately.

There are a realtively few firearm extremists making the case for all sorts of exotic weapons and accoutremont. They want to do what they want to do, when they want to do it and why. All they do is make things harder for gun owners who want to do the right thing, be good neighbors and support their society.

    Sheriffs are sworn in; this means they take an oath to uphold and defend the constitution of the United States. Politicians also take this same oath. When politicians try to strip rights from the people, they should be removed from office.

      Municipal police and federal enforcement officers also take the same oath. Much like the one I first took in '03 "...I will support and defend the CONSTITUTION against all enemies foreign and domestic and bear true faith and allegiance to the same..."       There are many laws which are constitutionally dubious and then there are some laws which are blatantly unconstitutional but the legislators don’t care.
      One example is California passing a law which restricts concealed carry to be basically impossible in any public setting. There is absolutely no way that will not get rightly struck down by SCOTUS.
      California is doing this because the judicial process for finding a law unconstitutional is slow, especially with the 9th Circuit Appeals Court in CA staffed by far left ideologues running interference for their preferred policies. But more importantly, there is zero personal accountability for the politicians involved in passing unconstitutional laws, and therefore zero incentive for them not to do so. They can just keep spamming unconstitutional laws and some of them will always be on the books because the courts just haven’t gotten to them yet.
      When a law is taken to court and found to be blatantly unconstitutional, the legislators who voted for that law, the executive who signed the law, and any writers of the law need to be held accountable by at the very least being on the hook financially for the costs accrued defending that law in court.
      That would very quickly put an end to such legislative spamming.

      @@BiggumsMcHoney The Illinois definition is extensive, but they basically define it as any belt-fed, magazine-fed or fixed-magazine-fed semi-automatic firearm which has anything reassembling a stock or handrail.
      Edit: Made the summary more accurate. They don't include automatic, just semi-automatic, for some reason. Also included belt-fed firearms.

      @@truthhurts5158 Yeah, which means that the type of gun or magazine size is not protected in particular, right? You just assume it's all guns/magazine sizes. Who said it is? At the time the Second Amendment was created, the predominant weapon was single-shot flintlock guns.
      Also, you know damn well that the Second Amendment's original purpose was another one when created back in the day. Today's view of it is heavily biased thanks to the gun lobby indoctrinating the society so they can make more and more money. And it seems you willingly play right into their hands. Hurray!

      Grow up, when I was a teenager boys carried buck knives on their belt and wore them to school, we had gun racks with our guns in the back of our pick up trucks. The only violent indecent that I can remember was when a kid threw a metal trash can down from the third floor to the first where a student was seriously injured. No stabbings, no shootings.

      People are making too much out of this. It's important to note that all of these sheriffs are only saying they will not enforce one specific provision of the law. That's the part that requires you to register firearms and magazines that fall under the grandfather exception. None of them are saying that they won't enforce any other part of the law or that they won't enforce the law as a whole.
      And there is likely a more selfish motivation for them not wanting to enforce that particular provision of the law. In order to do that they would need to implement and maintain a system to be able to catalog all of that data. That would involve a huge amount of money and manhours most of them simply don't have.

These days, they're trying to be SS elitists. I could take it or leave it. Last time I tried to flag one down to report something suspicious going on. I got treated like the suspect.       The second is under a fierce attack right now though, but it's also being fought in court rooms all across the country.
      They're attacking free speech as well, and conditioning us to question just "how free" it should be.

      @@LuccaAndretti We don't need servants from the executive branch of the government (e.g. sheriffs) to question the laws enacted by the legislative powers. That's the judicative powers' job (=in the end the Supreme Court).
      What this sheriff does is basically violating the separation of power - one of the major cornerstones of US society, laid down in the US constitution itself (and by far more central in there than the 2nd Amendment). But he's obviously pro guns, so many people go "yay, great sheriff!".
      For me that's absolutely hypocritical - the sheriff is trying to show off as a defender of the constitution - but is also only picking out the parts that suits his needs and is popular (=the 2nd Amendment). He probably just wants to position himself to be re-elected as sheriff. And what better way to do this than showing off by opposing this law and ensure the support of the powerful gun lobby and all its supporters?

    As of yesterday there were 67 County Sheriff's (and counting) in Illinois out of 102 counties who have said they will not enforce this law due to it being unconstitutional.

      State Police have jurisdiction over local Sheriffs. Fatty is planning to enlist State Police to randomly check shooting ranges and events to look for offenders. You can try all you want but you will NOT win a fight against the Fourth Reich.

      @@twinnevans971 Yes they have jurisdiction in the Counties, but they do not under law have the authority "over" Sheriffs'. They cannot order Sheriff's to do anything. They can enforce the law themselves in those counties, but they cannot order Sheriffs' to enforce the law in their counties.

    As another sheriff stated a few years back, the armed citizens are the first lines of their own defense against criminals who are trying to hurt them. They show up to secure the scene and fend off any other threat.

      Ignoring that the 2nd Amendment is the last line of defense against totalitarian entities and unfortunately for us we never saw it to it’s ultimately conclusion. You can have all the guns in the world, but if nobody knows how to organize and fight then they’re worthless. The US should have either mandatory service or another form of obligatory service in a new military organization specifically designed for the purpose of turning civilians into excellent guerrilla fighters or garrison troops.
