  • Tracy wants Peter to pay child support and seeking backpay. They both agree that Peter has made payments to her each month. The underlying issue is that Tracy is upset that Peter now dates a former student from Tracy's yoga class. Will Tracy get the relief she is seeking?

    This is why you give money orders or checks eveytime the child needs something so that it can be tracked.

      @@OJ-615 Not impressed with this man bc he brought proof of what he was under paying. Of course he thought it was sufficient. The judge gave him credit for what he paid and gave him the balance he owed. The child should live as comfortable as the parent that makes more money. This man seems to be ok with his child having less. If this kid is spending his time with friends or girlfriends, that means it’s not time spent with him so at least there’s money so he can afford a more comfortable life.

      Exactly that happened to my father with his first 2 kid's he gave money to the kid's every week and when the kids turned 17 their mother said he never paid anything and he owed back pay even though he gave money to the kid's every week.

    My ex wife n i divorced we used our joint bank account for me to pay/deposit my weekly child support payments. We did not have the amount given to us from the courts but an agreed upon amount. 5 years later, never once missing a weekly deposit, I'm summoned to court where my ex claims I've never once paid a penny towards child support. The chaos that ensued was enormous. I labeled our account " child support only" I had to prove with bank statements for 5 years that I never withdrew money & only deposited money. When the judge asked what were all the weekly deposits for my ex answered, " I thought he was giving me money to not complain" I got lucky the judge seen right through the B.S. or I would have paid 5 years of back pay. I got lucky I got the judge on the right day. There's too many loop holes in the system

      You didn't get the judge on the right day, you made the right move in making sure you were doing the payment in a way it could be tracked. Judge just wasn't a dunce.

    I worked for child support . And it's crazy to me how child support can be implemented when one of the parties involved is mad at the other. Because it really has nothing to do with the child or children. That needs to change.
    I've seen a girl put her child father on child support because he wouldn't but her concert tickets. And the father was taking care of his child, he just wasn't with her anymore. Blew my mind. She ended up mad because child support was less money than he was already giving her every month. Doesn't pay to be greedy.

Even after death child support will try and find property and anything else they can find under his name , to sell to pay that child support. But as long as he working under the table leagally they cant demand something that not in the system.

      I know parents use the cs as a weapon but it still needs to happen despite the reason behind it bc the child's life regardless will be more comfortable. It's bad enough he/she has to live without both parents together. At least the financial aspect is one less thing to deal with.

      @@irmaadams7780 I answered a question. But to be honest child support is not needed . You dont really want the authorities to be in your business. Because when you do you loose control and the state tells you what you can do with YOUR child. What really needed is the two adults the made the decision to sleep together and have a baby. Grow up and learn how to communicate and co-parent.
      If that's hard then both of the parents should have been think about whi this person is I'm sleeping with. Mist people on child support knew who the person they were sleeping with were before they did it.
      I tell people to go in your bathroom or any room where you have a mirror. Look in and fuss and cuss that person that's looking back at you. Because that's who you mad at

    The respondent was very efficient when it came to supplying his financial documents. The plaintiff looks like she is all the way bitter and thought that backpay was going to destroy him.

      He’s organized but penny pinching on his son. He was efficient to himself, not his son. The children are supposed to live as comfortable as the parent that makes the most money. This clown thought 600 was “sufficient”? That’s why there’s s set formula, bc “efficient” men like this put themselves first. Pitiful!

      This!! my baby daddy’s mother received child support until he turned 18 and she would use it for drugs. to buy methamphetamine!! and his shoes were messed up and needed clothes badly as well as needed new shoes but she never got them for him.

    I wish I had you as a judge in the state of Georgia! My ex doubles my income and only makes 2 payments per year to me just enough to avoid getting his license suspended. It sucks to sacrifice everything to to take care of child while the other parent is going on vacations, buying a new house and Harley Davidson but will not make monthly payments to support his child!! Exactly why we need to be selective about whom we reproduce with.

      Aswin Prakash he still wants a relationship with me and therefore if I’m not willing to be submissive to his request even though he has a wife and he made it up in his mind that he will not provide for her unless I deal with him. Eventually he’ll get what’s coming to him. I’ll continue to provide for her by any means.

    People if you find yourself in this situation please make sure when you pay this money to the other parent that you put in the memo that it is for Child Support otherwise the other parent or a judge can consider it a gift!

      How is it fair 🤔 They don't go by the child's average expenses (which would make sense and he pays healthcare) it only goes by the yearly income of the non custodial parent. A millionaire and a minimum wage worker would have 2 VERY different child support amounts. AND it technically should be his share and HER share of paying for the child. Not just his responsibility. You are ridiculous.

He pays for insurance, has his own place, makes good enough money to pay over a grand a month in child support, why doesn’t he have custody?     In the state of Texas if you're going through a divorce child support is implemented within the divorce so you shouldn't have to pay child support until after the divorce is over, but if you're separated for the man please pay something so that he could be credited to you when you do go to divorce court and they see that you been paying money orders send it through the mail certified so that she has to sign for it

      Bring receipts, a copy of the complaint, a copy of the response, and a notepad and working pen to take notes.
      If you have one, bring a recorder and ask the judge if you can use that (check local laws, but it's a trick I learned from Attorney Steve Lehto.)

    You made a comment briefly that she had accepted the $600 a month as child support. I immediately gravitated to that being like an oral agreement of acceptability. Why would further backpay be required if she had agreed to $600 a month previously? Seems like that should nullify backpay, like going back on a verbal agreement. She's mad now over his new love and isn't agreeable anymore. Seems like revenge money she is seeking.

    You should do a court case example where the child lives with one parents but not the other, however the parent that the child lives with does not allow the child to stay with the other parent. But the parent that the child stays with requests child support. I hope that makes sense!

    Really? This was revenge support, not anything about the child. Along with 50/50 custody in every state, the table the judge refers to (similar in every state) which is base (I'm good with) child support PLUS the sliding scale (wealth transfer) based on income needs to be dealt with in each state's general assembly. The tables are EXTREMELY abusive and should be done away with completely. It should be base child support only and then 50/50 documented expenses after that with an allowance for income disparity.

    My ex had a min wage job when we separated. He was order to pay 100 per month, the lowest possible. He did so ONLY because he was legally obligated to. He WANTED to pay 20 (yes TWENTY) dollars per month.

    Had it been me I'd have told the judge I'd pay the back child support amount in full in one payment and kept the lower monthly payment. This what happens in a marriage when women start ignoring their husbands... my ex stop all intimacy in the bedroom after we'd been married for 6 years. I finally said "see ya" and moved out. She filed for divorce. Unfortunately for her, we had a good prenup and she left with half of our joint bank account; nothing more. Btw I'm still married (28 years later) to the women I met after her.

    My husband took me to court to get his support lowered. We we divorced we agreed on $400 a month. He wanted it lowered to $200 each month. The Judge some how found out he was starting a new job soon and wanted it lowered before he started working. His starting pay at his new job was $6.000 a month lol. Well his support got increased to $700 a month. Jokes on him.

    My son’s “sperm donor” didn’t have to pay all the back pay because it would’ve been 12 years worth!! They tried going after him when he was about a yr or so old, but because we weren’t married & he had lied to me saying he wasn’t, I was told we had to have a “WITNESS”!! He was a TriMet driver & whenever any of the other drivers would say something, he would always say, you look at her & then look at me, you think I’d touch anything that looked like that???

    I find it interesting that some court shows give people credit for "child support" paid before there's an order, and other's don't. Please explain the discrepancy. The other thing I find interesting is another show, you made a father pay way more than his child support obligation because that was what he thought he should have been paying, and you told this guy he could have paid more and his backpay would have been less. Based on your other ruling, he could have also been stuck with paying more than his legal obligation. How are non-custodial parents supposed to balance the two scenarios? One guy gets stuck with paying way more than he should, and one guy gets stuck with automatic backpay which incurs interest. Both are ridiculous! How can the state even allow interest to be incurred on child support? I'm hoping Texas doesn't have a law like Florida and Michigan where back child support can get your license suspended.

      Well she said in one episode that backpay can be ordered only when requested but under some circumstances she can order it if necessary but I always wonder the same thing cause it doesn’t seem to be following precedent

      My oldest son father never paid anything I waited five yrs to get him a chance to spend time and split necessities for my child he never did so I went put him on child support and asked for back pay my son is now almost 10 yrs old he left state and I have never received any support and he has never to my knowledge been arrested either 🤷‍♀️ I never understood how some states will give some men yrs in jail over maybe a few months behind on support yet my son father has 10 yrs behind and hasn't given any support nor jail time

      Texas does have a law like this and are pretty harsh on people who owe backpay! After a certain amount you could also lose your right to travel by revoking your passport and have you charged once you go 6 months without a payment and or amount reaches $5000.00 a warrant will most likely be served! This is a business that states took on where they make a profit off of collecting backpay for support! According to our constitution non payment of child support is not supposed to be an arrestable offense but instead a Civil Matter! The states made it a jailable offense! Think about that for a minute!

    Hello, they just started this, it's new, least he tried to pay every month till they went to court .
    He should of not been charged for the 5 months . Should of been AS OF TODAY SIR you will start to pay $1,098 .

      It’s 6% interest. The state of Texas (Attorney General’s Office-Child Support Division) has an interest considering they provide the service. They act as creditors just like any other service provider.

And that's why she doesn't want me to get 50%, because then her support check would go down.

      @@radiantgoldensun6438 most times if a custody battle is entered the man has to prove the mother completely un fit, as in a danger to the child. If all things are equal (neither on drugs in a violent life etc. Etc.) The defualt will go to the woman.
      As custody cases can drag out for a long time and become expensive, with little chance of winning, it is not usually in the interest of the man to fight for full custody.
      In partial custody, i.e. the 50 50 you spoke of the man also gets hit with childsuport.
      I'm not so much against the payment. But parental rights in america are far from an unbiased practice.

    For those not aware when the Non custodial parent doesn’t pay their child support they have a past due balance which has interest so every month that past due balance still exists it keeps going up due to the interest and whenever another payment is missed. So whenever the NP pays the passed due balance known as arrears the money goes to the balance owed first before the interest like with a credit card balance or a car note. If the past due balance is $130 and the interest is $50 and you pay $150 the $130 of the $150 goes to the arrears and then the $20 left over goes to the interest. Also if you are making payments directly to the CP be sure to get a form that you fill out to keep track of all the payments you made that the CP has to sign off on as proof that they received the money. Kinda like a time sheet. But most child support agencies enforce a income with holding order

      Why would you push for that? He was under paying. There’s a formula for a reason. The parent that does all the work should be awarded some relief to cover expenses at least. Men act greedy trying to give the bare minimum. The children should live as comfortable as the parent. That’s why that formula is designed.

      @@irmaadams7780 Greed exists on both sides, do not solely blame men.. particularly the good fathers who are the ones who get screwed most. If dad has child 40-49% of the time, he is still expected to do the same things as mom and provide a quality lifestyle. But he has only 70% of his income to do so, while mom may only have a 10% bigger burden but gets 100% of her income plus another 30% from dad. How is it fair when dad has half a glass of water and mom has a full one .. of course dad is left thirsty. So the courts tell him to go work more, which cuts into parenting time and hurts his and child’s quality of life
      Deadbeat/absent parents aside, child support is ridiculous overkill towards the actual cost of raising a kid. I have two kids with my wife and we spend less on them then I pay in CS for one to my ex. It’s just hidden alimony and a way for the state government to get more funding through title IV

    In NJ. My ex paid nothing nothing 2 years. I filed for support after getting nothing for 2 years for 2 kids. He makes 70000.00 a year. Ordered no back pay. Only form when I filed and he wound up paying 150.00 a week for 2 kids and covered insurance which was completely free from his employer. I was screwed. I had to work 2 jobs to cover all that our kids needed. And he saw then when he felt like it.

    Here is a little help for people who is paying child support based on Texas laws. Move to a different state and change jurisdiction. Most states allow for travel cost to exercise custody to be deducted from child support payments. If you move far enough away all of the child support will go toward travel cost and she will not get a thing. There are ways to deal with a spiteful exe. Work under the table. Seek custody all the time and keep her in court defending custody. After she get to about 40000 to 100000 in legal fees she will have a more open mind about things. My kid mother went in debt close to 60000 dollars before she gave up. Them attorneys took all her money while I represented myself. Needless to say, I got custody of our daughter and now she has to pay me child support in addition to the debt she racked up to defend custody. Hate bring out the worst in people.

      Dont be scared, you need support and his father should be taking care of half the responsibility aswell. Do whats in the best interest of your son, if you're struggling, get his father to step up and help you out there is no shame in getting help to raise both your guys child. There's only a need to be scared if you've done something wrong such as play the system, aren't sure if you know who the father is, or if you've been a bad parent, but in your case you love your child. Hold your head up high & go file without any fear. Be polite & professional while your in court & you'll see that you've got this.

    Did I miss something, like why was her income not mentioned and calculated? I think based on my experience that 1000 dollars a month seems high. I think it should fall somewhere between 700 to 800 a month.

      The judge follows the law. Doesn't matter if yo think $1,000 is a little high and if you think 700 to 800 is best. There's a formula. The child should live as comfortable as the parent that makes the most money does. Be happy for the child or suck it up.

    My question is what happens when support obligation ends and there is still a credit left? Does the Child Support Distribution cut a check to me or do I have to sue my ex for it?       Well, I imagine it will be handled the same way when the child support ibligation ends but there is still some money owed from back child support. What’s done is a very minimal extremely comfortable payment plan is given.

    The state laws sucks and don't give a man a chance!! It's not right mine was 37,777.00 for 2 yrs and I was working on the road and missed the court and that's what they give me. What a bunch of bull. Judge was never fair to me@!!! Same thing happen to me bitter azz woman, but the courts the see that and that judge saw and should've dismissed the case period. Her reason for being there had nothing to do with the child!!!
