last point. at 19:20 fact finding hearing dangerous to men because normally you are dealing with 10+ false allegations, not just one.
I never had false allegations of domestic abuse, but the amount of character assassination and slander in the family court documents was unbelievable. Can you imagine good husband's and good father's who have done their duty as a husband, being treated with these false allegations.
And from the beginning of the court visit we are deemed guilty having to prove ourselves innocent.
Then the enormous piles of rubbish we have to wade through in family court, dealing with these allegations. It is exhausting. We just want to see our children!
This video was very helpful. I have a fact finding in August. About 30 allegations. I’m currently in contact centre every other week since early 2023.

All men should read practice direction 12J, it's entirely scripted and premised on a non empirical based claim from women's aid, it's all claimed by a criminal organisation of man hating feminists called women's aid, who are also placed into roles within CAFCASS also & they both conspire deliberately against fathers & judges go with women's aid narrative to deliberately portray fathers as perpetrators in every instance and women as victims in every instance to keep the women's aid funding going and to increase it.
This document is entirely premised on the unverified, unconfirmed claim of between 1994-2004 supposedly 29 children were killed exclusively by men in the UK and therefore men should absolutely never be awarded custody or be allowed around his children without extreme supervision as all men are extremely dangerous to children and 100% are always the perpetrators & with this completely flawed and deeply biased feminist narrative that is absolutely absurd for anyone who claims to have a braincell to sign off on and stand by.
It's a non scientific uneducated claim by a man hating organisations and not done by specialists without gender biased, it's entirely done by a feminist organisation women's aid & how anyone doesn't see anything wrong with that is insane...💯

This information is great for all fathers going through this ridiculous process (thankfully I managed to avoid a finding of fiction.. oh i mean fact hearing, but if we were to have had one I'd have all my facts against the ex made findings of the court too.

PROBLEM 2: A wife PROVEN to have made false accusations with EVIDENCE, in a family court has no repercussion! No perjury. No LOSS OF CREDIBILITY. No CONSEQUENCES. The family court judge can completly erase this from his judgement because of the principle of 'best interest of the child' - can't jail a mother for lying, who will look after this child. So wife LEGALLY immune from any consequences.
In a criminal court if a wife is found to have FALSELY accused the husband, and PROVEN with EVIDENCE, then the LEAST is her WHOLE testimony loses credibility. And with the Johnny Depp Amber Heard case the culture of 'believe all women' is changing.

PROBLEM 3. In a family court the judgement is made by a JUDGE on the BALANCE OF PROBABILITIES i.e. was there a 51% or more chance that it happened.
In a criminal court, the judgement is made by a 12 person jury and BEYOND REASONABLE DOUBT, I think means 99% certain that the husband did this.
SOLUTION: So maybe a solution is to refer ALL domestic abuse allegations to CRIMINAL court. Traumatic for the falsely accused dad, but the mums false allegations get scrutinised.

Thanks. I had no authority over my children. It looked to me like she simply wanted me to pay her for "her" children. It made sense just to move on and pay the child support.
I was told a finding of fact hearing not proportionate..is that a good thing?

Was it the judge that told you that? If so it is a good thing as it means they don't think you need a Finding of Fact (aka Finding of Fiction) hearing. Normally they will state in the order that comes out after the hearing that a Finding of Fact hearing was considered but is not considered necessary in the circumstances.
@numerouno2532 yes it was recommended by cafcass in initial safeguarding report.the consulted practice direction 12j and believe a finding of fact to not be proportionate..
1st unattended hearing judge had ordered a section 7 to be compiled by cafcass and to be disclosed 2 weeks before
1st attended hearing in March ordered
@@prestigedevelopmentslondon3860 Yes PD12J is what they refer to when considering a finding of fiction/'fact' hearing, and it's a joke of a practice direction but held in high esteem by the court. Nothing is ever guaranteed (especially with the family court) but it sounds like you have managed to avoid a finding of fiction, sorry I mean fact. The other giveaway is they normally do not order a section 7 report until after a finding of fiction, sorry fact.. if they were still unsure whether they wanted one they'd have delayed ordering a section 7. Sounds like you're progressing well. Good luck!

Just an update alhamdulilah, the judge has granted me interim access before the per trial hearing. If you don't ask you won't get. Always ask for access and more access on your statements. Keep your heads up high guys and always read up and learn about your and children's rights.

I am going to fact finding hearing and my ex wife has made all of these horrendous allegations. However, I have massive amount of evidence that she is lying -
I.e. she has give 3 statements with conflicting dates and stories with one story and date which is impossible as I was not in the city. I also have in excess of 500 pages of psychological and controlling messages, I also have loads of evidence to prove she is an abuser and has severe mental problems. I also have video and voice recordings that she admits that I am not an abuser would fact finding be beneficial for me as I have nto seen the children for 6 months and I believe I could get full custody of the children.

PROBLEM: a falsely accused dad is stuck in limbo. Because dad's judgement is from the family court. And at 16:40 it is UNBELIEVABLE that DADS BARRISTER CAN'T DEFEND DAD AGAINST THE FALSE ALLEGATIONS. This moment has to be clipped! I know you Faroukh were disorientated after he said this😂 How ridiculous. A fact finding hearing and you can't defend yourself! What a load of nonsense.
Dad can't use the criminal court standard to SCRUTINISE evidence e.g. dna, CCTV, timeline inconsistency e.g. in this video the example of wife alleged an attack but at time of this, the husband was in another country.
Because referral to the criminal court can only be done by the accused i.e. the mother.
So a false accusing mom KNOWS her accusations can be PROVEN to be a lie in Criminal court, but can keep the judgement of 'guilty' from the family court judge on an innocent dad, forever.
Why not talk about the fact they don't have any jurisdiction from the start it's all fraud

Fact finding hearing is really important in THEORY.
It is supposed to be an attempt at justice, with facts proving or disproving allegations.
But dads barrister can't even defend dad. 😂 What a horrible joke.
