Question No. 11 of Fatwa No.5741
Q. The one who does not judge by what Allaah has revealed, is he a Muslim or a Kafir [guilty of] the major kufr and are his actions accepted?
A. All Praise is due to Allaah and prayers and peace upon the His Messenger, his family and his companions. To proceed:
Allaah the Most High said: "And whosoever does not judge by what Allâh has revealed, such are the Kâfirûn" (5:44), and He the Most High said, "And whosoever does not judge by that which Allâh has revealed, such are the Zâlimûn" (5:45) and He the Most High said, "And whosoever does not judge by what Allâh has revealed (then) such (people) are the Fâsiqûn" (5:47).
However if he declares that to be lawful (istahalla dhalik) and believes it to be permissible (itaqadahu jaaizan), then this is the major kufr, the major fisq and the major dhulm which expels him from the religion. However, if he did this due to a bribe or some other motive while believing in the forbiddance [of this act], then he is considered a disbeliever with the minor kufr, a dhalim with the minor dhulm and a fasiq with the minor fisq which does not expel him from the religion as the people of knowledge have explained in the exegesis (tafsir) of the aforementioned verses.

Ruling by other than what Allah has revealed*
Ibn Taymiyyah
“Whosoever does not judge by what Allâh has revealed, such are the unbelievers.” Meaning: He holds it permissible to judge by other than what Allâh has revealed.” (Majmû’ Al-Fatâwa 3/268)
It was said to Ibn Bâz: “But whether someone has made something permissible is in the heart, and we do not know about that?!” He replied: “That is right.” (Al-Dam’atul-Bâziyah)
So don't trust mistranslated videos by khawarij online saying ibn Uthaymeen said this and bin baz said this. Just open their books.

the brother who responded is confusing between thinking that prohibited things are permissible or/and good (istihlal al-haram) and thinking they are prohibited but still doing it and/or allowing people you have authority over them to do it.

Al-Tabari reported: A man asked Ibn Abbas, may Allah be pleased with him, about this verse, “Whoever does not judge by what Allah has revealed, they are the unbelievers,” (5.44). The man said, “Has one who does this committed unbelief?” Ibn Abbas said, “It is a type of unbelief if he does that, but it is not like one who disbelieves in Allah, the Last Day, and so on.”

As you explained the scholars of Tasfeer says; a ruler will be included in the first category[Al-Kafirun] only if he believes whatever he is implementing in terms of non-Islamic law is better than the shari’a and what Allah almighty has revealed to us.|
No wise person would say that a ruler who mandates other than the sharia on a national level does not think that their secular laws are better than sharia. Also, kufr can be in action as well. Only the murji2a are the ones who say that iman is just i3tiqad Al qalb without actions. The kuffar of Quraish did actions of kufr yet only believed that Allah had the ability to provide for them and believed that Allah was the creator yet they were still kuffar. And there is ijma3 as cited by Ibn Abdul Barr and Ishaq Ibn Rahway and Ibn Katheer among others that the ruler who mandates secular laws is not a Muslim.

It is ok to someone to make duaa for you. It a lot better to do it yourself for yourself and family. I have lived decades not making duaa. I used to think duaa is for old people. Manshallah! Your videos are always concise, relevant, and presented with a lot of wisdom which I think many of the other brothers are missing. I am not even talking about the contents but the "approach". And as I responded to your critics on this subject , one can have all the knowledge in the world but if one is lacking wisdom the knowledge is vain. I am not here to participate in the online drama but I stand with the truth and believe in this case your approach and understanding is the true understanding and approach. Most of people who will disagree with your understanding are people from/living in the middle-East. I ( African) went through this discussion over and over with my wife ( Arab) regarding Libya, Syria etc. I was always told I don't understand the situation of people living there, the cruelty , the corruption of the leaders/government in these countries bla bla . They seek help from the kufar to kill their fellow Muslims, and their goal is not even to install Islamic values but "demon-cratie ". Sad!

Some people just want to call for change because they do not have patience. They have no real solutions or implementation strategies for their desired end goal. No proof of their ability to execute said plan, no experience implementing but they instigate instability. I disagree with a lot of things I saw while living in Saudi but there was so much good there as well. May Allah preserve all Muslim lands upon what is good and guide them away from what is wrong. aameen.
The most significant example which could be used to refute these people is that of Abdullah ibn Umar praying behind alHajjaj ibn Yusuf who killed Abdullah ibn Zubayr (Abu Bakr’s grandson) and many scholars and was a known oppressor. It got so bad that hajj was stopped for a year, imagine if that happened in this day and age, what people would say and do…
Criticising and rebelling are two different things

Those who misinterpreted this ayat are mostly those who don’t even judged by the Quran and the sunnah when they’ve internal dispute with their own family.

One of the signs of hizbutahrir when I was with them or attending their classes that they themselves don’t apply the sunnah in their house , one of the teachers would tell us he listen to the opera because it’s soothing , one teacher used to be beard shaven , it’s just so funny to me how their adhering to the sunnah level was

One thing I learnt from studying basic economics, is that civil war and natural disasters are a cause for a weak economy. This is a clear mafsadah that isn't spoke about and can be expanded on heavily.
They know that they want the Muslims to have in house fighting . Syrians fighting syrians Egyptians fighting Egyptians the Arab spring. The Iraqi war they put the sunnis against the Shia.. American promoting takfir the way of the khawarij
