- USCIS released approval and denial data for Quarter 1 Fiscal Year 2024 so we can calculate the approval rates for EB1A (Extraordinary Ability) and EB2 NIW (National Interest Waiver). We will also see the top 10 countries by number of approvals and the number of people waiting for a visa number.

May be in the future you will have time to make a video about the consulate procedure and the stage when NVC tries to organize the interview in the exact consulate for the approved petitioners, cause this stage is really in the fog.... nobody knows the terms and you have no one to ask. It will be really helpful to get information on this stage...

Hi Oscar, the address on the RFE for NIW are 2 different addresses i.e., an address on the first page on the RFE and the second address is on the cover sheet.

If you didn't get the receipt , it's not normal. I would contact. If you mean that there is no decision yet, then it's normal

I want some advise regarding my case EB2 NIW which was submitted in November 2022.
I got denial after RFE back in July 2023. What should I do now as I did not receive the denial notice yet just checked the status online on April 20, 2024.

Hi Oscar. Thanks a lot for your informative videos. I submitted my eb2 niw petition in March. I got fees deduction letter from USCIS. But there is no online access code in that letter. What should I do now for online access code? Please guide
In the letter you got from USCIS there is a code with three letters and ten numbers, that's your receipt number . Use it to track the status of your petition by entering it in egov.uscis.gov/

Do they publish statistics on EB2-NIW RFE approvals and denials? I know for HIB they have that.
No, they don't
Hi Oscar, i have submitted i-140 form since 3 months and till not I didn't receive the receipt number. what is your advice on this? I stay overseas but I submitted g-1145 form as well.

Lástima que no den los datos por stem y no stem, el ratio de aprobación ha bajado porque se incrementó el número de casos no stem que lo tienen difícil ser aprobados. En otro video vi que si comparamos los casos stem realmente el ratio solo cayó 1%

They'll have to wait until visa bulletin allows them to proceed
I received response from USCIS. What does it mean?
The application/petition has not been fully completed. One or more of the following fields) were not completed:
Part 1 501(c)(3) or government research nonprofit organization
- Part 1 25 or fewer full-time equivalent
Clearly, that those fields in the form were not completed...You can download the petition from my website if you want to see how it's done.

I have approved eb2 NiW petion and DQ since 5 months. However, my PD is not current. I have also got H1B visa and going for interview in a month. Does this effect anything as H1B is non immigrant visa?
H1B is a dual intent visa, so you are fine

I feel the decline is that many people are applying even though they might not qualify for the EB2 NIW category. Also, if it the application is not well drafted it will get declined.

Why do you say its 'more than a decade' for Indians? It still shows 400k people waiting on H1B. Accordingly, by the country cap it should take a little over a 100 years. Would love to hear your opinion.
More than a decade is more than a decade, not a decade. Regardless, we don't know how many people are still actually waiting and how policy changes could affect the wait time if that happens a few years from now.
Declining is more as people are doing themself.

Hi Oscar. Thanks for updating on the approval rates. I am from Pakistan and submitted my petition in September 2023. The USCUS received it on 11 Sept 2023. The fee has also been cased but still I didn't receive any acknowledgement or receipt number from USCIS. What I should do for it
You should contact USCIS , that is not normal. It's possible the mail got lost. Go on the USCIS website and ask Emma to speak with a live agent to see if they can help you . If you have someone in the USA, maybe you can ask them to mail a copy to them.

Hello oscar i take an email from uscis for my eb1a pettition "We have taken an action on your case" but for one month there is no information on my uscis account whats this email
It's best you contact USCIS instead of trying to interpret it. Contact Emma on the website and see if a live agent can dig into it

they don't answer. live chat officers can not explain what does that mean either. We had the same note from them ab a mounth ago. We tried to ask them online, and the only thing we received when 30 days passed "we will contact you soon" and silence))))
