Yudy, Missed the live session and will come back next week. How can an employer terminate the H1B employee without offering return cost of transportation and no severance package or anything extra (Same day termination)? I do not see anything in my contract stating I waved off this condition. Are there any loopholes in this process which my employer might have used. It is below 5000 employee company. side note: The management of this company is known for gaslighting its staff, for a while i thought i was laid off because of my mistake but turn out the company has been laying off its staff silently without wanting to come in news. It has done significant number of layoffs in last two three months without grabbing any headlines. Employer was located in Texas, and I was working remotely. Are there any state law that override the requirements to pay return cost of transportation. From what i read on internet, for bona fide termination, DOL still imposes the requirements to offer return cost of transportation. I left USA on my expense by the way and had suffered significant hardship in terms of lease breakage and other agreement breaking charges.
