    Just completely foolish. Now he doesn't get paid and has to redo the driveway or forced to pay someone else to do it.
    I have been an independent contractor for 5 years and have yet to have a disagreement with a customer that could not be resolved with good manners and compromise.
    These types keep lawyers working.

      @@DABIGDAWG001 that's when you show the quote, with it itemized to show how you came to that number. If trash removal is not included in that itemized list, you are not responsible for it. If they still refuse, you go to court. Destroying the work done is dumb because likely you'll have to pay for that anyway after being sued.

      If nothing else, it would, in theory, protect both people. At which point the question becomes whether the "contractor" has the sense to not add damages they'd need to pay.

      And she could. The contractor should taken her to court and he could have gotten a contractor's lean on the property. Making it part his property until the debt was paid. But now he has to put the driveway back to it's original (or like) state before he could sue. US law, I don't know what country this is.

      This has always happened. Only now video cameras are so common that people are videoing everything. The contractor was angry and thought he was doing the right thing. He didn't realize that he was being photographed doing a criminal act.

      There are a few ski resort areas in Australia couple of them near Melbourne.
      But me I live in Southwest Colorado 20 minutes away from the purgatory resort and our snow in the winters can range from 3 to 9 feet depending on the year so that’s kind of where my mind goes when I was just being flippant

      In my experience in construction homeowners often want to deal with cleanup themselves to save money so it doesn’t surprise me at all that cleanup would be excluded from the contract. Also these guys are form concrete guys they arent a disposable company its unreasonable to expect that from them

    I had a customer try to short me almost $5,000 just because it took an extra week to complete the job. We took on a full house renovation job during the winter time and almost every week we would get a nasty storm and had to go out plowing or materials could not make it safely to the site. We took them to court immediately and showed the judge the signed contract with the agreed amount and even all of the bills for the materials and everything was itemized to a tea. Even though it took us longer we had decided to be nice and cut them a break on the labor cost and never went over budget. The judge ordered the customer to pay the remaining amount and our court fees.
    And just for the record I am not one to just go in and destroy somebody else's property unless I have a documentation order from a judge that gives me permission to do so

      @@chriskelso723 I partially agree with your statement, however, at the end of the day there's only so much that the employer can eat cost on without losing too much money. Labor was probably cheaper to cut (while still paying employees their agreed upon rate and hours worked), where materials would be more costly to make an attempt at cutting.
      At the end of it, it's easier to utilize less manpower for a job and "cut labor" versus using subpar material or cutting corners where it concerns the health and safety of the customer.

    Also as an update, other contractors came in and fixed up the driveway for free. So it did have a happy ending. That’s what’s nice about Australia, if something goes wrong against you or even just something bad, like floods, happen, you have the community that will support and stand behind you, no matter where you are.

      It's not that she put a value on removal of rubbish. The terms of payment are done in stages in an attempt to incentivise the contractor to do a good job, and to protect the customer if they dont.
      The initial deposit is paid so the contractor can buy materials. The rest is withheld until the completion of the job. This gives the customer a chance to inspect the job is complete and to a reasonable standard, and if it isn't, the final payment is withheld until the problem is rectified.
      In this case, the customer didn't consider the job complete because the rubbish wasn't removed, so withheld the final payment.

      They didn't try to alter the price. They withheld final payment until the job was completed. Pay attention.

      Contractor took away the debris, crushed it to be used again and then sues the homeowners for time and labour and came out on top. The community rallied around the idiot homeowners and paid for their driveway to be finished. Everybody got what they wanted and the neighbours paid for it.

You present your bill to the customer, and the customer doesn't pay and laughs in your face. And the court system is either very slow or corrupt. You might be paid years from now pending on court decision, or you might never get paid. The law might be behind the customer, the law might say you can't destroy what you built, but as we are humans, it's perfectly understandable if you burn it all down.

      You wouldn’t be arrested, since this is not criminal court, but rather this would fall under Civil Court, where two parties can plead their case and a judge or in some cases a jury will decide who is the liable party here. If you were to be charged criminally though, it would likely be ‘destruction of property’.

      @@jesusflores1916 Really doesn't matter. A contractor doesn't have a right to destroy their work once affixed to the home. It is then under ownership of the homeowner and affixed to the property. Contractor must go through litigation and attempt to recoup the money. They can even place a lien against the home, until the balance is paid in full. But they do not have the right to destroy their work, without the ability to restore it to its original state before the work was performed.

      I've seen contractor's liens (that must to be filed before work begins) on commercial jobs, but for residential, they're just taking their work back. FAFO.
      No one ever thought the clean-up was worth more than half the price. She played games and didn't realize that blue collar guys don't play that way (on any continent).
      My ex was a plumber, and if you tried to play games, he'd smash the urinals or pour rice down the vnets, with the legitmate argument that since you didn't pay, the stuff still was his to destroy. (And it's always some rich prick lawyer in Potomac that thinks they'll withhold payment...)

    My father is a contractor, usually when there is garbage or debris that need a seperate charge to be removed as their quantity being excessive or need special handling, it is written in the offer we give to the customer that there is a charge for it which they can either pay or hire someone else to do the cleaning, if the offer says "after this job the worksite would be left clean and ready to use" it means there would be a garbage-debris disposal without any extra cost.
    In case the offer only mentions about the job and nothing about the garbage, for example if the customer has done a verbal agreement about who would handle it, it can cause a serious headache but still the dispute usually goes against the home owner for asking services not included in the invoice, because hey you can't ask for services you didn't pay for.
    That's why you should read and read again what you're agreeing to, becareful.

      Yes, and I'd imagine it would be helpful for the builder to disclaim cleanup costs in a contract as well, because non builders don't typically know what it involves , and would expect a clean tidy driveway at the end

    Contractors always try to get out of doing that little extra. I had tree removal guys leave behind a 4 foot log on my property that I asked them to take along with the other 40 foot tree.
    They refused because we hadn't discussed it as part of the deal.
    But I did say I wanted every branch and log of wood gone from the property before we agreed on the price. So I got them there!

    Contractors like this should go to jail for fraud. Basically scam artists. Underquote to get the job, then either leave it unfinished or start tagging on extra costs that weren't included, then threaten propery damage to get more money.

    I used to work at Lowes. A lot of contractors would shop there. And now, I can see why some came in with attitudes. Make sure you can fully pay your contractor before work gets done. They deserve better.

    I would think the trash came from the contractors’ work and that they refuse to clean it up after they finished. So they homeowner didn’t want to pay the whole amount because they probably thought that the trash removal and clean up was apart of the job.

    If you told me it would cost 6k to redo the entire driveway start to finish then my understanding is that that 6k was material, labor, and removal. The home Owner already made an initial payment to you and here you go destroying the work you already put in is destruction of private property.
    You could of done the reasonable thing and disputed it in small claims court and worked it out, but since you destroyed their property that they had already made a payment towards then your now looking as paying all the court fees, redoing the work that was destroyed for free, and paying a hefty settlement to the home owner.

    There was another case where a contractor ripped out a bathroom and stated on social media how the client refused to pay. But turned out, client was out of town, returning the following day and wanted to see it before making final payment. Plus the video, had other contractors pointing out the shoddy workmanship of what had been done, i. e. tile misaligned. And the client wasn't refusing, just wanted to see the finished product and give final approval. Once the contractor had his money, it's doubtful he would have returned for any warranty work. But he expected her to approve the work sight unseen.

    Aussie here - justified imo - tradies get messed around usually by those that can afford it. No guarantee the people would show up let alone pay at court and he’d be out the expensive court and lawyer fees. This was the cheaper option and showed the neighbourhood what kind of people those homeowners were

    I’ve worked on contracting jobs a number of times and every time cleaning up is an included aspect of any agreed-upon pricing. The only time that it would ever differ is, if you’re in as a subcontractor then maybe you don’t have to, but usually clean up is an included aspect.

    At the end of the day the homeowner only paid a small portion of the 6k if they truly thought they were right they would have paid the balance and dealt with the rubbish removal charge in court. But they refused to pay full stop
