      virgin even. I was pulled over for
      going 20mph in a fifteen. He was
      sitting in the back of my highlander
      suffering from allergies. Was searching for a tissue and they
      pulled him out of the vehicle and
      tried to scare him by putting their hands on him, roughing him up
      trying to get him to resist. He did
      not. They had to let him go but
      it was totally illegal not to mention
      WRONG. They told me to stay in
      Car and pulled him back out of my
      vision. We didn’t get names or

    I hate it when he says "officers lie because they're just like everyone else." It's like "no they shouldn't be" they have immense power over the ordinary citizen and shouldn't be able to just freely lie and the be blindly believed. They should be held to a higher standard because they have such power and be held accountable because that power shouldn't be abused.

      @@omars-qz6rn yes, in Philly I always said if you want to go to jail, get a Public Defender, because they usually have many cases and don't know much about any of them. In this case I'm sure his Public Pretender will throw her all into this, it's a big case, could make her famous.

    If you are not required to present ID, then the act of the officer threatening arrest is deprivation of rights under color of law by coercion. If they actually arrest you, then it the same crime but "by force". This lawyer is a danger to our constitution. Also note - whenever you give your ID to police, they will run you through several state and federal databases for warrants. Each time your ID is run for warrants, there is a record of it. Any time you apply for a job or a loan (especially at a larger corporation), one of the things they check for is how many times you have had your ID run by police. Even if it comes back with no warrants, it can still work against you when you apply for a job, a loan, etc.

    I got into trouble once, some 40 yrs ago. The cop picked me up and put me in his car. No hand cuffs. I was scared shit less, I spoke not a word. On the way to the jail. We have all heard that you have the right to remain silent. So, on the way this cop asks me all types of vile questions. And tries to claim I was some kind of psycho.. We get to the jail where two other cops are waiting. The cop that brought me to the jail opened the door and told me to get out. So, I did. Then tells me to face the wall. When I did the other two cops grabbed me and slammed me head first into the wall. Then they grabbed my arms and bent them behind my back and slapped the cuffs on so tight they cut into me. After a few slams to the head they took me into a holding tank. I sat there for eight hours until I was bonded out. After wards I was told I had to come back and talk to a detective. I was told to be honest with him and everything would be OK. So I go in and this guy starts accusing me of all kinds of things that never happened. It was not until recently I learned that in order to take the fifth. You have to talk to the cops and tell them that is what you want to do. Learn from my mistake keeping quite will only get your ass kicked. I wondered why they treated me so rough for years. I never resisted or made any trouble.

      @@garryhubbard5190 Maybe....but it is practical, because confrontation with the police can be expensive in both time and money, even when you are in the right. There are no Constitution angels out there ready to stand over you with a flaming sword as it spirals out of your control. If you are a agent provocateur for the ACLU then have at it. No one's saying you have to allow yourself to be violated by cops.....just don't be a dick just because you don't like police and your day will go a whole lot better.

      Just because our reality isn't ideal, because there shouldn't be consequences for telling Leo to fo, doesn't make his advice incorrect.
      I think he could've saved himself a lot of negative comments by clarifying how it's supposed to be, vs. how it is in reality, and why he gives the advice he does.
      When I advise my kid not to get overly intoxicated, wearing a miniskirt at a frat party, it doesn't mean i think shes asking for anything.
      When I advise my kids that, should they ever find themselves in a situation where domestic violence seems imminent, their best option might be to placate their would be buser, rather than righteously popping off, and telling their abuser what a pos they are. It doesn't mean Im asking them to throw away their rights to make the abuser happy or accept the shitty situation permanently. It doesn't mean I don't think the situation is okay. It means they're in a dangerous situation and there's a way to minimize the risk of harm, and that most definitely would be placating the would be abuser.

    Isn’t it terrible that you’re not required to have an ID or present and ID to an officer in the United States but simply because you exercise that right, you can get arrested and still face huge consequences and permanently being in a system where the only thing that people see is that you have been arrested. I’m not saying I wouldn’t show my ID to avoid that, I definitely would, but definitely not because that’s the way things should be.

    I have not been pulled over for years the last time it was harvest and the combine broke down. I was running 15 mph over the limit and had my usual .44 on my hip. The officer was not able to turn around brcause of traffic. Our highway has no shoulder and is dangerous. I saw his lights go on so found what I thought was a safe place pulled over to wait for him. When he pulled in behind me I asked right away if he was safe were I pulled over. It turned out I knew him very well and in fact often talked guns with him. When I informed him I had my gun he reminded me he knew just what I carry. No trouble I got a really strict warning and then he asked if he could use my gun range of course I said yes. If I was not polite and honest I told him we had a harvest breakdowm anf I had panicked worrying about the crops.

    My favorite one is the only charge is resisting arrest. How can one be only charged for resisting arrest without another reason for being arrested to start with. 🤣

      that's because in reality police have their own laws ... your are guilty ( that means you can be arrested) until they/you can prove that you aren't .. .. you were proven innocent of your original crime but well u resisted arrest so that's your crime now!... interfering with investigation they call it I believe .. makes sense right .. lol.. lol

    This is bad advice. Being arrested is a problem, true, but you shouldn't waive your rights to prevent an unlawful arrest. Stand your ground (verbally/legally) and if they arrest you, don't resist and hire a competent lawyer. They will tell you how to fight an unlawful arrest, how long that can be stored and how to request your arrest record to make sure it was deleted everywhere.

    If you're arrested for standing up for your rights, the arrest will not stand up in court and wouldn't be used agaisnt you when looking for a job or could it cost you a job. Any lawyer thart would tell you to speak with police officers or i.d. without being placed under arrest, or voluntarily allow them to search yourself, your car, or home is an idiot and not a good lawyer.

    Rule #1. OBEY! COMPLY! or Die! when confronted by a "King's man". When (IF) you get to court then *maybe* you can present your doubts, If the court has time to listen. Seizure and searching computers and mobile phones are violations. RARE is it that a Kop can get a search warrant for specific information to seize, they get a warrant to FISH for anything they can charge.

    Times we live in is changing for the worst. We have democrat liberal officials, whole police forces that not only hate this country as founded ,have no respect for the constitution they swore to uphold. They despise civil rights. It may have proper to cooperate with authorities and over information to assist these authorities in the distant past. Not this day and age. As raised , I will always treat an officer with respect. But that is all. No voluntary information. I will not agree to searches. And invoke my right to remain silent

    @4:06: There's quite a bit of excuse-making for unjustified bullying and invented pretexts for searches or uses of force. You seem to excuse all searches as reasonable as long as an officer can invent a suspicion--e.g., bulges in clothing, "furtive movements" (real or imagined), hands near a waistband (you know, where hands usually are), etc.
    This is the strange inconsistency of conservatives who are both "anti-government" and obsequiously deferential to authority. I just don't follow the legal theory of a defense attorney who pre-emptively excuses violations of civil rights... unless he's just a cynic/ pragmatist who thinks civil rights are better thought of as mercies from our betters if we cower and snivel appropriately.
    You're seriously talking about cops as if their power resides in veiled or implied threats, not in legitimacy, and it's not clear what conduct from them you wouldn't excuse. Should I ever need one, that's not the sort of defense strategy I'd want.

      This guy clearly says to never talk to the cops under any circumstances. From his perspective as an attorney, if he was defending someone, he cannot say that the cop is outright lying, rather, he is informing us that cops will say things such as that "real or imagined"; eg the bulge in one's pocket.

    You are only expected to identify yourself to Florida law enforcement officers (police officers and Sheriff's deputies, not immigration or FBI agents) when you are stopped on suspicion of a crime or a traffic violation. If you don't have identification documents, you may choose to remain silent.

    If I'm minding my own business then there no reason for an officer even speaking to anyone. But, they get bored and the go ' fishing' but, no one seams to tell the cops what to do. Why can't they honor the oath, do there real job to protect and serve instead of making arrest out of nothing!! ALWAYS RECORD THE POLICE NO MATTER WHAT. Lawyers take oaths to the government 1st not the people.. Every single police officer does lie and lie to make arrest!!

    You have rights…
    BUT, in reality… you don’t.
    Cops gonna do what cops gonna do… just cooperate.
    Sure you have the right NOT to be illegally searched or seize…
    BUT…
    This is how your gonna get illegally searched and seized.
    You realize don’t you, that whenever you say “But” you negate whatever you just said prior?
    You have a RIGHT…. BUT….

    Everything you told me about police officers in this video confirms my opinion that at least 60% of our officers require RETRAINING.
    “Your rights don’t matter. Do as I say and you won’t get hurt/arrested.”
    Yeah… Because cops are never thugs, bullies or tyrants.
    You: “No, cooperate with that, because cops ARE thugs, bullies and Tyrants.”
    At least as I understood your subtext.
    I do appreciate your “let’s be real” approach to encountering law enforcement. But the picture you paint is… “If you haven’t done anything wrong, you are not going to get hurt/arrested. Just give up your right as a private person, it’s OK. If you insist on that right… we’ll… you are going to suffer/deserve the consequences.”

      They have different databases, and I'm pretty sure they do save arrest records somewhere, at least for a while. When they are legally obligated to delete, there's always a chance that they just don't, but there are people who are deep into this and there's ways to request your arrest records, which tends to make them delete what they have to before giving you your information. Google how to request your arrest records and just try it out if you wanna be sure.

      thats how the law reads ,as it is today in almost every court RAS is 100% subjective to the officer ,even though the SCOTUS has ruled numerous times that exercising ones rights (4th A) cannot be deemed suspicious they will do it anyways and get away with it

    My standing policy to dealing with cops - I give them my full legal name and social security no. & then go mute. I respectfully decline to answer any questions, not even innocuous ones like, "Where ya comin' from?", etc.

      You don't even have to give them SSN, they've no right to that as a non-federal agent (I don't know if you're required to show someone like the FBI the SSN, but definitely not some lower tier copper), just only that identifying information legally required. The law does say that you have to verbally claim your right to silence. "I claim my right to silence, I decline to answer any questions" or "I invoke the 5th Amendment" ought to be enough.

      You're an idiot. Under Section 7 of the Privacy Act of 1974, neither federal, state, nor local government agencies, including police, have any legal authority to demand your SSN, and they may be sued under 42 U.S.C. Sec. 1983 for monetary damages, injunctive relief, attorneys fees and costs of suit. Giving up your SSN is giving up your valuable right to not disclose it to police. Don't ever give your SSN to a cop before consulting with a lawyer to determine your rights.

    I fish while open carrying a pistol here in Florida because I am allowed to do so. Florida Statutes Title XLVI crimes 790.25 (3) (h). The local police don't like it and become confrontational because they don't know the law, and some idiot calls them and says there's a man down at the river with a gun. So I have to correct them and show them a copy of the law which I bring when I'm fishing. I don't have to ID either unless I'm being detained or arrested. They tell me I have to ID and I tell them no I do not. If I am arrested, qualified immunity is not going to help after I've given them a copy of the law, and they've called into their local station.

    keep your cellphone locked. it's your life. whether cop, girlfriend, mother, etc., anyone will find something in it to complain or bust you about no matter how innocent you think you are. as a tech guy, let me remind you to only use a PIN code unlock. that's best along with an automatic wipe after like 10 wrong tries. a PIN depends on your memory and consent for access. if you use face or fingerprint unlock, these can be taken from you by force. a PIN requires your conscious decision for access. you're welcome 😎

    "Do police officers lie?" Well, for that question, I believe his answer was spot on. However, I do believe that a better question would be, "Are police officers legally permitted to lie?" That answer would be an astounding "YES!!!"
    So, that old myth about how an undercover cop when confronted with the question, "Are you a cop?", is required by law to tell the truth, and admit to being a police officer, is nothing other than utter BS. Not only can they lie about being undercover, they can lie to you during a traffic stop and lie straight to your face about what is going to happen as a means of intimidation to "persuade" you to allow them to do something which you have no legal obligation to do. About the only place where they are not permitted to lie, at least theoretically, is within the court room upon that witness stand. Then again, who knows? With what some of them claim to be the truth on the stand, they very well may have some deal worked out in the judicial system where they are allowed to spew forth lies while testifying on the stand???
    Anything an officer might ask you, you should assume that you have the right to refuse, to say "NO", because if the officer has the right to do it, and your permission is not required, then they would just do it, they wouldn't bother with asking your permission . . . they will only request your permission when they need it, such as when they wish to search your vehicle.

    Laws vary by state. Ohio revised code 2921.29 requires identification of name, address, DOB when requested by law enforcement if you are or may be a suspect, or a witness to a felony (short version)

    Police are allowed to lie, but if you lie to them it's a crime so your best bet is to keep the conversation to a bear minimum and if they start asking a bunch of questions, remain silent --5th amendment-- and if asked don't agree to anything especially if you are innocent

    If approached, or stopped I always start out friendly with, "Hi officer, how can I help you?"
    That suggests I'm friendly and intend to assist. That puts the office at ease. If driving I have my license and hand it without being asked. We ARE required to show it if driving.
    If asked to show proof of insurance, I say, "The papers are in the glove box, my neighbor, the sheriff, told me not to be digging in there when you were walking up. With your permission, I'll get them out".
    That sends the message I am friendly to law enforcement and my neighbor is the county sheriff.
    A skeptical officer might decide I'm making all that up so I have his name and address which shows he lives close by.
    I don't speed, I use my cruise control so it's always some other reason if I get stopped. I have not had an encounter in many years except for a burned out headlight. That only merits a warning which is nothing so long as you fix it.

    We don't owe them any subservience. That's the problem now. They're more committed to getting responded to like dictators that employed public servants who took oaths they swore to uphold.
    Actually, the onus is on them to be polite, courteous, and respectful. For several reasons. Whether we choose to or not.
    This idea that we need to bow to cops for fear that they'll abuse their authority and violate our rights if we don't is absolutely ridiculous. You talk to them how you choose to.
    The only thing he was right about is the fact that the cowards will go rogue when you don't bow to their imaginary authority.
    THAT'S what needs to be addressed. Not this idea that encouraging tax paying citizens who employ these homegrown terrorists to cower in fear to them is the best path forward.

    I e always been polite and have a script. Good afternoon officer what did i do now?..oh really I always make an effort to come to a complete stop (example) I was poaitive I had but I know you guys have a tough job so won't argue the point. Is there an option to just pay the fine when the ticket comes? (They always say yes and assume youre going to pay and sometimes lower the charge if possible because you're the first person who was polite, respectful and didn't argue and call them a tyrannical a$shole. They likely also wont take a bunch of notes or plan to ahow up at trial. Then I took pics, had my son sign an affidavit that I always explaing what Im doing while driving and described how to always come to a complete stop. Filed a trial by mail, which is allowed in California (and gives you a 2nd chance to have an actual trial with the judge if you lose), where I argued that the law doesnt state how long to come to a complete stop and that Id done so for at least a millisecond and felt the shift from front to back in the truck along with providing a diagram and pics of the area that showed there was no way officer could've seen the stop either way. Win the case and the $220 i had to put up to have file by mail returned by check.

    Your answer on house search was a bit incomplete. They can and often do go into houses if theres probable cause of a crime being commited at that moment. Hell, all you have to do is see all the vids on youtube . Theres the semi famous stolen Apple phone with the airtag, cops end up in the house with no warrant AND the homeowners screaming no consent. And sure enough, home boy owner stole the phone.

    Honestly I’ve been pulled over for more than one traffic offense though I would maybe have liked to be difficult I was polite and jovial and usually let go with a warning
