  • There are certain decisions the VA makes that the VA is (mostly) stuck with. This can help you a lot as you continue to fight your claim.
    As always, if you'd like me to help you with your disability claim, the easiest way is to schedule a call with me through my website, walshvetlaw.com/contact-me-fo....

    Thanks for this video. I was hesitant to file secondary claims out of fear of loosing my original service connection.

    What about Separation Pay?

    • @WalshVetLaw
      @WalshVetLaw  Před 3 lety +1

      Are talking about Involuntary Separation Pay or Disability Severance Pay. If you later apply for VA disability you can expect the VA to recoup the latter.

      I received an Honorable and Separation Pay. Was Voluntary.

      @@christroutman382 There is a sliver of a chance you can claim current hardship so as to get recoupment of your separation pay waived. It would probably take going as high as your Congressman/Senator to apply the pressure, and it still might not work, but it could. What can't be waived is the half-separation pay to those who were involuntarily but otherwise honorably discharged. (Weight standards, failure to advance beyond terminal rank, DADT.) For that there is no remedy but waiting for them to recoup that pay. Trust me on this, I tried. That's where I learned all the above.

    If you reopen your claim, it brings everything back available for review

    • @WalshVetLaw
      @WalshVetLaw  Před 2 lety +1

      Sometimes reopening the claim can trigger that, sometimes the VA will do it on their own.

      Yes but it's gonna be addons. For example but not limited to: dependants and combat related injury addon. Also SSDI is pretty much a sure thing if you're 100% plus plenty states wave property tax for 100%. If you include things like that, it's massive

      @@26longlongtime SSDI is nowhere close to a sure thing. Maybe before the law change in 2017…but not now. In fact I just lost my court hearing last month even though the SSDI doctor pretty much agreed with the VA doctor. That bitch female judge basically just crapped all over my evidence and picked it apart because she felt like it.

    • @WalshVetLaw
      @WalshVetLaw  Před 3 lety +23

      I am a licensed attorney, and I am accredited by the VA to represent veterans before the VA. Knowing how the VA works is part of maintaining that VA accreditation. It is very important to me that what I say on my CZcams channel is accurate because my reputation and credibility depends on it. If you found an error in something I've said, please let me know so I can correct it.
