    BIG Age Difference:
    If you fall in love with someone, your ages, are what they are.
    They can not be changed. It's a red flag, But not necessarily
    an insurmountable obstacle. I have helped plenty of couples where the sponsor was over twice the age of the foreign fiancee. I got them ALL approved.
    NO Recent Meeting
    This can be easily overcome, either by good planning or a frequent flyer miles. The ideal case, which I recommend to all clients, is
    that once the couple has sworn undying love, they should meet every SIX to NINE months. As the Scottish poet, Robert Burns wrote, "A man is NEVER too tired to travel to meet his lover".
    The couple that demonstrates with their frequent fyler miles, that they wish to be together, has an easier time to have their bone fide's believed.
    Some couples can't afford a lot of travel. This is very common
    and perfectly understandable. If one can only afford two or even just one trip,it is important to submit the visa petition as close to the return from the trip as possible. The meter starts running as soon as the American returns to the USA. If he submits the petition, almost
    immediately upon return, then chances are VERY GOOD, that by the time it starts to looking awkward that he hasn't traveled again,
    the foreign fiance could already be issued her visa and be on her way to the USA.
    A lot of clients hire me a month or two before their trip. That way
    I work with them to get all the information, and background out of the way calmly and deliberately well in advance of departure.Then DURING the trip, the couple follows the customized checklists I have personalized to their situation to get final evidences, photos and signatures during the precious few days of the trip.
    I have their petitions sitting 95% complete on my desk during their holiday together, and just as soon as the American returns, he sends me the final bits and I return his petition to him ready for
    his signature and IMMEDIATE submission to USCIS.
    NO "Front Loaded" evidences.
    My last caller "We submitted a THOUSAND PAGES of evidences" but the consular officer still denied the petition.
    All three couples, sent their fiancee's to the consular interview, hand carrying various amounts of evidences, including a Manhattan telephone book sized stack of correspondences by my last caller.
    The Consular officer, does NOT have to look at the evidences carried by the Fiancee. Officially the CO is supposed to make his decision based solely upon evidences that USCIS had seen.
    This is important, so let me repeat,
    The Consular officer does NOT have to look at any evidences
    carried by the Fiancee.
    In all the three cases, the CO did not allow the fiancee to hand over evidences, instead, asked a few questions, then sent the fiancee home with a rejection slip.

    I had 2 fiancee visa denials. In both cases, consul wrote "No proof of relationship" on the papers while verbally conveying different non-legal reasons to my fiancees. Since it happened twice at different consulates with 9 year time gap, and after reading DOS advisory cables of 1999, 2001 and 2004, I'm convinced that this was a widespread practice at American consulates due to the doctrine of consular non-reviewability.

      My experience is that the consulates approve well documented cases that clearly demonstrate a couples bone fides. Well at least I am glad to say that the consulates have consistently approved the cases I prepare. It's unlikely there is a widespread conspiracy by the US foreign service to deny in general. If your cases were both denied you should look to the common factors between the cases, ie: who prepared the application, what the quality, quantity and selection of evidences were etc. I have helped many couples who were initially denied, then came to me for help. And on their second (my first try) got their visas. No conspiracy, just anticipating what the consulate needs to see in order to believe that a couple merits approval.

      It's always a good practice to take overwhelming proof of relationship because that makes it tough for them to deny, but we weren't allowed this opportunity. I called the consulate, consul replied calmly but as soon as I identified the case, she said "I'm busy" and hung up. Next business day I called and the initially giggly consul told me: "Petition has already been returned. Without petition, there is nothing we can do.

      What I try to explain to my clients and your story bears it out, is that presenting evidences on the day of the interview is often too little, too late. I counsel my clients to do what needs to be done BEFORE we submit. Then I document and present evidences of doing what needed to be done in the Front Loaded Petition I prepare. It is the front loaded petition the consular officer sees BEFORE the interview starts, and by doing a good job in selection and presentation of evidences, sets the tone for a successful interview. I am sorry your cases were denied, without knowing the details of your relationship, evidences etc, I am sure that my methodology would have provided better results. Anyway I hope future couples in similar circumstances learn by your lesson and start with VisaCoach early when I can do the most good for them, versus after denial and the dust has settled.

    hi visa coach, I went to us Embassy for my interview but they didn't tell me if my visa was approved or denied., instead they ask me to send proof of life together with my husband.. what do you think is my visa approve or denied? ?

      Your visa is neither approved or denied. It is pending a decision, awaiting for you to present the missing info. If they find the new evidences satisfactory (along with everything else) your visa should be approved, if you do not provide the evidence, or the evidence is not good enough, or something else is a problem your visa will be denied.     Hi Mr Fred wahl!!! please I need asisst , that I had interview in 1/22/2016 duirng my intreview ,they asked me to bring some Affidavid of support and icome forms from my fiance
    and then got these docs and I put them in Aramex office with my passport, I have been wait for answer I was surprised that they send me same Forms with my passport without knowing the reason of refuse , there is no letter there is nothing make sense my age is 35 years and my fiance is 55 years
    we are still coufused , please help us

      Your fiance should contact the consulate to ask what is going on. If more info is needed you should provide it.     Hello visa coach. I had interview for my immigrant visa August 14 2018 in AUCKLAND New Zealand. Every thing was good. Only about my birth certificate I have my name with out my surname. And I have my passport with my surname. So officer put my case in administrative process. I send them all documents about that and Indian high commission also gave a letter where they write about my both names. Still above 3 months. They didn’t send me any information. What should I do now. Pls help me

    hello.. I was just wondering if anybody had an idea how long it will take to get the visa after the CENOMAR is received. from US embassy.. i passed my interview but my cenomar delay 1 week,, Can you please help me.. God bless

      Its an all too common mistake that DIY couples make by arriving to the interview missing one or more of the required evidences. If the rest of the interview
      goes well, then the consular officer may say "You are approved,pending you submitting the required document". Your case is then left open, waiting
      for you to take action. Once you send the missing item to the consulate, then your case is on Administrative Processing. If lucky your case
      is handled right away, if not lucky you can wait for quite a while. Sorry there is NO standard time for AP. It is a low priority for the consulate.

    Hello visa coach, i'm from Mauritius and i just met with my boyfriend for the first time in london 2 weeks ago, for 3days.. he's from Boston, we have been dating for a little more than a year now. We are thinking of applying for the k1 fiancee visa in a few weeks, so i can get to the US where we plan to get married, are we eligible for that? And also i found out that my country does not process immigration visas and for the interview i will have to travel to the nearest country which does, that is johannesburg, South Africa in my case, and i know there will be a medical examination before that, my question is that where will the medical examination be carried out, in my home country or in South Africa where the interview will be held? Please help. Thank you..

      Significant age difference is one of the major red flags that draw a consular officers attention, scrutiny and sometimes skepticism leading to denial. I usually need to work extra hard with such clients to overcome such red flags. So far I have had great success, even with 40 plus year age difference, combined with a country known as hi risk for visa fraud.

      If you have applied 15 times for non-immigrant visas to the USA and been denied everytime, sorry but its about time for you to realize that you will never be granted a non-immigrant visa. You can resume your married life once your spouse finishes the classes she is taking and returns home. Or should she be eligible for permanent residency, after she becomes a permanent resident she can apply for you for regular immigration.       The consular officer reviews a whole rainbow of factors. Age is only one of them. Without knowing the full story, I have no way of forecasting how the age difference will effect the outcome. No matter what, your chances of success will be improved with my help.

      +olga oliva Absolutely they might deny due to his felony, cause there are some crimes they feel indicate that you could be in danger in case they approve the visa. They might also deny because you "DID NOT KNOW" about the felony, cause it indicates your relationship is not genuine because you don't know much about your fiance's past.

      I do not understand why you say "why do YOU have the us citizen have to list .." Who is the YOU? certainly not me. It sounds like you are trying to fill in the forms yourself and are having a hard time understanding what is needed. Well, that is natures way of showing that you need professional help. Doing this alone is quite risky.     Hi visa coach i have a question my wife having a visa interview hon 11/17/16 but the NVC said i need to send my 2015 tax transcript to my wife but the problem everytime i call the IRS they cant provide me my 2015 transcript , i dont know if my brother sent my tax return to IRS coz my brother is the one who do my tax , is this thing can affect my wife's visa interview?

      If your income was high enough that you are obligated to file, then ONLY presentation of your 2015 tax return, WITH W2, and WITH pay stubs and WITH current letter from your employer will do.

    I was placed in a 221G situation here in Philippines. The consul is asking for proof of realtionship such as remittance slips, chatlogs, etc. I submitted the following:
    Remittance Slips and affidavit of loss for the other slips
    Chat logs
    Philhealth showing that he is my beneficiary
    Social Security showing that he is my beneficiary
    House Acquisition Papers
    Business Ownership Papers
    Spouse Declaration, notarized
    Pictures of my spouse together with my Family because he is living with my Family in US
    Any comments or views if this might work? If this won't, can we re-apply? We might be needing your help this didnt work out well.

      This guy is just trying to get you to hire him. In my experience, No proof of relationship denials mean that visa has been denied for other personal reasons, not because of proof of relationship. American courts have no time for you (doctrine of consular non-reviewability), US attorney will play defense lawyers for the government regardless of how many laws the consulate violates, the State Department treats it's employees like mothers treat their children so it's not you, it's the system.

      Are you saying that your visa was denied?. And you believe it is because you are 35 years younger than your fiance? A significant age difference is a red flag. This means it is a warning to the consular officer and it results in him looking more carefully at your case. When he looks at your case, it is the evidences of your relationship that will convince him to approve or deny. If the evidences are weak he denies, if the evidences are strong he approves. He does not decide either way because of the age difference. I have helped plenty of couples who had a greater age difference get their visas. It is all about what you do, what evidences you create, and how I present them. My signature move of front loading an application is especially critical to success when there are red flags.

      Visa Coach Hi Sir I got my interview yesterday May 9,2018 here in the US embassy Philippines..And he denied me ,Because of our age gap of my fiancé and also I got mental block when he ask me about the immigrant Visa it's same sound to me that I want the immigrant Visa only..And also when he ask about why I need to find husband in dating site ,while I can find it here in the Philippines .Well it's because of mental block I could not even answer him..And when he look up all the evidence that I bring like photos ,itinerary,hotel receipt,chat conversation,video chat,money receipt that sent to me,passport stamp,boarding pass..And the email of fiancé to me..He look up the email and read it ,when he read it,there you go he did not convince the email it's because the email it's like how to say ,I don't know how to describe ,sorry..and he keep asking me a question .I cannot depense or explain about the age gap or answer those question,immigrant visa,dating site oh no it's because I don't know how to answer I remember I answer him ,because I like American men..Then he give it back my folder ,that got photos and etc.Then He told I cannot give you a visa because it's like my fiancé and myself relationship is bone fied.Then he ask me to go to the releasing area and their the woman give it back my passport to me..So sad ,because been waiting for this moment to happen and I want to make my fiancé happy but the result is denied..And I ask the woman whom she give it back my passport if I can apply again the visa or any chances to get another visa ,she said marry and get spousal visa..

      Depends on the culture, depends on your actual ages. If you are now 15 years old its more a problem, then in case you are 60 years old. Anyway ANY significant age difference is a red flag, and in order to be successful with your visa application, you will need to have offsetting proofs or evidences to convince the officer to overlook his suspicions.

      The issue to demonstrate she can not travel, is quite different then the issue to demonstrate your relationship is bona fide. Proving a bona fide relationship takes quite a bit of experience and creativity, especially without an in-person meeting.
