    Today I want to discuss the realities of trying to settle and resolve pretrial, a serious injury personal injury claim, or a wrongful death personal injury claim against the at-fault party's insurance company for a fair amount, fair compensation for top dollar. I cannot stress it enough that the at-fault party's insurance company, whether it's a negligent security case or motor vehicle accident case, or another premises liability case, 99 times out of 100, will not offer a fair and reasonable settlement offer, a fair and reasonable amount if and until Number 1, your personal injury claim is filed in court by means of a lawsuit.
    Number 2, you go entirely through the discovery process. And what do I mean by this? Well, I mean, having a lawyer file lawsuit on your behalf, taking depositions of the key defendant witnesses and the defendants themselves, having your own deposition taken in the case, and having any of the experts in the case, whether it's medical expert doctors, security experts; having all their depositions taken, and also having a document exchange amongst the parties in the case. Again, 99 times out of 100 until all of that is done, until everything that I just described is completed, which may include the injured victim themselves being subject to an independent medical examination by a doctor at the at-fault party's choosing, the insurance company will not offer a fair and reasonable settlement amount in a large injury case.
    And I'm specifically sticking here with catastrophic injuries, lifelong care, a wrongful death case brought by the family members against the at-fault party. This all needs to be done. You and your attorney need to show the insurance company that if you do not get a fair and reasonable settlement before trial, you and your attorney are fully prepared to go in front of a judge or jury and present your case in front of a judge or jury and let them determine the amount.
    The other part of this though is that when you prepare like this for trial, when you do all these things, when you stay aggressive you will get what you are looking for.
    Every single client that I have had wants to settle their case before a trial, and that's my goal too; to get them a fair and reasonable pretrial settlement. You need to go through the steps. You need to get ready for trial or it's simply not gonna happen, or you will get a settlement offer, but it'll be nowhere near what your case is potentially worth.

    Your one damn good fuken attorney I would pay all you would ask for if you were my attorney , when I hear you talk about cases , you know your stuff , I can't find not one attorney to help me I guess it's cause I'm sick , but I'm innocent but hopefully if I get sent to jail I die in jail , thank you have a nice day
