I am not sure what 2nd degree is being referred but in light of discussion with others in town I personally still can't see 2nd degree but since the law says what it does i understand the pursuit. Since it's a one time occurrence I'd think an involuntary would be more likely to be obtained but since there was felony amount.. I'm not sure why the state voted for it in because there's nothing about it that's good. Numerous health studies have found brain atrophy as a result. In the part of the brain for mature decision making. And I'm not sure why we have a law stating felony quantity when there's no such law for alcohol quantity and it has the same effect. I previously wrote some time ago if narcotics were found and felony violence occurred every party should be charged with accessory to the fact and I stand by that. But I was talking about narcotics. I don't think I could render a favorable opinion for that charge in that case but I do see why those in town who are in favor of a prison term see it the way they do. As i wrote before I understand the position the prosecution is in and I don't wish to take or argue sides publicly. But if someone was talking about QT prolongation the jury will ignore my former comments.
