A trespass warning cannot be issued if the person never entered the property. Cops do this all the time mainly to satisfy the owner of the business. A judge should throw out the warning.
I do not think what you wrote is correct, I think a trespass warning can be issued if the person is not on the property. What is the basis for your conclusion otherwise? Some places have a "No trespassing" sign posted at the entrance so that you are warned before you enter the property.
