  • On Monday, Judge Shana Rooks Malone delayed Hannah Payne's murder trial after her defense attorney Matthew Tucker apparently failed to inform the court that he recently suffered a stroke. No definitive trial date has been set. Payne faces murder charges for shooting 62-year-old Kenneth Herring while trying to perform a citizen's arrest, which she claims was in self-defense.

    CLAYTON COUNTY, Ga. - UPDATE: The trial has been postponed after the defendant’s attorney was found in contempt of court.
    The woman accused of shooting and killing a man after a hit-and-run wreck is expected to go on trial on Monday.
    Police said Hannah Payne shot and killed Kenneth Herring at the intersection of Forest Parkway and Riverdale Road in May 2019 after she saw him leaving the scene of a minor accident.
    Prosecutors said Herring may have been having a medical episode at the time of the crash.
    In a previous court appearance, prosecutors said Payne ignored the instructions of 911 dispatchers who told her to stay at the scene of the initial hit-and-run and not to engage the other driver.
    “In the background, you can hear (Payne say), ‘Get out of the car. Get out of the car,’” Clayton police Detective Keon Hayward said in court at the time.
    After the shooting, a witness recorded a video that appears to show Payne changing her clothes before police arrived.

A judge would order the lawyer to show cause why they shouldn't be held in contempt (proof of being admitted) and if unable to provide such a thing in an alloted time frame, then, then you'd hold them in contempt. Also at no point would it be appropriate to talk to the defendant that way

      People who have strokes don't tend to make a lot of sense, since ya know they had blood flow cut off from their brain. Not trying to defend the defender, just trying to bring some rationality to this idea that someone who has had a stroke should be making completely reasonable decisions on what they should be doing.

    @ 0:03:43 -- I'd be interested to know what the Sheriff's Deputy said "Counselor Tucker is..."
    I find it hard to pass judgement with so little information. It's completely possible he had a stroke. It's possible he had a stroke, and is unaware the Court wasn't informed. It's possible the Court _was_ informed, but the judge wasn't. Who knows?
    I'd also have liked to see what happened before this. When did everyone know he wasn't showing up? Who told the judge? What was her initial reaction? Why does she doubt he had a stroke at all, versus his office merely failing to inform her?

      Because she posted bond, and people in the United States are innocent until proven guilty regardless of the circumstances of the case. She might well be convicted but our system doesn't require incarceration until trial unless they are thought to be a flight risk or pose a danger to themselves or others.

      She didn't say he was a liar or talking about his character at all, just that there was no evidence that he had a stroke. Yes, this is implied from being held in contempt and her frustration, but those are not directly disparaging remarks. I'm sure there is an implication that if he were to provide proof of a stroke that kept him from court AND from notifying the court of his absence, then the contempt charge would be dropped.

    She's right, the defendant deserves an attorney who's actually going to show up for her or at the very least inform the state and the judge. Sounds like this lawyer has done this before. If you can inform your client, then you can inform the court too. Regardless of what the defendant may or may not have done, she deserves an attorney who's going to show up, who's professional and works _with_ the court instead of just MIAing, and who's going to actually defend her.

Secondly there could be grounds for a suit against the said attorney. There's actually several avenues that could be explored in this person's comment. Now I'm not speaking about the case that's on the CZcams video. It's very obvious that the judge did her job in this case. But the defendant in the case on the CZcams video could possibly have grounds for a suit against her attorney if it's been proven that the attorney didn't actually have a medical emergency and just lied to the court. Whether or not the court or the attorney denied her due process is still a civil rights violation and since an attorney is an officer of the Court that civil rights violation would still be applicable.     All she needed to do is write down the license plate number of the truck that fled and give the police the info when they get there.....

    I want to stand up for this Attorney's reputation. Matt Tucker represented me in court many years ago and did a great job. He did an Interview with local news station WSB-TV in Atlanta from the hospital and stated that his office emailed the court. I would have liked to have seen the Judge in this scenario have her Clerk call the Lawyers office as a professional courtesy. This is a high level murder trial and her actions just wasted the county resources. The Defense lawyer appears to have a strong case to have this trial moved to another court and then it will have to be restarted at expense to both the county and his client.

      He should be careful - "I’ve had a stroke" is capable of being true or a lie, and should be easily evidenced. If it’s a lie made directly and knowingly to the Court (someone had obviously called and said he’s had a stroke) that’s a straight up 100% route to disbarment - they come down harder on dishonesty than they do many other things. My armchair expert knowledge from these channels and also watching Disbarment/Disciplinary hearings in state Supreme Courts tells me probable disbarment, especially with grievances filed by senior judiciary. The DIU convicted attorneys/ negligence based misconduct usually seems to be easier to defend (getting suspended usually) than dishonesty allegations (disbarment)- for good reason as well.

      @@tikar8982 apparently it was his colleagues that emailed, so if everyone knew then I’m assuming it was the court that dropped the ball and didn’t read their email
