  • A federal jury awarded a mother and two sisters $8.25 million after they were unlawfully searched and handcuffed by Alameda County sheriff's deputies at a Castro Valley Starbucks on their way to taking one of the young women to a college test in Berkeley.

      Right! However the action to take is file an Internal Affairs complaint which is an independent body that oversees police conduct where they interview the cops involved in a deposition videotaped interview to get their story on record, which then stays in their employment file for up to 5 Years and it can effect pay raises or promotions. This incident is the very reason why there needs to be NATIONAL POLICE REFORM!

      I back the blue when they're right. In this case they were blatantly wrong and should be fired and personally sued. This isn't ignorance. They knew that it was illegal to demand ID, detain, and search the car without reasonable cause. Three people sitting in a car outside of Starbucks in the morning is not reasonable suspicion. If the cop saw burglary tools in the car or the women were looking into the windows of other cars, then yes, it's reasonable suspicion. None of that happened.

      It's up to a new policy to be made that separates Internal Affairs from the Police Department. When it comes to issues like this IAD will always have the departments back. Law enforcement cant be disciplined by the people who have the best interest of the law enforcement department as a priority. IAD should be an entity totally separate from law enforcement. 💯

    The simple fact that, despite losing the case, the top brass of that law enforcement agency claims the deputies "did nothing wrong", is a clear indicator of how deep the issues of racism, discrimination and bias are entrenched in that department. To boot, the deputies were also promoted, following the incident, is unconscionable.

Until fees/fines/penalties (need to be % based) sting there will never be a change in behavior! People should go to traffic court w/previous years tax filing. That’s why I believe in a percentage system. You think police won’t clean house? We will never get people to encourage politicians or voters to change. Look how many are career liars & thieves! President Biden went to Congress in ‘77, when I graduated. He never left! How is working out?

    The sad part is the family initially thought the police were there to warn them about the car break-ins, making sure they stayed safe while waiting in the parking lot. 🙄. It kind of sends a secondary message that they are not seen as being worthy of safety; only of being suspicious and profiled.

    My husband was stopped while returning a book to the San Lorenzo public library by the Alameda county sheriff's. It was around seven thirty on a sunday morning. They demanded his driver's license even though he was walking carrying a thin book. I guess the sheriff offiers had never seen a real book next to a library. Also in the early 1990's they shot and murdered an elderly man in my neighborhood for not following orders. We moved away from Alameda county to distance ourselves from these thugs.

      I used to live there because as a young girl with 3 sisters my parents decided to leave Massachusetts and "go west." I had a friend who's father was the head of Oakland's police department, when he thought she had Cannabis in her room he beat her to an inch of her life. He gathered all her friends and the parents (including me) to their house. My friend's face was one black swollen bloody mess from his beatings.
      He didn't find any information about drugs from anyone that day, we were good kids in the last year of high school. Oh how disappointed he was. I was soon a working 18yr old (at the Federal bldg in San Francisco) and left that horror behind me. It still haunts me, POLICE frightened me then, and with daily news of their brutality and incompetence, I see no reason to think of them in a better light. I have never seen anything but brutality, excessive force, and incompetency for many years. There are too many mistakes, there is a "code" they must let go of.
      I cannot abide this way of POLICING IN AMERICA. Something must change.

      Castro Valley is UNINCORPORATED, so the county sheriff patrol the streets. Catilytic theft is not uncommon in Castro Valley, but the woman driver did not look or act like she was a nefarious person. The Sheriffs officer could have simply put his bare hand on the hood of the car to determine the heat " soak " from a car that has been operated for hours. No the sheriff was plainly on a fishing expedition because the driver had a luxury automobile and was black. The jury saw the same.

    I am a former Bay Area resident, have probably visited that Starbucks, and my outrage at this state-funded violence is beyond words.

    It is truly time to address state-funded and sanctioned violence towards ANYONE who is just living their lives, doing NOTHING wrong.

    Same thing happened to me. I was too exhausted and thought I had no chance at justice to pursue the case. They took me to jail for what the police called "giving him a hard time" and falsified reports of "drunk in public and disorderly conduct." Never used a breathalyzer or did a sobriety test. They towed my car and I eventually lost it to the system(auction). I had just bought the car with my hard earned money.

    The police get worse every day.I had a cop tailgating me recently so I pulled over one block from my house and screamed at him. WTF IS WRONG WITH YOU! He drove away! I went straight to the police station to complain and was basically laughed at.I’m currently collecting door bell footage and consulting my attorney.I’m not the type to do this but I’ve had enough

      Something like this happened to me one morning leaving my apartment in El Cerrito,Ca🤦🏽‍♂️I live in what you can call a nice area there's hardly anything going on here but one morning this cop drives by makes eye contact with me and turns around. He then proceeds to drive slow behind me so I stopped and yelled "wtf are you following me for I live here??" he immediately sped off. I seriously think they get a kick out of messing with people and it just so happened that I caught him before he decided to snatch me from behind.

    EVERYONE who gets unfairly/illegally abused by law enforcement agents needs to take action to hold both the officers, the city, and the county, accountable. Unfortunately its often extremely difficult to find an attorney willing to represent clients in any suit filed against regional government entities - especially with regard to clients who can't afford upfront payment, and therefore need to find an attorney to represent them based on a contingency agreement. Hopefully the increasing number of plaintiff victories, combined with high dollar awards, will help change this. I am very grateful to the woman in this video for having the courage, the strength, and the will, to stand up for herself - and to take the fight all the way to victory. That could not have been an easy thing to accomplish.

      @@restrainingorder7301 Remember the Judge can (and may even by law be required to) lower the payout amount regardless of what the jury said. Can be expensive to file a case against even local govts. And not sure if filing a complaint with DOJ would create more than a "don't do this type reprimand from the fed DOJ. That's really not much incentive for local govts to change their ways. However, since no one was actually killed here, I also would think that the federal judge will substantially lower the amount.
      NOTE: Breona Taylor's family received $12M and she is DEAD. So $8M with no permanent physical injuries seems a bit excessive. I'm not saying the the officers (and their training supervisors) shouldn't be penalized. In fact, somehow this needs to be tied to their performance reports. Crazy that the news reporter said some of them are being PROMOTED.
      ALSO: I know someone who was unfairly harassed by the police due to color. Like the lawyer said: on a mental / psychological level it messes with the person for life. When past police abuse victim is pulled over for something relatively mundane (eg - speeding ticket) it can become scary for them and even dangerous. Again read about Breona Taylor and her reactions - which were misinterpreted by the arresting officer and thus led to him worsening / escalating what should have been a non-violent ticket type situation.

      @Jake McClendon Thanks for posting this. I didn't read it fully till after I posted to @Restraining Order. If you read what I posted it tends to reinforce what I was saying: being harassed tends to create PTSD type issues.
      New research links earlier deaths / higher infant mortality deaths with African-American women as related to such repeated societal stresses / "micro-agressions".
      By sharing your experience your helping solve the problem by creating awareness.
      At the same time, be careful. First unless you have physical injuries most juries still don't believe they have enough evidence (or jury instruction laws) to find in favor of a plaintiff. Second, I've seen such cases FAIL. No one talks about or posts about these and the losses the victims / attorneys suffer.
      Also, if you look on youtube you can ALSO find white males wrongly shot dead by police. Only 1/3rd of police seem drawn to the profession "to serve" society. 1/3rd seem drawn "for the power" (and we know that power corrupts). And 1/3rd want to stay neutral ("see no evil, speak no evil, hear no evil" and/or not be drawn into police abuse issues) and just go home and then retire on a pension. Probably like many of your co-workers at almost any job. What's cool is that I've seen more and more officers (of all colors) try to hold their fellow officers accountable. If you look up the stats, you'll be AMAZED. There are many officers who now turn in other officers (and unfortunately are at SERIOUS RISK of losing their jobs for doing this... Google it!).
      Regardless of color, if the family has little or no MONEY or luck finding a lawyer they may eventually still LOSE (remember these news stories do NOT sensationalize the boring APPEAL BATTLE that can cost MORE than the trial!). If the government appeals that may cost a LOT of money / time that neither the "trial attorney" or the family has. So possibly this will be negotiated to even less than $1M settlement. Then deduct lawyers fees, costs, etc.
      If you really want a chance to stop police brutality, INVEST. Train and join the police force yourself.
      Or challenge you and some friends to each buy at least 2 car cameras and leave them running in your cars. Also, set up a protocol where you text someone your location if police pull you over. Have a buddy system where your friends will try to drop everything and film what's happening.
      Depending on where you live and how uneducated the police are, no matter what color you are, you may catch some good footage. Hopefully you (or your family) can put it use to bring justice, and help improve police professionalism.

      @@tubsun The judge better lower this amount. She is 100% in the right to get award damages for this case, but people are are beat and tasered are lucky to see a few hundred thousand. Look at the deaf guy who just got beat and tasered because he couldn't hear them (he's deaf). I bet he will be lucky to see a million dollars, and that is much worse than having handcuffs placed on you. Look at the guy who was arrested for driving a stolen car that was a hertz rental and spent 6 months in jail awaiting trail, lost his car, his house, his job, everything. Bet that guy won't even see 1 million dollars. She deserves 100k per victim, so 300k total in my opinion from looking at other cases.

I don't own an insurance company, nor am I an agent, but if I were I wouldn't want the liability. If they personally have to feel the financial heat, they will stop, IMO.

However, it is absolutely true in general what Eothee is saying. The reason being is that service members are held to a higher standard and have a lot to lose. It can bring an end to their career, it can limit promotion, reduction in rank/pay and you can end up in the brig. That goes for the individual and those in their chain of command. It's called accountability.

This reminds me of the group of Black women and children arrested and made to lie on the ground in Aurora Colorado by the police.... no crime committed... just because...

      We've all been abused by the police. IMO, this award amount is grossly unjustified. People are beat up and tasered in their own homes for doing nothing, and are lucky to get 100k. The idea of 8 million for the inconvenience of hand cuffs and the back of a police car is insane. Maybe 1 million at best, I think more like 300k. She wasn't beat or tackled or tasered or anything. And legally, the cop could ask for her id because she parked in a handicap spot. Read the paperwork at the dmv you signed to get that plaque. It clearly states cops may ask for you to prove it's yours if your using it, which involves IDing the person. She deserves money, no doubt t was racial profiling, but this amount is insane imo. A lot more people are going to try to bait the cops with awards like this to try to get their own lawsuit settlements.
