Librous Oshioma spoke well as a respected Lawyer. Those pro fubara state lawmakers are real jokers. How can four members with emergency executive order be making laws for a state ? Fubara as a governor trying to be four law makers at thesame time.
Where are the sepration of power.
Interim order can not declare seats of those members who decamped as vacants ,only the legally appointed speaker can do that. Besides, interim order can only existed for a week which after a week the order becomes stale. Fubara might be impeached because he has allowed the Igbos and Labour party supporters including Former governor Wike enemies to push him to political precipice. We shall see how it all works....
Nothing hurts more than ingratitude. But I will still blame Wike for everything. In choosing a candidate, don’t always pick someone you can control. Rather pick someone that is qualified and knows the job. And don’t expect anything after your exit. Mr Liborous Oshima, with due respect, i always admire your legal elaborations of problems from afar Nigeria and today my disappointment of your views on Rivers state problems between assembly members and governor. The constitution states that the moment any elected member defect to another party has automatically rendered his or her sit vacant.

That is not what constitution says , speaker or the court need to declare those sit vacant before they are vacant. We change the constitution to reflect your interest , i hope your interest won’t change tommorow. The man is trying to balance his views but you want something that will align with your interests
You need to understand this. In as much as the constitution is clear on it, the speaker is the only person that has the power to declare their seats vacant. The question then becomes, who is the current speaker? Remember, the SO-CALLED members sitting in the government house now have been suspended since October last year.
Also, the members who have been asked to stop parading themselves as members (due to an interim order that only lasts 7days) can also pursue the matter to the Supreme Court, even though it has been decided in some cases. So, let’s put things in perspective before attacking commentators.
NB: NO LAW IS AUTOMATIC. That the constitution says a person that kills must be killed is not automatic. You still need to convince the court beyond reasonable doubt.
Wike should let Rivers State have peace by letting Fubara do his job as governor. Why are the senators making trouble, they already resigned their posts to become APC.

Oshioma's statement is the one borne out of political ignorance . The president peace intervention was partial and one sided in his attempt to please Wike against a sitting governor Fubara. The 27 decamped members to APC will have to fight their ways to the highest court of the land to finally justify their positions. They shot themselves in the foot by decamping in the heat of a political conflicts without using their brains.
It is not for Oshioma to determine that if the 27 remsins legal or illegal. This matter has passed the elders of rivers state. It has to be determined by Supreme court. Oshioma is talking rubbish here. He has no points to make it is just rattling and rambling.

Don't be quick to blame Oshioma, I think he has always been factual in his analyses of River State. If you listen to him without any emotion, you get his point clearly. I will refer you back to the Abegunde Abena case, he remained a legislative until his seat was declared vacant. It's also similar to when the court sacks a governor, he has the right to appeal, and he will remain in power until the final court of the land (supreme court) removes him.
In my opinion, I think Fubara was too quick to act, you do not have the majority of LG chairmen, a majority of the House of Assembly, and you want to fight. Not even the party-state and local government executives!!! What stopped him from waiting to conduct the LG election, and party excos election, which is due this year, strategically fractured the house to gain some members by using those 5 members as a proxy. As it stands, it will be a very difficult battle for him to win. Don't forget that if the state becomes too hot, state of emergency will be declared.
