    Another V5 issue, highlighted in an excellent video by Scottish Car Clan, is in relation to log book loans; they had bought a car, HPI clear, received the then sold it on 6 months later.
    The next buyer went to trade the car in and it was now coming up as having a logbook loan against it.
    The first seller had applied for duplicate V5 gave the’”lost” one to the SCC guy, then having retained the current V5 simply applied for a loan against the car *after* he had sold it…

      If the guy had evidence he bought the car before the loan was granted this is classed as fraud and the loan would be removed against the car
      Or personally I've had them before and just stripped the car or buy an accident damaged one and swap everything over just to get some money back 👌

      @@XBMCXBOX I’ve no idea what the outcome eventually was, however chances are the finance company would repossess the car and then you’d have to fight to get it back. The law up here is slightly different, whereas down south the finance company would be able to seize the car from the innocent new owner, up here as long as you can prove the car was bought in good faith at a fair price then they can’t take it back, unless you’re a trader…

      @@Graham-rc1cp If you sell a car then it's no longer yours and in that light the V5C is *not* proof of ownership but regardless the finance company should have checked the registered keeper first. If the car was sold to and registered by the new owner _and then_ a loan was taken out then well, that's too bad for the finance company. They can only repossesses the car with a court order and although it can happen (I've seen it) if they repo' a car and it then transpires that they don't actually have a legal interest in the vehicle then compensation is payable and can be quite a bit.
      But yes, the law in Scotland around car finance is pretty good and correctly places the legal burden on the finance company, rather than protecting them from their own possibly intentional ignorance.
      *TL;DR:* So long as the new owner had a dated bill of sale from the previous legitimate owner, had registered the vehicle in his name and the finance was taken out _afterwards_ then it's not the new owner's problem.

      I always take a cordless angle grinder and 6 discs when I'm visiting England. It's quite satisfying cutting off unwanted attachments , just cut a link out the chain , not the lock . Then send a postal order to pay "pro rata" for 1 chain link. Usually £2.50 maximum.

    Another good tip not very well known is if a vehicle has been taxed whilst in trade in full, not by direct debit and then sold to a private person afterwards, the remaining tax stays on the vehicle. We've done this many times when using a car as a run about. Usually only a £20 or £35 tax car but we can't then claim back the tax so the new keeper might as well benefit from it and not pay the government twice.

    About the tax / direct debit one (brilliantly cheeky btw if you just need to move something for a few days!): if you cancel the DD, do you then need to make sure you SORN it? Or does that happen automatically?

    Let me give another slant to the yellow section. I traded a car. The dealer said he did the yellow section whilst I was there. 6 weeks later I got a speeding ticket. He hadn’t completed it. Always do it yourself!

    It only tells you if its CAT S on log book. CAT N is not listed on logbook

      @Mark--- yes. 15 years ago it didn't say anything and 20 years before that it was the reg plate that was recorded so of changed plates it wasn't recorded. Go figure lol

    Something i never came across, saw and bought motorbike from Northern Ireland. Came originally from England but disappears off DVLA when it went to NI. I did vehicle check wasn't on DVLA. I thought odd. Called DVLA, they said yes it was correct, will come back on the Wales England register when i send in the new keeper form my address in England.

    Done the tax dodging loads of times. You have about two weeks before you get a letter from them. Then another week before you get a threatening letter. Soon it before that second letter. Leave it for two weeks without use. Then tax again for the following month. Then repeat.

    Never realised about using trade when occasionally buying and selling cars I always put them in my own name then having to tax etc. I will keep this in mind on my next acquisition

      Only works with a traders policy. Otherwise you can't tax it unless in your name.

    As a new trader I have a question. When buying a car in trade and been given the V5 by the trader with all the supporting documentation. When I sell that car and follow the instruction on the DVLA website for 'change of ownership' isn't it going to ask for the original dealers details who first put the car into trade? So I guess my question is, if that car has gone through a couple of traders beforehand how will I know the original dealers contact details for the DVLA change of ownership website? And do customers ask questions when you are on the DVLA site in front of them but not inputting your dealer details (if you have them)? Hope I've explained that correctly?

    I put one into trade over a month ago then last week got a letter from dvla saying I was caught on a tax camera for driving an untaxed vehicle although it was in the trade and had trade plate on the windscreen

    What do you if you buy a car from auction and you do not get the v5 number, I have been putting these cars in my personal name is this wrong or should I do something else

      Either that or do a V62 in the customers name when you sell it, you don't add an unnecessary extra owner that way

    Prices on that carwow auction are insane😂I prefer to source vehicles myself on eBay it’s more of a headache but we are slightly different than most in that we buy and repair from cat s and n to engine failure so we aren’t looking for clean. Still, absolutely overpriced no wonder some dealers are pricing their stock so high they are paying too much. We buy a lot from copart and synetic too.

    Question ... how long does it take to get a new number plate? My car was registered new with a private plate, and upon buying the car I put my private plate on. When I eventually sell my car and put my private plate on retention how long will I have to wait to get a new (unissued) registration? Cheers 🖖

      If you do it online it'll be immediate! And it'll usually be the vehicles original VRM so your old plates should be fine. Remember to tell your insurers...

    Car has private plate and looking to sell the car and retain the plate. Don’t want to remove the plate in case car doesn’t sell though. Will I have to wait for new v5 beforehand I can sell the car?

      Be careful as soon as you sell it and buyer puts it in his name, maybe on line the minute he pays you've lost the number.

    I just bought a car from an insurance company and need to tax my car. I have sent off the v62 form 3 days ago and pick the car up I 2 days. DVLA says I cannot tax the car as it is not in my name yet. Not sure if a post office will be able to help unless I send a 2nd v62 form away I do have photos and receipts of the first v62 form

    l was at a BMW main dealers to buy a thirty grand plus four series and the dealer wouldn't let me touch the V5 because of GDPR and he had his fingers over the previous keepers address and expected me to see what l wanted from the other side of the desk

    Great videos mate and following you religiously now! I'm a new trader with a limited company. How do I get a V5 for a car being sold at auction without one? Aston Barclay has cars I'm interested in but are being sold without a V5. How do I get a V5 so that I can sell the car on without adding my personal details and adding a new keeper? If that makes sense? Cheers

      You can't but what we do in that case is fill out a V62 with new owner details, (your buyer) write the dvla a cheque or postal order for £25 and let the owner tax it at the post office before collection or do it for them (just charge them the tax amount)

      car needs to be in Trade to tax on a V62, if not in trade you need the last keepers postcode, here's another tip, if you want to tax a car as a new keeper and have v5c but green slip is missing simply put a number (such as 3) in front of the doc reference number from the v5c and it will tax online as a new keeper, select you have the green slip when taxing

    I have a question, if I am a limited company without motor trade insurance, Can I transfer the vehicle to trade? And what should I do if I need to drive the car back to my home for 3 hours, should I insurance and tax the car?

      If you're buying it with the intention of selling it then yes you can put it into trade but yes you will still need tax and insurance

    My 4x4 had 2 keepers when I sent the V5 off, came back saying 5.
    DVLA wouldn't admit they have made a mistake.
    100% they messed up.
    They just say it's data protection and nothing can be done.

    There is a difference between Keeper and Owner.... The v5 is only concerned with the current keeper. Identifying the owner is a far more complicated problem... lol
    Also, opening a letter that is not addressed to you leaves you subject to criminal prosecution, as does failing to notify the DVLA where a change of keeper has occurred.. Your method of cherished plate retention is encouraging people to commit a criminal offence, so you know...

      Ridiculously, yes (unless it's SORN)!
      The law says that you must normally have at least third party motor insurance if you drive or own a vehicle. You must also have insurance if you leave it parked on the street, on your driveway or in your garage.
      You don't need motor insurance if:
      you have a valid Statutory Off Road Notification (SORN)
      your vehicle has been kept off a public road since before 1 February 1998
      your vehicle has been scrapped, stolen or exported and you have given notice of this
      your vehicle is between dealers or is being held in stock by an authorised dealer.

    Just had my first customer who was not happy with the car because the fog lights are not working. I offered to fix it for them or a full refund. They said refund lol. The log book has been sent of in there name already.. should I send the refund with out getting the v5 first?

    I have an ongoing issue with the V5 from the car I part exchanged with a dealer against a newer car. As the car was over 3 years old they sent it to Auction. Whoever bought it has not completed the V5, and it is still showing as Trade. I have had two speeding tickets for it. I have contacted Speed Enforcement, and they say until the V5 is completed the Speeding Tickets etc will go to the Last Registered Keeper; which is me! Very Annoying!

      I have contacted the DVLA, and they have sent me a covering letter stating I am no longer the owner of the vehicle. I wish I knew who had purchased it. I have contacted the Auction Company. They know who bought it, but cannot pass on the information to me. This has been going on for two years. I have been back to the dealership as they have to receive the Speeding Tickets from me to then send to the Auction Company to return to Speed Enforcement.

      @@paulfrowde4145 oh dear bud, problem is if you did a letter dated later than the speeding fines your on the hook, only way round it is actually apply to court to sign a statutory declaration in front of a judge and that overrides every thing, I've done that couple of times, I always put the customers car directly into trade on line in front of them so their liability is off St away, I've had buyers copping for tickets as soon as they drive off.

      I kept all the data from the first week before shutting it down
      Once bitten etc, and I am just a private owner

    Handy for trade to know and Your disabled customers, who claim PIP. If you qualify for PIP and have 12 points for mobility issues you can claim 100% car tax free one one car. If you sell or change your car with disabled £0 tax. It has to be taken off £0 disabled tax. If you have PIP and you know you are going to change your car apply for an upto date Certificate of entitlement to personal independence payment serial number. Buyer has to take this to the post office with the log book to register the car as £0 disabled this can not be done online for the first tax. After 1st time the car can be taxed online until you sell it or scrap it. i for got this and am setting her with a new car to me waiting for this letter to tax my new car. i have insurance for it.

    Hi great channel been subscribed for a few months now. I'm looking for a cheap place to get my first trade insurance do you know of any places ? . Iv had 5 quotes now all for over £2200 and Iv got 14 years now claims on my standard car insurance 😢 ouch. Any info would be appreciated.

      I use tradesure in Birmingham, but I doubt you'll get it cheaper, my son had a quote of 4k the other day.

      You'll have to show trade insurance, so probably no, Aston barclay accept private buyers with 500 deposit and 2 forms of id, you'll be on high buyers rates tho.

    7:59 Except you (the seller) can be fined up to £1000 for this, the driver is also breaking the rules.
    The owner would also need 'non owner' insurance for a car not registered to them.
    If they did have an accident in the first week and the insurance was deemed invalid because of the sellers actions it could come back to bite you.
    See the following- The Vehicle Excise and Registration Act 1994 (as amended)
    Offence of using an incorrectly registered vehicle
    (1)A person is guilty of an offence if, on a public road or in a public place, he uses a vehicle to which subsection (2) applies and in respect of which-
    (a)the name and address of the keeper are not recorded in the register.....A person guilty of an offence under this section is liable on summary conviction to a fine not exceeding level 3 on the standard scale.
    I've known traders to keep the v5 for months until the warranty expires.

      I think you’re taking things a bit too literally there! The sales receipt is the proof of ownership. It literally says on the V5 ‘this document is not proof of ownership’ 👍

      @@Jinxer121 This is very interesting. Are you a trader, or you have a car that just was not registered with the new keeper by one reason or another?
      It tells for me that putting a car into trade means the trader is the real owner, not just a keeper, and the car is not registered with DVLA and it is not a subject to legislation. No need for tax, councils can not search the car in DVLA Database for parking fines. I bet you can also beat ULEZ and other CAZ in other cities. Did you ever tried? It is covered by trader's insurance.
      How easy is to become a trader?

      @@dmitrikhmelevski9214 I have trade insurance and haven't been into a ulez zone. I have been in hospital parking lots of times but don't go out of my way to get tickets.

      @@ShiftingMetal It's probably a law that isn't well known in the trade. The law and insurance both tend to take things literally!
      I know when I have filled in online insurance quotes I have to tick the box to say that I am the 'Registered keeper', after all it could be owned by the finance company.
