Es scheint, dass im Voraus vereinbart wurde, dass Joost nicht unmittelbar nach seinem Auftritt gefilmt wird. Der Grund liegt darin, dass er sich im letzten Teil des Liedes auf seine verstorbenen Eltern bezieht und diesen Teil unbedingt mit Gefühl singen möchte. Er ist auch sehr emotional, nachdem er dieses Stück gesungen hat. Dieser Aufforderung kam die Kamerafrau nicht nach. Was er wirklich getan hat, ist noch unbekannt. Merkwürdig finde ich, dass die EBU keine eindeutige Anklage vorlegt, es müssen Beweise vorliegen (Aufnahmen der Kamerafrau).
Well said , tho in previous rehearsals this also happed against all the agreements ( not requests like you said) about not being allowed to film there. Joost was very emotional (crying) after his song in honor of his demiced parents, everytime he has performed Europapa he relives his loss. He was on his way to the greenroom and had not much time to get there (3 minutes) and in the meantime to settle down and regain to a more relaxed state of mind again. You might be able to understand the stress alone of performing is very high, if not just look at what f.e. Bamby thug said about this, she was very very angry at the organisers on that topic. But ... Joost asked this (sorry I'm mad and I'm Dutch) camera horror B.... 3 times not to film him, she shunted him and ignored this as had happened multiple times against the agreements about this, he then was typically Dutch blunt but that is to be expected (if somebody disrespect you so much they make you angry, so its logical you become angry, its not the other way around) when made angry, thus that's not even worth a slap on the wrist for. Its totally disrespectfull, what the ESC/ EBU did, they broke all the agreements multiple times on previous occasions as well, and not only with Joost.
They (ESC/EBU) where/ are in the wrong, they proved to have little respect ""They broke their own codes, o,o, oooh!""
Nemo said something like this about it in his press conference ""I broke the trophy it should be fixed, the ESC/EBU is also broken and needs fixing too.""
And Israel, that's a whole other can of worms the EBU/ ESC did to show little respect/ regards for/to their own rules and regulations, and broke that code as well.
In Joost I trust, I'm so proud of that lovely weirdo, Joost I love you!

Warum hat man ihn nicht auftreten lassen? Eine Disqualifikation wäre auch im.Nachhinein jederzeit möglich, wenn gerechtfertigt.
Diese Disqualifikation hat diese extreme und absehbare Unruhe bei diesem ESC weiter verstärkt. Ein Mediator bzw. Streitschlichter hätte bestimmt anders gehandelt.
Ich hoffe, dass die Öffentlichkeit informiert wird und Journalisten und andere an der Sache dranbleiben.
The AVRO/TROS and the NPO ceo really tried, Friday night it looked good, and it seemed to have became a non problem. But then Saturday the EBU dropped an unexpected bomb and dsq-ed Joost. The justice system in Sweden is much stricter (I'm told by those who live and lived there) than most outsiders know/ realise, if someone feels threatened by someone and that is very ""subjective"" you can run into troubles with the law there. One can have really rude remarks coming their way and turn away rub it of, and don't take it serious. But another have a tender soul or a nasty agenda and perceives that as threatning and can get you into serious troubles with Swedish law. Sweden is very different in that respect, than compared with most other countries. I found that out because of this incident. A reason never to go to Sweden for me, Im to Dutch-blunt, -honest and do not sugarcoat or beat around the bush either, I'd be probs jailed there in no time. LOL

Is it a freak show, yes it has became that. But IMHO it shouldn't have became this.
Dressed up female performers and hetero sexual males and females, hmm they have a big disadvantage and nearly without a chance to win.
Im very open minded and have nothing against the LBGQ(RSUVYTXYZACDEFHIJKMNOP) gender things, but wow the issue is it became more important than it should have. Live and let live, do what you do, be who you are as long as you don't do any harm or cause unequalness with it, but sadly it has been completely blown out of proportion and has caused more problems than it solved IMHO.

in a interview (telegraaf) the head of the dutch delegation said: "I can't say anything" and gave the camera a headbutt, hint? Joost in an interview said he might be on the spectrum and I am too, the reason he did not wanted to be filmed at that time is very reasonable to ask and they violated that. Even then he asked several times and they did not stop. Participating in such a massive event is a lot to process for someone on the spectrum, he needed to be left alone at that moment and they violated his request, is to deny a blind person to use a dog to get around, no pets allowed.
Moroccannoil, the main sponsor of the European songfestival, is an Israeli company. Joost was outing criticism about Israels participation in clever ways that could not get him disqualified. Could it be a reason they were looking for an excuse to cancel him? There were other delegations that outed criticism, but none of them was as popular and high in the rankings as Joost.
Hmm you could be on the right track, it seems to but is/was it really a ""set-up"". Don't ask me, that turd is to hot for my liking. And obviously speculations are not facts, we need the facts.

Wahrscheinlich hat Joost im Vorfeld zuviel Kritik an der EBU geäußert, er war also einfach zu "frech". So jemand "darf" natürlich nicht gewinnen. Es zeichnete sich nämlich auch bereits klar ein Finalsieg ab.
Ich fand es absolut unverhältnismäßig, Joost wegen des Vorfalles mit der Kamerafrau auszuschließen. Es wurde ja auch niemand dabei verletzt und man hätte die Wogen sicher schnell glätten können.
Wenn in jüngerer Vergangenheit jemand hätte disqualifiziert werden müssen, wäre das die Ukraine 2022 gewesen, da die eindeutig rein politisch auserkorenen "Gewinner" mit ausgestrecktem Arm und entsprechender Parole von der Bühne gingen, das kann gern im Netz recherchiert werden. Doch da geschah unbegreiflicherweise - nichts.

Ich fand es nicht Ok...die Kamerafrau hat schliesslich den Wunsch ihn nicht zu filmen, übertreten. Joost Klein hatte es aber ausdrücklich gesagt, also musste sie mit einer Reaktion hier rechnen. Im NL TV habe ich aber gesehen, dass hier keinerlei körpelichen Kontakte stattfand und nichtmal eine Anzeige vorliegt? Warum dann dieser Ausschluss? Ein ganzes Land hat sich hier ein Jahr darauf vorbereitet, dass ganze hat Millionen gekostet, Es sollte in NL auch übetrall Public Viewing geben, dass wurde jetzt alles gekanzelt (ein riesen Verlust für dieses Land).
Deshalb auch der Gedanke mit dem Schadenersatzanspruch...

Not everything was canceled, oh no! There where big parties planned and less than expected showed up, that is true. But in the history of the ESC this years ESC Dutch tv viewers topped all viewers number as any other ESC.
We hold our heads up high, we Dutch i.g. support Joost and we are proud of that lovely weirdo, I love the guy. Many parodies are made to scove the EBU and oh that's not only juistivied, it so funny too.

Hat aber nicht die Kamerafrau den ersten Übergriff begannen? Filmen ohne Genehmigung und dann einfach weiterfilmen ohne Erlaubnis...So gesehen ist sie doch der Täter, oder nicht?
@@dcdeborah_ Nobody attacked anyone. There has been no contact, there were supposedly/ alledgedly some harsh words and gestures. All kinds of artist had complained about her filming during the rehearsals etc. the EBU and some artists agreed to that there would be no filming them anymore by her or in that zone at all, it was an very anoying situation she forced upon stressed out emotional artists as anyone can imagine.
Swedish law is different to Dutch law, I don't know how German law is in these kinds of cases. In Sweden (I'm asured by ppl who say they know), if anyone there feels being threatened they can get the other into problems with the Swedish law.
I'm not a lawyer, but imho I feel like it seems that she is the perpetrtator/ culprit but plays the victim. We can but only guess how Swedisch justice will handle/ judge this, we have to wait what will come from it.
Anywho, IMHO it seems to be nothing more then ""a storm in a glass of water"" nothing very serious took place, IMHO (by what we know thus far) things were completely taken out of context by that woman.
If it would really be as bad as the EBU wants us to believe the camera footage would already been showed, was the footage lost/ destroyed by the camera breaking or perhaps even deleted, or will it only show up in a court case if at all there will be any?! Your guess is as good as mine.
But I know very well that cameras/ cell phones and such electric devices can seem to be broken (almost) completely, and yet still the data of it can be retrieved from it in the fast mayoritry of cases.
Anyone who knows a little of (micro) electronics will know this very well, OEM''s don't want to admit that i.g.
I have studied electronics in my younger years, most OEM's don''t want the public to know that most of the time their devices can be repaired/ data can be retrieved. Most OEM''s are untrustworthy, to say it mildly.

The fact that we are all talking about this without knowing the facts proves one thing: EBU acted unacceptably from a judicial point of view- and I fear intentionally. There are only two known facts: 1 a complaint was filed and led to an investigation 2 that fact alone was grounds for for DQ.
Whether or not this complaint has grounds is unknown and even irrelevant. The decision to suspend was made on the sole ground of an ongoing investigation. But after that suspension there was no realistic way back. DQ was inevitable: otherwise EBU had caused an irreparable disadvantage. Suspension influences jury results. And withdrawing a suspension would have meant the EBU admitted a mistake. Losing face. So fact is that Joost is DQed on the grounds of an investigation. So much for innocent until proven guilty.
Could EBU have done something else? Of course: the right thing to do would be to let him perform in rehearsals and even the final until something solid enough to justify DQ could be made public. Even after the final. Or were they afraid he might win? Dq after that would indeed be painful.
There still is nothing solid enough to publicly justify DQ. Yeah, zero tolerance. Zero tolerance of what? Even that question has not been answered. There are stories, no facts.
So, what is really going on? The mighty EBU wanted to make clear that nobody messes with them - and Joost of course did irritate them. All week. That is what he got punished for. Who ordered this camerawoman to try and film him backstage, immediately after performing? For the third time? After agreements that he was not to be filmed at that moment? Let me guess: EBU? Yes, Joost irritated and provoked EBU. But that is the sole reason they wanted to find a way to dq him. With some provoking of their own.
All evidence must be laid on the table. Then all hearings should be in a Public International Court!
The Swedish organisation should have changed the camera woman the moment it was clear that she was egging Joost on. Instead they let her further provoke Joost out of the contest. Sweden fucked up. Bigly

1. You are not a lawyer. I am. Lawyers always look at the SCOPE of a text. The scope of the text that you give us is clearly limited to the lyrics and or performance of the songs. An artist can not be disqualified on the basis of this article for what he/she does off stage.
2. Joost Klein had a specification in his contract with the Festival, that he would NOT be filmed when he was going off stage. This woman had done so before and was warned then. This time she did it again. Klein warned her three times to stop it - she aggressively kept stalking him, against the contract. Then Klein made clear move against her -NOT touching her. Afterwards she says she felt threatened, while in fact she threatened him. The camera woman should be prosecuted for her stalking.

However, this is an infotainment channel. As a lawyer you however are rushing too fast to disqualify me as a lawyer, but it's ok, because as I said this is an infotainment channel and I don't claim to give a legal expertise as an attorney.

In a court of law. Not in EBU's kangaroo court that is prosecuter, judge, jury and executioner all at once. Especially if the allegations come from a Eurovision employee harrassing a singer against all prior agreements.

Ich meine der deutsche Kommentator hat gesagt dass Zorra zwei Bedeutungen: Füchsin und eben die Beleidigung. Deswegen konnte man das noch akzeptieren
@@lucky4luke Nur das halt niemand an das Wort Füchsin gedacht hat. Er hat nämlich auch gesagt, dass man das auf gar keinen Fall jemals zu einer Einheimischen sagen sollte. Und auch kein einziger Muttersprachler wird daran gedacht haben. Die EBU und ihre Doppelmoral: so unglaublich sichtbar dieses Jahr. Israel war nicht der einzige Fall.

Wenn man Joosts bewegende Geschichte kennt, den Hintergrund seiner Widmung am Ende des Songs versteht und das Versprechen, das er seinem Vater gegeben hat, eines Tages auf der ESC-Bühne zu stehen, dann versteht man besser, warum er nach seiner Performance um Privatsphäre gebeten hat.
Im Video von Joosts Auftritt kann man deutlich sehen und hören, wie er fast in Tränen ausbricht, als er die Widmung an seinen Vater spricht. Dieser Moment zeigt nicht nur, wie verletzlich er in dieser Situation ist, sondern auch, wie wichtig die Teilnahme für ihn persönlich ist.
Die eigentliche Schuld liegt bei der Person, die seinen ausdrücklichen Wunsch ignoriert und weitergefilmt hat, seine persönlichen Grenzen verletzend. Es wurde schließlich vorher besprocohen, dass er nach seinem Auftritt nicht gefilmt werden möchte. So ein Ignorieren seines emotionalen Zustands ist wirklich unfair. Diese Person sollte vom ESC ausgeschlossen werden, nicht Joost.
Es wäre fair, wenn der ESC eine Wiederholung des Finales in Betracht ziehen würde, um Joost die Chance zu geben, die ihm zusteht, ohne dass er für seine Reaktion auf die Verletzung seiner Privatsphäre bestraft wird. Das würde nicht nur seine Performance ehren, sondern auch das Versprechen an seinen Vater, und die menschlichen Aspekte betonen, die in Wettbewerbssituationen oft vernachlässigt werden. Dann braucht man nur noch eine neue Siegertrophäe, damit er nicht die in Empfang nehmen muss, die Nemo bereits kaputt gemacht hat.
Ne wiederholung ist nicht realistisch, aber sofern die bisherige schilderung stimmt,wär ich für eine automatische qualifizierung für das nächste finale.

Was ich bei der EBU kritisiere, ist die extrem schlechte Kommunikation.
In der ESC Bubble herrscht so viel Unruhe, dass die EBU gut beraten wäre, endlich eine inhaltsreiche Stellungsnahme abzugeben.
Mir tun insbesondere alle KünstlerInnen Leid.
Es bleibt ein sehr faler Beigeschmack.
Ich find's fragwürdig jemanden so kurz vorm Finale zu disqualifizieren. Vorallem weil nicht mal was schlimmes vorgefallen ist und die Kamerafrau, Keren Peles, kommt aus der israelischen Delegation was ein Zufall.
Does that apply if there was an agreement not to film? Does it mean that the performance is over?
Also next; the camera person was an employee of the organisation, doesn't this put her in a position of power?
Third: I saw reports that this wasn't the first altercation with the same camera woman; if so, and if there was an agreement not to film, can they claim harassment?
Fourth: what does the EBU rules say about problem resolution?

Und was bringen da die rechtlichen Hintergründe? Ich meine, selbst wenn sich herausstellt, dass er nicht s getan hat, kann er ja wohl kaum die Wiederholung der Veranstaltung einklagen, oder? Dagegen ist man doch mit Sicherheit abgesichert.
Das ist dann Pech bzw. das Risiko des Lebens. Und wie sollte er den ESC verklagen, wenn der ESC die Anzeige gar nicht erstattet hat.

Nur beantwortet das die Frage, die ich gestellt habe nicht, was bringt es rechtliche Hintergründe zu kennen, wenn der ESC sich doch bestimmt dagegen absichert in Verträgen? Damit ist das Video doch eigentlich obsolet?
@@maddin9703 Ja, das Video ist vielleicht ein bisschen clickbait, das könnte ich mir auch vorstellen.
Ich denke es geht dabei viel um Ruf. Wenn du rechtlich aufzeigen kannst, dass eine Disqualifizierung nicht legitim war, wird das medial aufbereitet. Die meisten internationalen Medienhäuser werden nur die große Disqualifizierung und teilweise auch reißerische Schlagzeilen geteilt haben. Unter anderem standen ja auch in Deutschland viele vermeintlichen Falschaussagen in den Berichten (gewalttätig, sexueller Übergriff etc).
Ja ist doch klar das man lieber jemanden nimmt das besser ins narrativ passt

But there where bystanders who saw everyhting happened (according to Media), so i will hope they came to disqualification on basis of very good research from their part.
But i think that joost made some comments towards the EBU on multiple ocassions, maybe that was the reason they wanted him to disqualify on.

Why is no one talking about the fact that this happened in Sweden so that you have to deal with Swedish law and culture (and Martin Österdahl is also a Swede). Sweden is ridiculously strict with this kind of thing - look at someone askance and you can be prosecuted for threats or intimidation ("olaga hot" in Swedish). In the Netherlands they would have come up with a rational, harmonious solution; in Italy it would have been laughed off; but now it happened in Sweden and you have a big problem. (However, Joost was not arrested, he may leave the country and the prosecutor is not in any hurry, so I wouldn't be surprised if it turns out to be a tempest in a Swedish tea cup - which would be a big problem for the EBU maffia and Kim-Jong Österdahl.)

Bei der Freakshow wundert mich gar nichts mehr.
Vielleicht wollte man einfach dem Ergebnis polizeilicher Ermittlungen nicht vorgreifen? Das sollte doch eigentlich so üblich sein.
Vielleicht sollte die EBU das auch getan haben, statt jemanden bloss auf Anschuldigung ihrer eigenen Kamerafrau zu verurteilen und schwer zu strafen?
Soeben habe ich ein neues Detail gehört. Es stimmt, dass er die Kamerafrau wohl nicht berührt hat. Allerdings war die Kamera nach dem Vorfall schrott. Wenn ich hier lese, dass er bedingungslos seine Ruhe braucht und alleine gelassen werden will nach einem solchen Auftritt so verstehe ich nicht, warum er und sein Team das nicht offiziell kommuniziert hat. So dass jeder das weiss und auch die Bedingungen dazu bekannt sind. Dass er nicht vor die Kamera will ist für einen Anlass in dieser Grösse wohl ansonsten nicht verständlich und schwer umsetzbar.

BTW the Newspaper the Aftonbladet, reported that the camera was broken in the incident , well the camera could have dropped she could have been clumsy, has butterfingers or whatever we can make up. But and still she should not have been there in the 1st place, so we do know what we do know for sure:

Can you give me the source for an existing legal binding agreement between Joost and the EBU to make camera filming exceptions for him? Because all of the arguments against his disqualification are particularly based upon this partiuclar request.
As someone working in the industry, it's hard for me to believe that such an written agreement really exists, as it would be nearly impossible for SVT and EBU to make such an exception. All camera paths are highly choreographed and every cameraman and camerawoman need to be in exact these particular spots at the exactly right second. If showacts don't accept them to do certain things the show needs them to do, it can be hard to impossible to pull it off. You just can't have showacts running rouge, risk problametic images or break cameras because they act emotionally (even though his motivations are perfectly understandable, at the end, you need to produce a full show, not only him and if it's too emotional for Joost, he is clearly not able to perform it in such a large scale with millions of Euros at stake in a safe manner that will ease the producers' fear of having an incident live on stage).

Ich rate mal was da passiert ist:
Das war eine weltweit übertragene öffentliche Veranstaltung. Ich bin mir sicher daß jeder Teilnehmer unterschreiben musste daß ständig gefilmt wird. Nun hatte der Holländer da offensichtlich eine Sonderklausel ausgehandelt. Es ist wahrscheinlich daß die Kamerafrau einfach den Job hatte den Backstage Bereich zu filmen, und sie wusste evtl. nicht mal was von der vereinbarten Sonderbehandlung. Also macht sie Ihren Job. Vielleicht ohne bewusst wahrzunehmen wer da jetzt gerade nun wieder durch den Gang kam.
Es wäre sinnvoller und einfacher gewesen eine Ausstrahlung von Aufnahmen in diesem Kontext auszuschließen. Es wurde ja nichts live aus diesem Bereich gesendet, das war garantiert nur für Hintergrundvideos und Social Media etc. Das hätte man hinterher klären können, bzw. gleich so vereinbaren.
Mal ganz abgesehen davon daß diese ganze Geschichte sowieso komplett blödsinnig ist, gerade im Kontext des ESC wäre ein Clip von Joost mit Tränchen in den Augen nichts negatives gewesen.
Machen wir es kurz, die Niederlande waren zu diesem Zeitpunkt Top Favorit und Israel hätte einen Sieg als positive PR sicher gut gebrauchen können.

Wer mit der Publicity nicht zurechtkommt, sollte nicht mitmachen. Alle Teilnehmer werden unmittelbar nach dem Auftritt gefilmt. Von jedem Teilnehmer werden nach seinem Auftritt Aufnahmen gemacht.

Wenn etwas strafrechtlich relevantes passiert sein sollte, ist eine Disqualifikation gerechtfertigt. Dieses Video klärt das nicht. Die Polizei ermittelt, ob das ausreicht jemandem den Stuhl vor die Tür zu stellen... ??? Aber man stelle sich vor es käme heraus es war eine Straftat und man hätte nichts unternommen, ... das Szenario finde ich schlimmer als das aktuelle.
Wieso? Warum ist das schlimmer als einen unschuldigen schwer zu strafen auf blosse Anschuldigung seiner eigenen Angestelter? In dubio pro reo. Und the EBU ist kein Gerichtshof. Das hat man sich nur angemässigt

Mein Punkt ist, ich war nicht dort und kenne die Situation nur aus den Medien und nur von CZcams. Deshalb weiß ich nicht, ob ich ihm glaube. Deswegen kann ich die Disqualifikation ein bisschen verstehen.
Der Schweizer hatte am Anfang bei der Flaggen Parade die Schweizer Fahne am Rücken und eine Regenbogen Fahne vorne an der Brust.Das ist auch verboten.Also gehört er im nachinein disqualifiziert

Quatsch darüber war gar nichts vereinbart. Für alle Teilnehmer galten dieselben Regeln. Überall durfte gefilmt werden. Klein wollte eine Ausnahme und bekam sie nicht. Dann fing er an zu drohen. Er ist selber Schuld an seiner Disqualifizierung. Hätte er sich eben besser benehmen müssen. Bekannt war daß er sich selbst nicht in der Hand hat. ist eben ein sehr wenig stressbeständiger Typ. Einer aus der Woke-Familie.

Es gibt Regeln die sind ein zu halten ! Das jeder Gefilmt wird ist jedem klar . Die Teilnehmer in der Vorrunde wo ausgeschieden sind sind die Blamierten .Die hätten so ein Verhalten nicht an den Tag gelegt wie der Niederländer ! So wie der Schweizer sind schon etliche Aufgetreten z.B 2015 Danna International .
Even behind the scenes? I think you can demand not to be filmed. That is your right. If you are walking on a public street, it's somewhat different. Even if you can be filmed anywhere, if someone asks you to stop filming, you should stop filming. Basic human decency
Actually, the opposite is true: In most European countries, being filmed in public is illegal, while being filmed in a private equity, after accepting the contract with the private owner (here: EBU), is perfectly legal. You can ask people to stop filming you on the street, but you cannot demand it if you agreed to it in private space if the party of the contract doesn't see it fit.
Setting aside if there really was a legal binding additional agreement between Joost and the EBU to not film him in certain situations, that is. Personally, I find it hard to believe that such an agreement exists, as no professional show runner would sign it - but there's no proof, yet. Only hearsay. Nevertheless: This is the largest music show on earth. You have cameras everywhere and you need your showacts to be comfortable with it. If they aren't and cameras break because of this, the risk to have similiar situations live on stage is too high. In such cases, producing the show without problems (or cameras breaking that you desperately need) becomes more important than personal feelings. You can find this inhuman, but at the end, it's millions of Euros at stake.
@basti0007 No, it's illegal if you are the main subject being filmed. If you are a passerby being filmed, it's not illegal in most cases. Even so, it is difficult to uphold such laws, so in practice, you can film whatever you like if you are in a public space until someone makes a big deal out of it.
Anyway, if it's legal or not doesn't impact my opinion; it is basic human decency to stop acting intrusive if another person asks for it (multiple times even). This was backstage, that also makes it a different story. What purpose did she have filming there?
Es war ja von vorne herein klar, dass dieses Jahr eine Non-binäre Person gewinnen muss. Leider ist Joost in den Umfragewerten an der Schweiz vorbeigezogen, deshalb musste man ihn loswerden.
