    This was the craziest audit to date. But it finally decides the Poster 7 debate without a SHADOW of a doubt! Great educational audit!
    I know it's a long one, but it is worth watching every minute of it.
    Auditor Grading System:
    Anything less than an A is a fail. The lower grades denote to which degree the auditee failed
    A: Applaudable
    B: Bothersome
    C: Confrontational/Called police
    D: Detained without probable cause
    F: False arrest
    E: Educated
    All audits are completed within 30 minutes

      Joe cool He established himself with "Veteran" status the moment he arrived on the second visit. That took guts. Chris's boyfriend would not have fared well if he'd threatened me like that. Cop told him to get the hell out of there that was good. Cop flip flopped like Obama. Passed, almost, on the 2nd day. The fail was not identifying himself.
      The fail was the first day; infringement of civil rights under color of law (4th Amendment US Code Title 18 section 242) and press the Department of Justice to press charges against him. He will probably not lose his job, he may not serve time, but he'll have a criminal record that he infringed the rights of a citizen journalist.

      SGV NEWS FIRST Right! But they can only ask you to leave IF you are causing a disturbance. They can not ask you to leave just because a customer doesn’t like it.

    • @michaeldomino3334
      @michaeldomino3334 Před 5 lety

      Everytime a customer entered that building, they were conducting private business. Exposing their private credit card details, and use of the us postal service. Also exposing private addresses and information. So in my opinion, I would have asked you to leave everytime a customer came into the building to protect the customers 4th ammendment right, or any right to privacy period. I think you just going into the office and just starting to film makes people uneasy obviously. You should just come out with what your intentions are, eventhough I know you dont have to but all this does is cause a disturbance. And seams counterproductive. The us postal service has been notified to really just ignore your "audits" because all they do is create a problem when the us postal service follows its standard operating procedure. The postal inspector you 1st spoke with sounded un-versed and uneducated in her actual roll. Sounded more like a customer service specialist. I think how this all went down was bad for obvious reasons. (The boyfriend) You just coming in probably looking like a weirdo. Stuff like that. I believe these audits are really a waste of time. Try auditing the federal reserve, or somthing that matters, and leave the post office alone. They have enough of their own problems without your camera wielding antics. Let me guess, you were probably dressed like some man off the street with out any professional attire, name tag or literature of the "awareness " your spreading, am I right? Waste of postal inspectors time.

    • @Dalonghair
      @Dalonghair Před 5 lety +1

      Michael Domino
      You are absolutely wrong on everything you stated. I mean, _everything._
      The auditor did not interfere with the business transactions of the customers. He did not encroach on the customers while they were conducting business with the post office clerk. [edit] He did not do anything different than anyone else standing in line does. The only difference is he was holding a camera. I do not think you understand how credit card transactions work. There was no invasion of privacy of the customers. There was no exposure of private information of any kind, including customers’ addresses. There were no 4th Amendment Rights violations.
      Get this through your head:
      Filming is not a crime.
      Photography is not a crime.
      Do you not see your own cognitive dissonance? Do you honestly think that the postal employees should clear the lobby for each and every customer? They have a lobby for a reason. Everyone stands in the lobby together and waits their turn to speak privately with the postal employee when they approach the counter. You don’t clear the entire room and make all of the customers wait outside while dealing with each customer individually inside the lobby.
      Do you understand what a lobby is?
      What is your problem with the 1st postal inspect on the phone? She seemed professional to me. Were you triggered by the way she advocated for this U.S. citizen exercising his 1st Amendment Rights while he respected the USPS policies? What did you think was going to happen when he called the Postal Inspector?
      If you believe these audits are a waste of time, then why do you waste your time watching them, a half hour at a clip?
      What “camera wielding antics” are you talking about? Every time I mail a package at the post office counter I take pictures of my postmarked package - at the counter. No one has ever blinked twice. Do you know why? Because there is nothing wrong with that.
      When exactly did holding a camera become suspicious?!
      His attire is no concern of yours, Mr. Fashion Police. This isn’t 1952. Most people don’t dress up in a coat & tie to go to the post office anymore. You can if you want to but no one expects it. Name tag?! Are you serious? Do you wear a name tag every time you go out in public? Literature? The only literature he needs is a pocket-sized copy of the U.S. Constitution. Some auditors carry them and hand them out during audits. That and the auditor with the paper with crayon-scrawled “Press Pass” are my personal favorites. 🖍

    • @Dalonghair
      @Dalonghair Před 5 lety

      When you are making transactions at the post office, TYPICALLY no one is playing Canasta in the lobby. When they do, I expect them to be wearing their Sunday best and name badges identifying who is on whose team.
      TYPICALLY no one is quietly praying in a corner of the lobby not bothering anyone. Better call the police.

    The cop on the first day was a complete fool, too, telling the auditor the sidewalk in front of the post office belongs to the post office. believe or trust anything the police say to you. They are not there to help. They are there to take your money, take your

    They are arrogant, self-important, self-serving, entitled, under

    USPS revised ASM 66 (Administrative Service Manual) regarding private and personal photography, video, etc. of the interior of Postal Service facilities:
    "Informal snapshots from handheld cameras for personal use may be allowed at the postmaster’s discretion provided that there is no disruption to Postal Service operations and that the pictures are taken from areas accessible to the public. In these cases, no prior permission is required from the Office of Rights and Permissions; however, no lighting or scaffolding may be set up, and no picture can depict any Postal Service employee, customer, security camera, or cover of mail (i.e., the exterior of a mailpiece, which would show customer name and address among other things). Postmasters may restrict any and all photography if they determine that it is disruptive or there are potential security concerns."
    Points to note:
    (1.) On the PUBLIC sidewalk, outside the facility, you are permitted to record anything within view, as long as you do not disrupt operations;
    (2.) Inside any facility, you cannot (a) record any employee or customer (b) record the position of any surveillance camera (kind of silly, if you ask me);
    (3.) You cannot, in any way, disrupt postal operations;
    (4.) These activities can be halted and/or prohibited at the discretion of the local Postmaster for that facility or an authorized supervisor.
    Without direct prohibition by the local Postmaster or an authorized supervisor, you do have a right to do what your'e doing as long as you don't disrupt services and operations. As you can see, there is a lot of confusion about the issue even within the U.S. Postal Service. Most of the seasoned and experienced auditors have ceased doing audits of the interior areas of the postal service facilities because of this massive misunderstanding.
    The bottom line is - you DO have a right to record with the above stated limitations. Clearly, however, it would be next to impossible to video record any interior areas without capturing employee or customer images. I doubt USPS would really make an issue of that, though.
    Well done. Very productive.

    Poster 7 explained - _see the problem people have in comprehending the text of USPS Poster 7 is... the subject areas and conditions._
    *Note: the section in Poster 7 concerning "Photography for News", it covers three "Subject Areas" (SA#) and two "Conditions" (C#) ;*
    _(SA1) - Photographs for News,_
    _(C1) - entrances, lobbies, foyers, corridors, or auditoriums when used for public meetings_
    _(C2) - Other photographs_
    _(SA2) - Advertising,_
    _(SA3) - or Commercial Purposes._
    _Let's review the subject areas, and their conditions._
    _USPS Poster 7 (Aug 2016) text:_
    *Photographs for News (SA1), Advertising (SA2), or Commercial Purposes (SA3)*
    *(SA1)* Photographs for news purposes may be taken in
    *(C1)* entrances, lobbies, foyers, corridors, or auditoriums when used for public meetings except where prohibited by official signs or Security Force personnel or other authorized personnel or a federal court order or rule.
    *(C2 & SA2, SA3)* Other photographs may be taken only with the permission of the local Postmaster or installation head.
    _(The last sentence deals "Only" with _*_"(C2) Other photographs"_*
    _IE: _*_"Advertising (SA2), or Commercial Purposes (SA3)"_*_ as (SA1) and its condition (C1) was already covered._
    _Where readers misinterpret the last part of the first sentence covering (SA1) & (C1) is when they encounter the word_ *_"except."_*
    (We will refer to that as the *_"exception.")_*
    _The _*_"exception",_* which is *_"Except Where Prohibited",_* indicates that it has to be _"already prohibited" or is "being prohibited";_ again, *_where prohibited._*
    ▫️ _NOTE that:_ *(SA1)* "Photographs for news purposes may be taken in"
    _Clearly establishes "that photographs may be taken."_
    ▫️ _And note that:_ *(C1)* "entrances, lobbies, foyers, corridors, or auditoriums when used for public meetings"
    _Clearly establishes where "photographs may be taken in."_
    ● An _"Authorized Personnel"_ or _"Employees Only"_ sign or placard meets the *_"Except Where Prohibited"_* guidance.
    IE: [except where _{in any of those places it is}_ prohibited by official signs or Security Force personnel or other authorized personnel or a federal court order or rule.]
    Again, the key words are: *_"Except Where Prohibited"..._*
    ● by offical signs
    ▫️IE: an _"Authorized Personnel"_ or _"Employees Only"_ sign or placard.
    ○ Currently there is no Legal Signage prohibiting news photography in public areas.
    ● or Security Force personnel
    ○ Can only restrict photography or stop someone from doing it in an "authorized/restricted" area per the USPS "Rules and Regulations Governing Conduct".
    ● or other authorized personnel
    ○ Can only restrict photography or stop someone from doing it in an "authorized/restricted" area per the USPS "Rules and Regulations Governing Conduct".
    ● or a Federal court order or rule prohibits it.
    ○ Currently the Federal Courts and the CFR allows news photography in public areas.
    The CFR, the DHS Order of 2018, the USPS POM, and the USPS Poster 7 all allow news photography in public areas. Cause: the *_"right"_* to take pictures or video in public areas has already been clearly established by the courts and the government/courts can not confirm a *_"right"_* then place restrictions that take that *_"right"_* away in its entirety.
    Even 41 CFR § 102-74.420 (linked below) clearly verifies photography is allowed for news purposes in the public areas. And the CFR is the Controling federal regulation for Poster 7.
