    That officer is an absolute joke. He looked terrified the whole time and then had no idea how to perform a search, too much time spent sitting in his little hut, with nothing to do all day but let his brain turn to mush. We also know which officer ate ALL the Pies.

      It's an implicit criticism of the clever chaps who designed the security part of the arhitects' brief, and of the building managment - the constables are saying that sensitive data is on display for anyone with eyes who looks in the general direction of the building.
      I think maybe if they raise this with the building management at a nice big meeting, they would be told to f-ck right off
      as if the expensive architects and all the rest of the clever chaps didn't think about security when they designed it, or they would be in breach of DPA 24/7 because something sensitive was on display for anyone to see if they look at the building fffs

I'm a photographer so knowing all my rights, thanks to you and channels like you, is so so so important.     Their attitude is so belligerent because even if they are found to have made an illegal search nothing will happen to them. Maybe we need a law that states if any constable makes more than 1 illegal search they are dismissed from service. No appeal rights.

      @Jack Sugden - I’ve noticed on several of his videos that if things don’t go the way that he wants them to then he reverts to his natural character, which seems to be shouting, swearing and abusing people and then crying that he’s been badly done by.
      He then usually claims that this was due to acting in the heat of the moment.
      I’m pretty certain that one day, the person who he is trying to intimidate, will “act in the heat of the moment” and kick the crap out of him.

    Police should employ mystery shoppers eg auditors to test police and actually take action on them. Love this they have a iconic building witch is photographed 1000’s of times a day and they used terrorism to get in your pockets , after a search I would then film for hours afterwards they can’t suspect you of a terrorist after they say your free yo go

    Don't forget this one at the end - when they say "you've obviously come here to provoke a reaction from us" just say "provocation is mitigation". i.e they are admitting wrongdoing but less culpability for sentencing after they have admitted guilt for the offence they claim was provoked.

    These audits are entertaining and you're right, if we don't exercise our freedoms, we lose them. My only concern is that because there are gazillions of 'less capable' auditors on CZcams (and the number of channels are growing daily) then at some point the powers-that-be are going to see it as a nuisance and change the law. If they ban public photography in certain places completely, create new bylaws and/or give the police more powers to detain photographers under new subsections of law then that will have a negative impact on the reason behind these videos.
    I don't know what the answer is, but I saw two videos yesterday whereby two young lads were just abusing police and claiming to be 'auditors'. Those individuals - and there really are a lot on CZcams - are starting to give auditing a bad reputation. I don't think it will be tolerated for long. Hope I'm wrong. Cheers for the video. I really did think that cop was going to cry...

    It's quite concerning to see his colleagues stand by and watch him abusing your rights and do an illegal so called search purely through revenge without a word or any action from them to stop it but we seem to be seeing more of this protecting their fellow constables behaviour , It's no surprise that the growing amount of public have lost any trust or respect for them , This behaviour doesn't do the police force any favours .

    Straight to the IOPC then professional standards with these two. After asking for your ID the next words out of his mouth, under informed concent, should have been, "you are not legally obliged to identify." After your phone was searched and the prig of a cop filling out the form still didn't have a clue what he was doing, the copper stood by the door, was chewing gum on duty, in front of a member of the public. That's a massive no no. You could see the colour drain from his face when you knew every section of your rights and their wrongs. What an absolute joke. Great audit and well done for standing your ground. Even the van was parked illegally, on double yellow lines.

I rate the fact that your probably the only one of the "Auditors" that ever mentioned misfeasance in public office. I really look forward to hearing the outcome of a criminal prosecution for misfeasance. That will then stop other officers from abusing the powers we gift them. I don't hold much hope in him being prosecuted without having to threaten the prosecution with misfeasance also. He clearly had no reason to use S43 and was ignorant & arrogant in his whole demeanor from the refusal to identify with his oversized ego. He definitely needs taking down a peg or two. Keep up the good work.

    Police worried about a man with a camera outside the embassy for a few minutes, but there's all those flats overlooking the embassy and it just needs one to have a camera on it's balcony and it could be recording 24/7, uploading to a Russian web server.

      Eh? He was looking at the photographs/footage taken on the phone to determine if PTTP was carrying out hostile reconnaissance. He made that eminently clear and that’s why he wasn’t interested in searching PTTP’s person. Possibly he was the wrong side of the line on whether he had reasonable grounds, but counter-terrorism officers get a fair amount of leeway. The US embassy IS a genuine target for terrorists, unlike random police stations and that would factor into his decision too. In spite of PTTPs belligerent attitude all the officers stayed calm.
      There is a weird irony here too. PTTP is very confident that there were not reasonable grounds for a search but he does believe there were reasonable grounds for him to believe “malfeasance in public office.” had occurred.
      At some point, there will be a major terrorist attack on London. Those officers and their colleagues will put their lives on the line to protect us. Treat them with a bit of respect. They are not random megalomaniacs like some of the bully officers who have used s43 in other auditing videos.

      The US embassy is an amazing building that has been heavily photographed since they first started development of the site around a decade ago. Counter-terrorism officers must follow the same laws, guidelines and procedures as any other sworn officer.
      The NPCC (which is responsible for counter-terrorism operations in the UK) offers the following guidance on the subject of Auditors and Bloggers:
      *** Auditors/Bloggers should not be confused with hostile reconnaissance which by its nature is
      covert. Hostile reconnaissance will cover and test:
      - Security vulnerabilities
      - Patrol routes
      - Shift patterns
      - Layout of a venue
      - Security practices ***
      "You are pointing a camera at this building" does not constitute reasonable grounds to suspect an individual of being a terrorist.
      Respect is earned, Jon, not demanded. Your emotional plea has no basis in fact, and serves only to shame yourself.
      "Those who would give up essential liberty, to purchase a little temporary safety, deserve neither liberty nor safety."
      Stop celebrating your ignorance, Jon. It's not a great look.

      I agree that pointing a camera at a public building doesn’t constitute reasonable grounds for a s43 search. However, it is possible that the officer observed him filming things in such a way that would make a reasonable person suspicious. You can’t know as the video was edited. It seems likely that the officer was over-zealous and I said that. Having the officer jailed for misfeasance in public office for this search would be a much worse injustice than the search was. It took a few minutes and wasn’t done in an aggressive way. PTTP wants him jailed. Not retrained because he didn’t have sufficient grounds - jailed. You agree with that?

      @@JonCookeBridge I'm not interested in hypothetical subjective observations of which we have zero evidence. Our legal system is founded on what is reasonable, not on what is possible, and rightly so.
      What the camera shows is an example of misconduct, carried out by a public officer which resulted in personal injury (an unlawful search). Whether or not this particular case should result in a custodial sentence is a matter for the crown court to decide, not PTTP, but it certainly should be considered misfeasance.
      I agree that there is a case to be heard, regardless of the outcome. Whilst I don't necessarily agree that the officer should serve time, I also recognise that this particular infringement of his rights was exacerbated by the fact that the officers were armed.
      I propose that the officers involved should at the very least be reprimanded, removed from firearms duty and reminded of the oath they swore to uphold "fundamental human rights" and to accord "equal respect to all people".

      I think they are selectively better trained. But I suspect there isn't alot of contact with the public training, since the priority is intimidation.

      I'm sure there must also be cops who get into it to keep their community safe from harm but south london seems to be full of really nasty ones for some reason. Many of them live in Kent and Surrey because why shit on your own doorstep? Imo, cops should live in and become a part of the community they police. The met seem to be fostering a culture of encouraging abusive behaviour toward the public. I've only ever experienced real misconduct from British cops when in London and only when I wasn't filming. Everywhere else, I've found they're usually quite friendly and helpful. I'm sure there will be exceptions. I've heard bad things about TVP but I haven't been there. I don't care if they have their hands in their pockets, chew gum or wear a black Union Jack or even a Mr blobby outfit as long as they respect and protect our freedoms while keeping us safe from actual crime.

    Highlights of this excellent audit are too numerous to mention. A small selection of them include:
    8:27 "you're an absolute knob, identify!", 10:53 "anything else we can help you with today ? you can burger off", 11:31 - "you wont be able to take photos - I already have", 11:46 "jog on", 11:53 "any reason why are you filming in there? ...because that is what I want to film", 12:52 (thumb on warrant card), 13:12 "do your job properly".
    They certainly got their A55 handed to them on a plate that day - a brilliant lesson in the law for these two.
