Pisses me off how they shine their torches in peoples faces/cameras. As for their behavior perhaps they believe the word POLICE is an acronym for: Pick On Lawful Innocent Citizens Everywhere
That sucks he's riding in the car with his ex well hopefully anyway why the fuck would you ever not back your man.
It’s not clearly established in all federal circuits that one has a First Amendment right to record the police in the performance of their duties.
Only one federal circuit court of appeals (4th Circuit) has held that there is a constitutional right for a passenger to live-stream their traffic stop. It should be noted, however, that the 4th Circuit didn’t decide whether a general right to record the police was clearly established and it also remanded to the federal district court the issue of whether the regulation of the live-streaming passes constitutional muster.
There is a concern over whether occupants of police detainments have a right to contact third parties during _Terry_ or traffic stops.
Even in jurisdictions where the “right to record the police” is clearly established the contours of the right may not be so clear so as to clearly establish a right to video record one’s own detainment.
You indicated that the only way an officer can extend the stop is probable cause. That’s incorrect since the “reasonable articulable suspicion the criminal activity may be afoot” is also sufficient to prolong the temporal duration of a traffic or _Terry_ stop.
I’m going to quote the same case you cited to make my point.
{An officer, in other words, may conduct certain unrelated checks during an otherwise lawful traffic stop. But contrary to Justice ALITO's suggestion, post, at 1625, n. 2, he may not do so in a way that prolongs the stop, absent the reasonable suspicion ordinarily demanded to justify detaining an individual.}
_-Rodriguez v. United States,_ 575 US 348 - Supreme Court 2015
Absent reasonable articulable suspicion, the police may not extend the stop beyond the time it would take to complete the mission of the stop.
When an officer doesn’t want to be recorded means he’s dirty and can’t be trusted.

Glad you're a former cop. Me too. Out of all the horrendous things I have seen, the one that hits me the hardest, is when I saw a cop kick a cuffed up, non-violent kid in the face. When he went to kick him again, I stopped it. I was blown away by this. I never in a million years imagined someone wearing a badge could do that. I reported the incident and was immediately hated by many. When I was ordered by Internal Affairs to make a statement, I did so, of course. I provided a synopsis of the incident. In doing so, I reported the first kick, but I did not report the second kick attempt that I thwarted. By this time, I had received death threats and been mocked while walking down the halls of the Police Department. I showed up at roll call and every officer got up and walked out. The maleficence of one rogue cop demonstrates the growing controversy of unlawful orders used to escalate routine interaction into excessive use of force. Routine police misconduct is reaching critical mass in the court of public opinion. Our prison for profit pipeline arrests more U.S. citizens than any other nation on earth. ( Maydar, NYU Law.) Pulitzer journalists who investigate the issue report "the principle of equality before the law has been effectively abolished. Instead, a two-tiered system of justice ensures that the country's police and government officials are virtually immune from prosecution, licensed to act without restraint, while the politically powerless are imprisoned with greater ease and in greater numbers than in any other country in the world." (Greenwald, 'With Liberty and Justice for Some'.) Law enforcement spends billions taxpayer money to defend legal settlements for repeat offenders of police misconduct. Lack of department accountability and punishment leads to the same police misconduct time-and-again costing taxpayers -- essentially defunding law enforcement. (Washington Post, 'The hidden billion-dollar cost of repeated police misconduct'.) One "study finds misconduct spreads among police officers like contagion". It doesn't appear to be 'one bad apple' but the complete tree from its union roots to top branches of leadership that are toxic. (Criminologist study on police accountability at North Dakota State University.)
It's been almost a decade since the 'Council on Criminal Justice Task Force on Policing' called for "complete overhaul of U.S. police training and national standards". The task force found "most police training in the United States is misfocused, too short, uses ineffective teaching methods, and is out of alignment with both community safety priorities and research about what works to minimize bias and use of force." The task force concluded. “Police departments need policies and standards that hold officers accountable - and leaders committed to changing the internal culture of their departments.” As of today -- the institution of law enforcement ignores all professional and public demands for real reforms.
It should shock every American when cops use *color of law* to deprive fundamental and well-established rights and laws. An unlawful order using 'color of law is "a mere semblance of legal right; something done with the apparent authority of law but actually in contravention of law, where no legal authority exists". In fact it's a federal crime under U.S. Title 18, Sections 241 & 242. Every rookie cop learns "the freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state.” (U.S. Supreme Court, City of Houston v Hill, 482 U.S. 451, 1987). Every rookie cop knows 4th Amendment rights .. “the United States Supreme Court ruled that a police officer could not arrest a citizen merely for refusing to present identification.” (Kolender v. Lawson, 461 U.S. 352, 1983).
These cops knew they were violating civil rights - *and don't care* -- because they understood they would never be held accountable. History has amply demonstrated where this will end up. "Show me your papers" was used to deprive rights in history once before, until that police duplicity was revealed in a final solution. According to national research .. "No less than 27% of Police Officers; 34% of Sheriff Deputies, and even more concerning, over 68% of Private Security personnel are psychologically unfit to wear a Badge much less carry a Firearm." Viral videos such as this are classic example of why citizens have lost respect for and trust in Law Enforcement organizations in our nation; so much so, that many now -- even the mainstream media consider the United States to be a "Police State" .
