      What we see at the JSC's interview should not be a surprise. South Africans will never get justice served on from any our courts being criminal or civil. The is a lot wrong with our judiciary and the people who are expected to uphold the law.

    Judicial officers are more human than politicians or bureaucrats, they are just protected from accountability by the structure of our state in the sense that they are only held to account or rationalize their judgments in this process. I hold a very strong opinion that if some of these judges are called to account for their judgments they wouldn't meet the requirements or standards. I somehow feel that some judgments are so grossly incorrect that they transcend to the realm of illegality, they are just indemnified by the law from illegality and veiled by the cloth of error. However, some errors are too gross and should be deemed illegal.

    Notwithstanding the fact that judges are fallable, it is clear that there are many cases where a lot of people did not receive justice for their cases brought before our courts. To me it shows the inability of most judges to be objective when handling cases in court. They either become overtaken by the matters at hand by default or deliberately and thus become subjective eventually.

    Juju is pointing out the issues in our law, not the Judge. The law has to change it us difficult for some judges to understand application of law, as pointed out by Nqcukaitobi.

    I really don't know if in this planet do we still have honest judges or lawyers. Just think about it how many people have been in prison for years for the crime they did not commit. Most of the judges doing that are the ones who have been promised or shown a lot of money by the offenders to rule on their favours. Even if deep down their hearts they know that it will be the wrong thing to do. During the ruling time, the judge will be stuck with two options, which is, which one is going to take should he/she do the right thing and loose the money have been shown to him by the offenders or saying to hell with the money. Since we know that most of the people are hungry for money, it's not any exception with the people from that profession
    Of course that will be his choice. But after choosing the wrong one, how is he going to sleep at night for r the rest of his remaining living years.

    If you understand the law you would understand what the candidate judge is implying. Every case is different and will judged differently. The fact that different people are convicted of rape will never mean the sentence must b the same

    I love listening to the JSC interviews - but some of these mistakes by these jufges or magistrates are shocking.
    Can somebody explain clearly to me what this magistrate got wrong?
