      I have seen several JSC interviews of Malema but this one of Malema holding a glass of Coke seems to be the most thrilling. I think that The Coca Cola Company must pay a specific amount of money to the JSC for product marketing.

      In the case cited the points raised were valid actually. The problem is the way in which they were raised was kind of an ambush. What I like about the judge was the fact that he admits to not having done great in 2015-2017 but certainly believes he improved since then

    Its really refreshing to see the CIC Malema defending the candidate. The candidates response was also good because as CIC Malema qoutes the candidate saying English is not his first language. What I got here is a sense that all candidates should be treated fairly.

    That prof kept saying he'd read excepts of the judgement, but never did so. It was impossible to understand what the prof was criticising and Malema was spot on.

    Lol, but all those judgements were given and those people involved in those cases were affected by those judgements. So now I hope people can see how important it is to have competent and people who are not corrupt. These judgements affect everyone because those interpretations are followed by other judges.
    Malema is right, there is a right of recourse for the people to appeal or review his decision. If the judgement is not up to scratch, then it should have been picked up by the various bodies who are responsible for oversight.

      But that is where the problem is, these law bodies did not. In fact, they picked up language and reasoning issues on the judgments of the two black ladies who were interviewed for the Limpopo Division, but not this judge, which raises obvious questions that Prof Marumoagae is referring to.

      I thought the issue was that it was not included in the pack so that everyone can prepare for the question. The other Commissioners could not interrogate the question or assess the Prof's contribution because it was coming out of the blue. Add to that the fact that the point the Prof was raising had not been objected to by other bodies so the respondent could not answer and the other Commissioners had no idea what he was on about

    We have a Judicial Service commission here in Kenya. Its mandated to appoint all judges in Kenya ( including supreme court judges). The JSC is constituted by representative of Law society, Public service commission, clergy and President nominate two members. The three arms of government should always strive to be independent

    Holland-Muter SC, was one of my trainers during pupillage in 2017, at the Pretoria Bar.
    A very fair, able and hardworking guy if you ask me, he is not afraid to make big calls.
    His appointment will surely contribute massively to the development of our law.

    The Commissioner is within his rights to question that judgment and he raised very valid points actually to anyone who cared to listen, the only issue is he should not have ambushed the candidate. I am a big Julius Malema fan myself and yes he was right in his first point that anyone can raise issue why leave it to others to raise for you? Then complain when they don't? But he misinterpreted the issue raised. The issue was application of the Act and Section cited to the case in question. You can't cite a section, list its properties then not show its applicability or relevance to the case you are ruling on, what's the point? Very valid criticism but the ambush was unfair. What I like about the judge was the fact that he admits to not having done great in 2015-2017 but certainly believes he has improved since then.

      Im no law expert nor a politician but i dont think its fair to criticize someone based on a document they compiled/wrote 6 years ago without giving them an opportunity to go throught that document again. Maybe he would have been able to explain himself if he was given a chance to go through that judgment before the interview.

      @@musajohannessithole8970 in case you are confused, I'm a passionate fan of the CIC an even strong supporter of his course, however, l, quite like malema, reserve the objectivity of my mind even when it pertains to him, unlike you who sound to have transcended the level of a supporter to fanaticism. There is something called grandstanding in politics and those that master it, exercise it in the subtlest of manners that blinded followers, such as yourself, cannot detect, and malema is one master of grandstanding. If you had read the comment with sobriety you would have realised, but I accept that fanaticism and predisposition to political nuances and deception eliminate sobriety in its totality and leaves only political hypnotism.

As to whether I'm confident in their feasibility, I'm non-committal. Malema, in my observations, is one of the most strategic politicians in the country, and he has to be, given that his political philosophy is opposed to the status quo which preserved, perpetuated and sustained by capital whose infinite capacity to character assassinate polarizing political figure such as malema is unrivalled, on account of its unlimited resources. So the man is a model and exemplary leader in the black community across the globe. However, be that as it may, that shouldn't blind us as to his contradictions and tarttuffery, our ability to observe his shortcomings does not mean that we oppose him, it points to our ability decipher political nuances and that translate into an EFF following that is more than spectators but also critical thinker that are able to digest information and produce practical solutions. Thus if everytime an observation that sounds, but not necessarily is, critical, of the CIC is perceived as an opposition, then the fragility of the CIC's support base is shaky at best. Lest my point is lost along the way, I'm EFF an enthusiast, and this isn't by any measure sycophancy, but only a way to demonstrate my objectivity.

    Let us test this: The two female judges from Limpopo were grilled on their poor use of language and inability to reason in their judgments as well as misapplication of the law. No one complained or came to their rescue. No one asked if English was their language. The questioning from JP Mlambo created an impression that this judges' judgments were unimpeachable because there were no adverse comments from the law bodies. Prof Marumoagae, as was done with the poor ladies from Limpopo, demonstrated language and reasoning faults in this judge's judgment. Limpopo ladies were challenged with unproven rumours from other judges who did not make statements to the JSC. Prof Marumoagae challenged this judge with HIS OWN JUDGMENT. There is no clip of what the Limpopo ladies were subjected to because Malema was not involved. The proposition by Prof Marumoagae was fair and in line with what happened to other candidates. Please check out the criticism levelled against aspirant black female judges from Limpopo because you comment merely on the strength of this clip. Context matters.

      That's the problem with mushrooming issues. If you do not circulate what you intend to raise, your matter deserves a dismissal. It is a valid representation but it's equally a specific matter that could have been brought to the attention of the candidate prior to this so they can provide clarity.
      Raising such an old matter without providing a prior notice is unfair.

      @Thabo Phuti Mojela My dear, for rule of law to continue fair and unbiased, there is a separation of powers of the judiciary from the government. Think about it, when citizens sue the government, the judge must be unbiased. The judges must be appointed independently by professionals in the legal field, not politicians. Politicians are constantly dodging the law and one can see how our politicians are very corrupt so they should not be involved in appointments - if there one politician from the EFF, then there must be a panel with all the political parties involved in the decision because that would be fair although.
