  • Alec Baldwin pointed a loaded gun at his crew on the "Rust" set, pulled the trigger and killed Halyna Hutchins over a year ago but he has not been criminally charged. In this video, I give you five facts in the case -- from the very first day -- on whether he will be charged with a crime for ignoring all three gun safety rules or whether he gets away with it.

    He should have been arrested the first day like any one of the rest of us would have been.

      PRECISELY !
      Fingerprints taken, mug shots taken, residue on his skin or on the clothes he was wearing etc.
      So my question is: Why was AB treated differently than others who had shot someone by the Sheriff Dept. ?

      Ed, I only started to see that with the sudden civil settlement with Hutchins. Now it seems most likely and either a public apology with no charges or a lesser gun-related charge.

    Thank you Emily for posting the AB Sheriff's interview on Substack over a month ago. Yes, it was long but it's worth watching
    the interaction of AB with the Sheriff's Dept. Investigators. This is one HUGE reason to join Emily and the rest of us on Substack !
    I can't think of one TV network that broadcast the entire interview of AB & the Sheriff Dept. Investigators. Why didn't they ?
    Don't forget folks: AB has already settled with the family of Halyna Hutchins just recently....BEFORE any charges were brought against
    anyone and BEFORE any Criminal Court Hearing was started. Why did AB & his lawyers settle BEFORE charges were brought and the
    Criminal Court Hearings had started ?

    The most he can be charged with, if anything, is manslaughter or negligent homicide. Whether or not he is charged and the degree to which he will be charged hinges on what the DA can prove his mental state to be at the time of the killing. There is a 99.9% chance it is not intent. So it could be recklessness or negligent. The question will be whether he knew, or should have known there was live ammo in the gun.

    • @Emily.Miller
      @Emily.Miller  Před rokem +1

      I'm so glad to get your legal analysis. Do you think these standards would apply for a regular person? Also, Baldwin has insisted that it's not his responsibility to check to see the ammo is blanks or dummy rounds (no one considered live ammo) but other actors I've interviewed (plus George Clooney) say they check their own guns on set to know what is loaded.

    Emily, great reporting as usual. It bothers me that people that are "celebrities'" seem to get preferential treatment over ordinary folks like you and I. What happened was a tragedy and is an accident but there were so many gun handling rules broken that it is not surprising what happened. Thank you Emily!

    • @Emily.Miller
      @Emily.Miller  Před rokem +1

      Thank you so much for watching and the feedback! I agree that celebrities seem to get off easier because of their fame and they can afford the best teams of attorneys and publicists that make their fans sympathetic toward them. We shall see what happens to Baldwin in the next few weeks or months.

      @@Emily.Miller If it took the Sheriff Dept. a year to do their investigation, will the DA's office
      take this much time as well to do their own investigation ?
      I am perplexed: Why didn't the DA work hand in hand with the DA's office so that the investigation
      would be done by now and the Court Hearings be started by 1 December 2022.
      Something seems "fishy" here ! Is there a reason(s) the DA is now doing their own investigation of this incident ?

    • @michaelk4422
      @michaelk4422 Před rokem

      Sadly Zeke, it has been this way for years. But now with more media folks like Emily and others INVESTIGATING,
      we are seeing MORE and MORE "celebrities" and even in many of the Feds investigation, there is a two-tier Justice
      System.
      One needs look no further than Joe Biden and Hunter Biden. Hunter was discharged from the Navy for "street drug
      usage". If this is true, which the facts point that direction: Why was Hunter not charged with possession of the street
      drugs in his barracks or wherever he kept his drugs if it was on a military base ? Also, in 2018 Hunter bought a semi-
      auto pistol while he was doing street drugs. This pistol is seen on at least one video that was on his Laptop.
      Is there a reason that the Feds are leaking all kinds of things about Trump to LYINGnews, but coincidentally NOTHING
      has been LEAKED regarding Hunter and if he is facing FELONY criminal charges ? Why not ? Two-Tier Justice !

    I don't like Alec Baldwin, but it's not realistic to expect an actor to treat a gun like someone who's using it conventionally would (cop, hunter, sport shooter, etc). Actors point guns at people all the time because to them they are simply props. I mean for F's sake they run around shooting blanks at each other with real guns which outside of a film production or a military exercise is considered to be extremely unsafe. The ball was dropped when a proper armorer was not on scene to ensure the gun's were in a safe condition. Alot of people want to say screw Alec Baldwin, fry him because of his politics. In the end this is no different then an Industrial accident. The thing that makes things complicated is that Alec Baldwin is a producer for the film.

    • @Emily.Miller
      @Emily.Miller  Před rokem +2

      I respect your opinion but Baldwin said in multiple interviews that he knows the gun safety rules and he would "never" pull the trigger or point a gun at someone on set (he blamed Halyna for telling him to point it at her). Also, George Clooney said he always checks his own guns on set to see if they are loaded and what is in them. I've interviewed multiple actors from film and TV and all say they check their own guns and don't point guns at people and pull the trigger even when unloaded. @@Emily.Miller It is very telling that AB said that Halyna said to point the gun at her.
      Why would she even say this as it defies "gun safety" and logic and common sense ?
      It would be more believable if she had said:
      Point the gun at the camera, but make sure that no one is physically at where you are pointing the gun at.
      Halyna was the cinematographer and not a Director.
      Would her telling AB where to point the gun be within her scope and role as a cinematographer ?
      However, Halyna is not alive to CONFIRM that she actually told AB anything even close to these words.

    Why is the final report being hidden from the public?
    Why is the DA dragging her feet she did get some funding. This deserves a public trial with a jury not behind the scenes deals, its a bad look if they do and further erodes public trust, something they should be trying to build.

    EM, another great example of why you stand out from the rest and "keep me comin' back". You put the "two scoops of raisins in every box".
    Allow me to explain.
    Raisin Bran is a name of cereal that has no trademark. Every cereal manufacturer has Raisin Bran. General Mills, Post, Kellogg's, etc.
    To differentiate their product Kellogg's Raisin Bran marketed their cereal by implying they have more raisins in every box. Serial Cereal Consumers (li'l homophonic fun) chose Kellogg's Raisin Bran. In Grad school we did a case study on this marketing campaign. People like consistency and reliability.
    EM, you deliver consistency and reliability in your reporting. You are tenacious. You follow facts.
    Like Raisin Bran, News is not trademarked. Every company puts out stories, but some take care and exercise due diligence. Like you. Instead of raisins, you deliver facts.
    PS you look great on camera.
