I wish they could but it is, unfortunately, unconstitutional to prohibit them.
In reality the Raleigh City council requires all new developments to have HOAs. Cuts down on nuisance calls from their perspective.

I will NEVER be a part of a homeowners Association. I've never heard anything buy bad stories. One time someone was painting his house yellow, the HOA took him to court. The house from the beginning was yellow.
My sister loved her HOA. Then the HOA president refused to let her bible study group meet in the community clubhouse. It seems he's an atheist and a lawyer. He used every ploy he could to harass the members of the bible group. This continued until he moved out of the neighborhood.
You do have to consider Selection Bias with these stories. The ones that go violently off the rails and end in nuclear revenge are the ones that go viral so to speak. The stories about "this is how my HOA actually does it's duties, doesn't overcharge for dues, the board is made up of perfectly reasonable people and the meetings are very civil" are not the ones that get views on youtube.
I live in a HOA (not in the USA) but I'm not part of it. I bought my house at a foreclosure auction, so I bought directly from the bank, paid in cash, in full, up front. When the moment to sign the contracts came, I just asked the bank to remove the bit about the HOA from the contract and they did. So I have a purchase contract and a deed that both say I'm not part of the HOA.
There used to be some idiocy from HOA Karens at the start, but using municipal beautification laws and national endangered species protection laws, I still get my way all the time. Then members of the HOA who want to do the same thing that I did, will get permission from the municipality and the HOA not being an actual resident can't file objections to permits.
HOA, for when you live in the freest Country on earth, but still want a bit of Communisim in your life.
Maybe the cop should have of start charging the homeowners association for call and make waste and resources
Police departments used to do that but they were made to stop because it was making people afraid to call police granted the police can still fine people for misuse of emergency services but it has to be like 5 false calls in a row or like TV new coverage and the false caller needs to be made an example but that all depends on the state

I would never buy in an HOA neighborhood. It makes NO sense, you're paying twice for the same thing. Without the HOA, the city and or county would do just about everything that you really NEED an HOA for, roads, sewers, water, etc., it's already covered under your taxes, so why pay an HOA for the same thing ??? The BS about maintaining a standard for the neighborhood is just another way of saying they will be racist for you so you don't have to admit to being one.
I actually live in an HOA neighborhood. My dues pay for all the upkeep in the community. The pool the clubhouse the gym my biggest problem is my HOA doesn’t do anything. The rules say no RV vehicles in your driveway no boats in your driveway people do it anyway, it’s not like there’s an HOA police driver, cruising the neighborhood looking for violations.
@@Thisishard2333 In some HOAs there are HOA police, people that have nothing else to do than to check if someone has rust on some part of his vehicle, if he parks on his own grass, if maybe the color of the curtains are wrong etc, so the HOA can get money for fines. Money they have to use not for upkeep but for legal fees for harassment of people outside HOAs.

If the HOA Covenant is not on the deed then they have no standing. One visit to a judge should have taken them out of the picture completely.

The second story there was a foul up about a year-and-a-half afterward and he ended up taking the one brother to court and got the money back with interest and court cost.

Here’s what far too many people can’t appreciate: in some states even, as well as certain municipalities, you CAN’T get a home without an HOA, because for decades, cities have encouraged and maintained HOAs with every new development!! It’s fewer services the cities are obliged to pay, and they get extra tax monies when they do it, never mind the destruction of community cohesion and destruction of The American Dream. There’s NO financial disincentive and only financial incentives for them, so they become ubiquitous.🤬
The other historic fact, for those CRT deficient: HOAs were created and spread once redlining by governments was Federally prohibited. HOAs were ways to PRIVATELY prevent the “wrong” people from moving in a community, no matter if all HOAs do this all the time, it IS possible to happen in EVERY HOA. It’s the cornerstone of any HOA.
We really need federal legislation to drastically curtail the powers of HOAs. Basically, turn them into toothless kittens. With almost no power to enforce their will on anyone, not even their members.
Of course, condos and skyrises would need to maintain their power. We don't want buildings falling down because we got rid of HOA power. But single family buildings..., HOAs should have almost no say except to keep our front yard clean.
If you truly want your freedom do not buy do not buy into a neighborhood condominium townhouse or any other type of housing that has an HOA . As a former HOA manager, I have found that only one out of 50 people will actually understand what an HOA is to buy there .

In far too many cases, it's just a matter of HOA membership being baked into the purchase contract for the property, required to be included in any future contracts when an owner originally joined the HOA. A lot of people who live in a neighborhood with a dominant HOA just get bullied or tricked into joining it, with HOA representatives coming to insist the resident pay membership fees and sign a "new" membership agreement, which locks them and any future owners of the property into the agreement. At this point, too many neighborhoods are already locked into an HOA and those properties are sometimes the only ones available in the buyer's price range.
That said, (and believe me, if I could make it so, I would make it illegal to tie a property to an HOA,) for some people HOAs do offer some reasonable benefits, like keeping maintenance and landscaping companies on retainer at discounted rates (effectively paying for such services at wholesale because it's an entire neighborhood), or guaranteeing for those with more passive/conformist/vanilla outlooks that their neighbors won't be obviously "weird" or non conformist. It's not a mindset I relate to at all, but I can understand why some people might prefer that. What can I say, I wouldn't want to be their neighbor either. Maybe I could appreciate an HOA that gives discounts on certain services, but mandates members not bug each other over property issues that are none of each other's business, so long as that is baked into the bylaws and cannot be changed without the consent of every member.
Like I said many many times before. 5:06 HOAs Lower Property Value, Never Increase them. HOAs Harm Communities and Neighbors and Friends and sometimes Families. It is Much Better to Disband all HOAs in the World then Keep them around. So, If you can, Get on the HOA board if you live in a HOA and Get it Disband as Fast as Possible.
Why do I think that this whole story about the HOA is made up. Police generally don't respond to these kinds of complaints, it's ordinance enforcement officers. Nonetheless it's a good story that gives you every reason to never, never join an HOA.
Oh, I don't know. A lot of rural cops are really, really bored most of the time. I can see them attending just for something to do.

If you're ever in such a situation, document EVERYTHING (every fine, every letter, record every conversation if possible) and give copies of it to your lawyer.
Thank goodness HOA are very rare in my country. We hate what controls city councils have over us and won't tolerate HOAs.

There is a development north of Saint Petersburg that must have a HOA. I rode my bike through it during the holidays and noticed identical christmas decorations on EVERY yard as far as the eye could see. At first it seemed pretty, then creepy. I guess if you didn't celebrate Christmas you were out of luck.

The first question I ask when searching out some real estate is 'is it in an HOA? If so, won't even consider it. I suppose some people like them but I sure as hell wouldn't want to pay someone to make ridiculous rules and fine me for doing what I want on my own property,. I've heard some horror stories of HOA's and how they got a handicapped veteran locked out of his own home or not allow a wheelchair ramp to his home. It's really disgusting some of the HOA's have so much power and how they can do horrible things to people who are the actual owners of their homes but end up in some sort of foreclosure or expensive legal battle trying to get out from under one of them.
I love it, after the cop reviews the documents he agreed you weren't poart of the HOA.
